A little less than a month after the confirmation of Justice Amy Coney Barrett, the Supreme Court on Friday issued a new set of circuit justice assignments, which take effect immediately. Barrett was assigned to the 7th Circuit, where she served as a judge for three years before becoming a justice. (snip) However, justices can and often do refer significant emergency requests to the full court ---a role that has taken on increased importance in recent years with the sharp uptick in activity on the court’s “shadow docket.” A map of geographical regions covered by each circuit is available here.   Correction*

The optimistic side of me wants to think that, no matter how compromised Roberts is, even he sees what is happening. The cynical side wonders what fresh skullduggery is this.

Trump campaign lawyers Rudy Giuliani, Sidney Powell, and Jenna Ellis gave a blockbuster press conference on Thursday in which they ran down the legal case for the president’s repeated claim that he won the 2020 presidential election. Giuliani insisted that the evidence the campaign has collected suggests that “more than double” the margin of votes required to flip the election in six swing states are provably illegal, meaning Trump will have won them when only legal votes are counted. Ellis insisted that the legal challenges are not aimed at reversing the preliminary election results, however, but at restoring election integrity.

Pollsters across the gambit told us that in 2020, Donald Trump would be lucky to hold his numbers from 2016. In fact, we were told he wasn’t going to win additional support from the minority community (he did), he was going to lose considerable support amongst women (he didn’t), and that there was going to be a massive Republican cross-over vote that would deliver the race to Biden (there wasn’t). Yesterday GOP Chairwoman Ronna McDaniel held a press conference and unveiled 131 affidavits and 2,800 incident reports documenting fraud and other irregularities in the election in Michigan. Reporters were unimpressed: In Wayne County, Republican poll watchers were denied their legal right to monitor the election and purposefully kept in the dark…there are thousands of reports of poll watchers being intimidated and unable to do their job and as of 4 p.m. this afternoon, 131 affidavits have been completed just in Michigan with over 2,800 incident reports that have been submitted to us since election day.

It’s unclear if the point on the 2020 election timeline has been reached that allows for serious discussion of legal challenges around what the Trump camp is suggesting looks like widespread fraud. Too early and the newly gracious and delicate media will revert back to hurling invective, painting those giving such insane notions quarter as mad and pathologically incapable of just letting a legitimate loss go. Vote counting continues in four critical states as of early Thursday morning — Pennsylvania, Georgia, Arizona, and Nevada. Pennsylvania and Georgia are stories unto themselves. There are reports that both have evaded any efforts at transparency in what they are doing behind closed doors, and little or no reporting about why it is they have not been able to accomplish completing their vote counting nearly in one or two urban cities when the vote-counting in nearly the entirety of the remainder of the stated has been finished for some time. (snip) For now, I want to focus on the status of counting in Arizona and Nevada.

Michigan was set to be a state that went to Trump but miraculously, a bunch of early votes was found and every one of them was a ballot with Joe Biden’s name on it. When I say “every one of them” I mean every single one. Not one of these ballots had a Trump vote on them. This kind of thing is far from normal and is worth investigating. Twitter users also found this to be so unlikely as to be completely unbelievable.

The Dow Jones Industrial Average is soaring Tuesday morning with shares of Walgreens Boots and JPMorgan Chase delivering strong returns for the price-weighted average. The Dow DJIA, 2.12% was most recently trading 586 points, or 2.2%, higher, as shares of Walgreens Boots WBA, +3.91% and JPMorgan Chase JPM, +3.18% have contributed to the index's intraday rally. Walgreens Boots's shares have risen $1.46, or 4.1%, while those of JPMorgan Chase have climbed $4.03 (4.0%), combining for a roughly 36-point bump for the Dow. Also contributing significantly to the gain are Goldman Sachs GS, +4.18%, Cisco CSCO, +2.98%, and UnitedHealth UNH, +3.17%.

I missed most of the debate last night, because it occurred during the dinner hour out here on the left coast, and dinner is a sacred institution in our household. But I saw enough to see why everyone thinks it stunk. I did, however, flip around to take in some of the post game show on several news channels, and I was struck by how uniformly glum the liberal network news types were. The subtext here was that Biden was weak in the face of Trump’s boorishness. The fact that so many media figures are saying the next two debates should be canceled is quite telling.

The Big Ten announced Tuesday that its Council of Presidents and Chancellors has voted to allow the league to play football in fall 2020. The Big Ten will open its season on the weekend of Oct. 24 with teams playing eight games in eight weeks and a Big Ten Championship Game scheduled for Dec. 19, sources tell CBS Sports' Dennis Dodd. That would make the Big Ten eligible for the College Football Playoff as the final CFP Rankings announcement of the season is set or Dec. 20. The conference will now feature daily, rapid COVID-19 testing as a focal point of its return to play plan.

Baker Mayfield has done an about face. The Browns quarterback, who insisted in June and reiterated in August that he’d be kneeling for the national anthem, had announced via social media that he will stand. (snip) "I have been showed that a gesture such as kneeling will only create more division or discussion about the gesture, rather than be a solution towards our country’s problems at hand. In another sense, business has never been better. In June and July, Fox News was the highest-rated television channel in the prime-time hours of 8 to 11 p.m. Not just on cable. Not just among news networks. All of television.

You probably already know that Trump’s legal team announced that Sidney Powell is not a team member. The brief statement leaves unanswered the most important question: “Why?” Absent solid information, speculation leads us either to “This is the beginning of the end” or “This is all part of the plan” – and I’m leaning to the latter. (snip) If Powell represents the campaign, the government regulates individual donations. If she’s apart from the campaign, things are less constrained. Amazingly, it appears that Trump’s own campaign is now disowning Sidney Powell’s fairly out there claims about German servers and millions of switched votes. And I don’t say that as someone who wouldn’t want to believe it if there was proof, but there was obviously no proof and plenty to the contrary. Here’s the Trump campaign today essentially telling Powell to go jump in a lake, which is probably the most surprising development of the last several months. Well, this is awkward.
