Minnesota has removed race as a preferential factor for determining which COVID-19 patients should receive scarce monoclonal antibodies, which are outpatient infusions that reduce the risk of severe illness and hospitalization.
Updated rationing guidance on Wednesday prioritizes infusions when they are in short supply for people who are immunocompromised or pregnant. It also gives preference to people who are older or have underlying conditions that increase their risk for severe COVID-19, but it switched to a scoring system that no longer considers race.

Republican Glenn Youngkin has moved ahead of Democrat Terry McAuliffe in the Virginia governor’s race, less than a week before the election.
McAuliffe receives 45 percent to Youngkin’s 53 percent in a new Fox News survey of Virginia likely voters. Youngkin’s eight-point advantage is outside the poll’s margin of sampling error.
That’s a big shift from two weeks ago, when McAuliffe was ahead by five, 51-46 percent. Among the larger pool of registered voters, it’s a one-point race: McAuliffe 47 percent vs. Youngkin 48 percent. Two weeks ago, McAuliffe led among registered voters by 11 points, 52-41 percent.

Beth Barts, a far-left member of the Loudoun County School Board, has resigned from her position.
First elected in 2019, Barts has been criticized by parent groups over Critical Race Theory and transgender policies in the school system. Her resignation, which will take effect on November 2, 2021, staves off an ongoing recall attempt.
“This was not an easy decision or a decision made in haste. After much thought and careful consideration, it is the right decision for me and my family,” said Barts in a statement Friday.

Dr. Anthony Fauci said Sunday that COVID-19 rules have “nothing to do” with the issue of US civil liberties — after he sparred with Republican Ohio Rep. Jim Jordan on Capitol Hill over whether the restrictions violated Americans’ rights.
The director of the National Institute of Allergy and Infectious Disease said Jordan was incorrect to claim that public health rules infringed Americans’ freedom.

State Health Commissioner Dr. Norman Oliver told 8News on Friday that he plans to mandate coronavirus vaccinations for Virginians once one is made available to the public.
Virginia state law gives the Commissioner of Health the authority to mandate immediate immunizations during a public health crisis if a vaccine is available. Health officials say an immunization could be released as early as 2021.
Dr. Oliver says that, as long as he is still the Health Commissioner, he intends to mandate the coronavirus vaccine. (snip)
Under state law, only people with a medical exemption could refuse the mandate.

An appellate court has tossed the death sentence and overturned three of the convictions of Boston Marathon bomber Dzhokhar Tsarnaev.
The court in its ruling cited errors in the proceedings that found Dzhokhar guilty and condemned him to death, according to papers tweeted out by @Law360 senior Boston courts reporter Chris Villani.
The ruling will not result in Tsarnaev being freed, and the death penalty can be revisited, according to an excerpt included with the tweet.

Sen. Tim Kaine claimed that the United States created the institution of slavery.
During Tuesday remarks on the Senate floor, the Virginia Democrat addressed the issue of accountability in police departments but later claimed that the U.S. created the institution of slavery.
"The first African Americans sent into the English colonies came to Point Comfort, Virginia, in 1619. They were slaves. They had been captured against their will. But they landed in colonies that didn't have slavery. There were no laws about slavery in the colonies at that time. The United States didn't inherit slavery from anybody. We created it," Kaine said.

President Trump's niece is set to reveal herself in a tell-all book as the confidential source behind a prize-winning story on the family's finances.
In Too Much and Never Enough, due in August, the daughter of Trump's late brother Fred Trump Jr. will detail “harrowing and salacious” stories about the president, people with knowledge of the book told the Daily Beast.
Mary Trump is expected to explain how she was a primary source for the New York Times's blockbuster investigation into Fred Trump Sr.'s business dealings, supplying tax returns and other confidential documents that showed how the president received nearly $413 million from his father's real estate empire

Three Democratic members of the Staunton, Virginia, city council were ousted by Republicans on Tuesday despite receiving more votes than they did four years ago.
Republican candidates Mark Robertson, Amy Darby, and Steve Claffey all joined incumbent Andrea Oakes in a four-seat GOP sweep, WHSV reported. The three incoming council members replaced Democratic incumbents Erik Curren, Ophie Kier, and James Harrington all almost doubled their vote totals from 2016, yet still lost.
Local outlet Augusta Free Press reporter Chris Graham called the results “stunning almost beyond words.”

In a 4-3 decision, the Wisconsin Supreme Court on Wednesday struck down the state's stay at home order, handing a defeat to Democratic Gov. Tony Evers in his administration's response to the COVID-19 pandemic.
With the governor's stay-at-home order suspended, Gov. Tony Evers and legislative Republicans will need to work quickly to come up with a replacement plan, otherwise it may be up to individual counties to implement a patchwork of their own COVID-19 regulations.
In its order, the Supreme Court said Evers' stay at home order is "invalid, and therefore, unenforceable," so businesses and restaurants presumably may open immediately.
