The State of Texas filed a lawsuit directly with the U.S. Supreme Court shortly before midnight on Monday challenging the election procedures in Georgia, Michigan, Pennsylvania, and Wisconsin on the grounds that they violate the Constitution.
Texas argues that these states violated the Electors Clause of the Constitution because they made changes to voting rules and procedures through the courts or through executive actions, but not through the state legislatures. (snip) Texas approached the Supreme Court directly because Article III provides that it is the court of first impression on subjects where it has original jurisdiction, such as disputes between two or more states.

In PA we have legislators with no backbone. All the republicans in the House and Senate voted for Act 77 (mail in ballots) and gave the liberal governor everything he wanted. Now, they don't want to convene and fix this mess because they said they can't because it would be unconstitutional to convene now. I said, vote them out in 2022. This is sad that we have to rely on Texas to do what our legislators in PA should have done. I promise that I will remind the conservatives in PA in 2022 how our republican legislators screwed us and our president Trump.

As a lawyer, I find the legal argument really compelling. The Covid-Democrats overstepped the boundaries of the Constitution. Let’s hope the Constitution prevails and the House decides the election.

Yes! Jay Sekulow said this would happen, and he said every state without voting issues/every red state can do this! These four states plus Arizona and Nevada affect the outcome of the election, and because of their cheating, fraud, etc., they dilute our votes and disenfranchise the rest of US if their fraudulent elections are allowed to stand. Somebodies are going to be in big trouble for their illegal actions and for certifying fraudulent elections--GA SoS, Michigan SoS, PA SoS, Wisconsin SoS, governors, and obama judges.
I hope I'm understanding this right, as poster #4 stated it, but wouldn't this violation of the Constitution affect even the Republican legislatures who wrote elections laws for mail in ballots (PA, for example) without going through the required processes-amendments and votes of the people? Could this be why the Republican legislatures and governors were "scared or hesitant" to act? If so, they are in a position to redeem themselves by not playing any games with the electors, if it Looks like somebody finally figured this out, or they knew it from the beginning. This is HUGE, poster #2!
Elector seating Tuesday is going to be an interesting day. South Carolina, where are you? Before leftists start screaming about ACB, Roberts should recuse himself.

A certified poll watcher on Dobbs last night said he was more disappointed in the republicans rolling over in Pa. than the dems. Maybe Cruz can argue for Texas? Republicans could take some lessons from the dems how to fight for their cause. Cruz is the only senator standing up for Trump. 222 house members refuse to acknowledge Biden as the winner.

If the Legislators are the ones who will choose the Electors, and they do NOT choose TRUMP Electors, they should be recalled. No waiting until 2022! They should have Billboards with their pictures that state, DO YOUR JOB! You were elected by Republicans! You can be recalled by Republicans!

This is actually brilliant. The United States of America is in fact a legal compact between its states. Each state therefore has standing legally to challenge the actions of other states that subvert that compact, namely the Constitution.
Thank God that Texas is standing up to make this challenge. Go Texas!

If nothing else, this will make Chief Just-Us Roberts squirm in his chair. He has to read the Constitution and dream up a new 'Amendment' to keep the status quo going. Just now he doesn't have 4 reliable Associate coward legislators (known as Associate Just-Uses) on the Court to count on voting with him. And some of the other Justices on the Court that have read the Constitution are now publicly mocking Roberts for his lack of legal and constitution knowledge.

I think if Florida and Ohio along with other states that held honest elections would join Texas in this suit it would add to our chances. Also, Arizona, Nevada and Wisconsin should be added to the list of defendants

Love Texas....were men are men and WE women love them...when I travel to Texas I'm always treated with respect and doors are opened for me... I'm affectionally called "Mama" and watched over... it's a treat to go shopping and be treated like a lady...I feel sorry for the young women who don't know that feeling... they are so angry and unhappy... sad!!

OP is correct, this is essential to sending the election to the US House. PA's 20 Electoral Votes were not enough. I was relieved to see this story this morning, and I am hoping that it's Clarence Thomas who delivers the majority opinion that I'm hoping for and cautiously expecting.

Read the MOTION...Texas did not "file a lawsuit", it requested the court's "leave to file the complaint..."
It's an interesting angle to attack. The problem I see is that, if it even grants the motion, SCOTUS will simply deny relief on the theory that the legislatures did nothing to stop the modifications, thus gave tacit approvals to them. I don't doubt, in the case of GA, that SCOTUS will point out that the election apparatus is under Republican control, and it re-certified the election after three re-counts.

Every state that ran a clean election should do this. I told dh this a month ago. Thievery and fraud in one state disenfranchises the voters in every other state.
The Constitution has remedies if the Supremes have the guts to enforce them.

The question in my mind is this: can any individual American, or any other state, also disenfranchised by the unConstitutional actions of other states' election process, also join suit with Texas, or file their own independent lawsuits?
I'm pretty sure the answer is 'Yes,' but as a non-expert, I'd like to hear some commentary from experts on the matter....
And incidentally, as a Texan, I will find out who the local movers are that drove this lawsuit into reality, and support them come their next election.

Instead of releasing Krakens and other such nonsense, this should have been the tack that the Trump Campaign's legal team should have been taking all along. The Constitution is very clear on who gets to set election law, and it's even clearer that those four Blue Wall States crapped all the Constitution. Now it's up to SCOTUS to do the right thing and throw out those four states' EC Votes.

Yeah, the Fake News is constantly going on with this stuff about "your voice, your vote," but they took away my vote by allowing vote fraud to take place every election. All these smug, belligerent, thoroughly hypocritical leftists used every trick in the book to steal the election, then have the nerve to tell all of us that accusations of vote fraud are "baseless." Without bothering to lower themselves to actually look at any of the evidence.

SEVEN states have now joined Texas lawsuit, arguing that the Equal Protection Clause has been violated in this election from state-to-state!
Louisiana, Arkansas, Alabama, Florida, Kentucky, Mississippi, South Carolina, South Dakota.
I have never lost hope and have grown a little tired of dragging all my Debbie Downer friends out of the ditch of despair. This should be helpful.
