Minnesota has removed race as a preferential factor for determining which COVID-19 patients should receive scarce monoclonal antibodies, which are outpatient infusions that reduce the risk of severe illness and hospitalization. Updated rationing guidance on Wednesday prioritizes infusions when they are in short supply for people who are immunocompromised or pregnant. It also gives preference to people who are older or have underlying conditions that increase their risk for severe COVID-19, but it switched to a scoring system that no longer considers race.

The only shortage is what the government says can be delivered. There is plenty of supply if the government will just out of the way.

Why is it necessary for Big Government to be rationing any care? Why is the government not trying to boost production and availability of the drugs? When there was a shortage of ventilators and swabs in the early days of the plague, the President cut through the red tape and got things done. When there was a shortage of hospital beds in NYC, the President dispatched army field hospitals and a hospital ship to help. All we seem to get now is Soviet style rationing and excuses by the current president.

Republican Glenn Youngkin has moved ahead of Democrat Terry McAuliffe in the Virginia governor’s race, less than a week before the election. McAuliffe receives 45 percent to Youngkin’s 53 percent in a new Fox News survey of Virginia likely voters. Youngkin’s eight-point advantage is outside the poll’s margin of sampling error. That’s a big shift from two weeks ago, when McAuliffe was ahead by five, 51-46 percent. Among the larger pool of registered voters, it’s a one-point race: McAuliffe 47 percent vs. Youngkin 48 percent. Two weeks ago, McAuliffe led among registered voters by 11 points, 52-41 percent.

State Health Commissioner Dr. Norman Oliver told 8News on Friday that he plans to mandate coronavirus vaccinations for Virginians once one is made available to the public. Virginia state law gives the Commissioner of Health the authority to mandate immediate immunizations during a public health crisis if a vaccine is available. Health officials say an immunization could be released as early as 2021. Dr. Oliver says that, as long as he is still the Health Commissioner, he intends to mandate the coronavirus vaccine. An appellate court has tossed the death sentence and overturned three of the convictions of Boston Marathon bomber Dzhokhar Tsarnaev. The court in its ruling cited errors in the proceedings that found Dzhokhar guilty and condemned him to death, according to papers tweeted out by @Law360 senior Boston courts reporter Chris Villani. The ruling will not result in Tsarnaev being freed, and the death penalty can be revisited, according to an excerpt included with the tweet.

"The first African Americans sent into the English colonies came to Point Comfort, Virginia, in 1619. They were slaves. They had been captured against their will. Three Democratic members of the Staunton, Virginia, city council were ousted by Republicans on Tuesday despite receiving more votes than they did four years ago. Republican candidates Mark Robertson, Amy Darby, and Steve Claffey all joined incumbent Andrea Oakes in a four-seat GOP sweep, WHSV reported. The three incoming council members replaced Democratic incumbents Erik Curren, Ophie Kier, and James Harrington all almost doubled their vote totals from 2016, yet still lost. Local outlet Augusta Free Press reporter Chris Graham called the results “stunning almost beyond words.”

In a 4-3 decision, the Wisconsin Supreme Court on Wednesday struck down the state's stay at home order, handing a defeat to Democratic Gov. Tony Evers in his administration's response to the COVID-19 pandemic. With the governor's stay-at-home order suspended, Gov. Tony Evers and legislative Republicans will need to work quickly to come up with a replacement plan, otherwise it may be up to individual counties to implement a patchwork of their own COVID-19 regulations. In its order, the Supreme Court said Evers' stay at home order is "invalid, and therefore, unenforceable," so businesses and restaurants presumably may open immediately.

A county judge in Texas dealt a blow to Governor Greg Abbott's controversial 'Operation Lone Star' after ruling his national guard's apprehension of an illegal immigrant unconstitutional Thursday. Operation Lone Star was created by Abbott amidst a wave of illegal immigrants from Central America crossing the US-Mexico border.
