A U.S. district judge nominated by former President Barack Obama has dismissed a case against a shooting suspect from the Bronx in New York City over a lack of “diversity” in the jury. In her ruling, Judge Analisa Torres agreed with William Scott, the defendant, after he argued that there were not enough black and Hispanic people in the jury pool after an indictment was returned against him a year ago this month. Charged in the White Plains division of the Southern District of New York, Scott was allegedly in possession of ammunition linked to a shooting in the Bronx, the New York Post reported.

How are there not enough non-whites in the jury pool? In NYC? Give me a friggin' break. No way that stands up to any scrutiny, if any were applied.
For the record, just what is the minimum percentage of POCs required? Is this codified in law, or are you just pulling this out of your azz, judge?

If this judge's order stands, that is what we face: a jury consisting of 'equally disadvantaged' jurors. Dangerous territory.

A jury of this guy's peers would have no permanent address, because they are all out roaming the streets committing more crimes.

I have two issues with this. One is the reporting, which omits "grand" in the headline and lede. It was a grand jury, which decides whether to try a case, not a jury, which tries the case. Meaningful difference in this context. But shouldn't this still have just caused the case to be redirected to a more acceptable grand jury?
The other issue is the judge's ruling, which seems to overturn more than a century of precedent. Didn't courts decide ages ago that "a jury of ones peers" doesn't imply having the same race, age, or sex as the defendant?

Don't like it? Then VOTE! District Judges are elected every Six Years. Vote them out if they are no good! No other way to change things! New Yorkers don't like the way things are going in their State. Change it by VOTING!

13% of the population would mean a jury would require 1.56 blacks or one really black, black and an Obummer tinted black, one Puerto Rican, one Oriental and 8 whites. But since jurors are taken from the voting polls and we all know that blacks can't get registered because of racism, they'll never be a jury with the correct diversified makeup.

Sorry, #14: The first line makes it clear that this is in federal court: "A U.S. district judge nominated by former President Barack Obama. . ." Maybe state, county, or New York City district court judges are elected every six years, but federal district court judges serve until they choose to retire or are impeached by the Congress.
