All fifty Senate Republicans are launching a formal challenge to President Biden's vaccine requirement for private businesses, as the Occupational Safety and Health Administration (OSHA) order is being challenged in court.
Indiana Sen. Mike Braun leads his 49 GOP colleagues in filing a resolution of disapproval against Biden's order that all companies with over 100 employees must require vaccines or weekly Covid-19 testing.
The disapproval resolution is guaranteed a floor vote, which Braun says he will set for early December. The resolution is filibuster-proof, meaning it needs only pass by a simple majority. If one Democrat signs on, the resolution would then need to be approved by the House.

Good point, OP. Lots of people have already been bullied into taking the needle or have been fired, but there's no particular urgency on their end as the entire US Congress and all of their staff are exempt. Also, not only should the federal mandate be undone, but it should also be unlawful for any company or organization to force this on anyone.

This is a good move.....but comes only after these wind indicators have sniffed that the courts are going to strike it down.
Once the parade is off and running.....the Repubs run around the front, huffing and puffing to catch up, to "lead".

The way I thought I understood this, is that the 5th Circuit ruled (quite brutally) to stop the mandate on GOVT. Employees and contractors. I heard today that the 6th Circuit (a conservative court) has been assigned the lawsuits about the PRIVATE mandates of companies over 100 employees. It does look like that will be struck down, too. It still bothers me that some private companies will still have their own mandates, and good people will lose their jobs over it. A good lawsuit or 2 might rectify that.
It does look like the GOP senators saw this and felt comfortable with this vote, which is most likely moot. Yet, it is still surprising they got Romney, Collins, and Murkowski to go along.

Won't matter one bit if the court reverses Brandon's mRNA jab mandate, as long as corporate leaders declare their own mandate (ala IBM and others) when told he plans to mandate the clot shots.
Though banning Federal mandates may spare the members of our military from dishonorable discharge (or worse) for not getting jabbed.

Two separate legal processes. The first, in the 5th Circuit was a STAY which blocked enforcement of the diktat while the issue was in the courts being decided. The stay was appealed, and the 5th Circuit Appeals court affirmed the stay. In each ruling they opined that the actual case would likely be found in favor or the plaintiffs.....against the diktat.
Next, in the 6th Circuit the actual case is being decided at the lowest level. The diktat will likely lose, then the DoJ will appeal to the 6th Circuit Appeals Court....and likely lose again. At that point the DoJ will try to push it up to the Supremes. The Circuit Justice for the 6th is Kavanaugh. If Kavanaugh rejects the request for certiorari (request for the Supremes to hear the case) then DoJ can ask ALL of the Supremes to review it. At that point, at least four justices have to vote to accept the case. If they don't accept the case, the ruling of the 6th Appeal will stand, which ever way that goes.
Seems likely that DoJ will push the whole stupid way, and I'd bet that Kavanaugh blocks certiorari, and then they fail to get four justices to accept the case and it ends with whatever the 6th Appeals says.
Just my guess. I have studied SCOTUS procedures in their own Guide for Reporters, available online, and this is how it seems that the system works.
Not a lawyer but have several lawyer friends and spent many frustrating hours being corrected by them about what I used to think was "clearly right". One pointed out, in response to my protestation that "that isn't justice", in a particular point of discussion, that "we do not have a justice system, we have a legal system. Sometimes the legal system dispenses justice. Sometimes not." I hate it, but she is right, and I can't change it.
