Jordan Neely’s father is suing Daniel Penny over his son’s chokehold death on a New York City subway car as the jury still deliberates whether to convict Penny of manslaughter. The suit, filed in New York Supreme Court on Wednesday, accuses the Long Island Marine veteran of negligent contact, assault and battery that caused injuries and Neely’s death last year. Neely’s father, Andre Zachary, “demands judgment awarding damages in a sum which exceeds the jurisdictional limits of all lower Courts which would otherwise have jurisdiction,” according to the lawsuit.

In turn, every person on that subway train should sue Jordan Neely’s father for raising and knowingly let a dangerous predator in public. The fathers responsibility in this case is like allowing a child to take the fathers gun to school.

Why does the alleged father have the last name Zachary and his alleged son have the last name Neely? I doubt that this lowlife grifter is actually Neely's father. I would also guess that the mother has a different last name than her son as well.

Neeley is dead because his family didn't look out for him. Where were they when he was roaming loose? If he hadn't died on the subway, who's to say he wouldn't have been hit by a bus or a car? They knew he was unstable, a danger to both himself and to others. Penny should counter-sue on general principle.

The idea for a lawsuit was probably initiated by an ambulance chasing lawyer ( they like to call themselves “personal injury attorneys”). There was probably a rush of scum bags to the father’s door, each promising untold riches. The father hired the best promiser. I have had two unmerited lawsuits filed against me. In the first one, the ambulance chaser dropped his claims because of embarrassment. The second is still in negotiation with my insurance company. My insurance rep said filing lawsuits is an easy way to make a living - learn how to fill out the forms and you might get lucky. I advise my friends to carry excess insurance coverage known as an umbrella policy. If you are sued, your insurance company will hire a lawyer to defend you. They keep lawyers on retainer just for that.

Here we go. Criminal court is different than civil court. To all gun carriers, before you decide to use your gun in self-defense - even if there's a glaring need to do so, on camera, with eye witnesses, you may be found not guilty in criminal court. But there's a much higher likelihood you'll be found liable for wrongful death or something similar in civil court. That's where the $$$ payout comes in. I took a CHL course in Texas and the instructor just about gave every reason in the world not to use a handgun. This is what Penny's going through now. This is what OJ went through (who was found not guilty criminally, but he got his backside burned in civil court). And the lawyers in the cases laugh all the way to the bank.

A Manhattan judge on Friday agreed to drop the top charge against Daniel Penny in the subway chokehold death of Jordan Neely. “We move to dismiss the top count of manslaughter in the second degree,” Assistant District Attorney Dafna Yoran told the court at around 3:30 p.m. The judge then signed off on the request — which came after jurors twice said Friday they couldn’t come to a verdict on the manslaughter rap. The 12-person panel will continue deliberating Monday on the lesser charge of criminally negligent homicide, which Penny, 26, faces in the fatal May 2023 encounter aboard an uptown F train.

(AP) — Wisconsin Republican Eric Hovde conceded defeat on Monday to Democratic incumbent Tammy Baldwin in their U.S. Senate race, saying he did not want to “add to political strife through a contentious recount” even though he raised debunked election conspiracies. Hovde, who was backed by President-elect Donald Trump, could have requested a recount because his margin of defeat was less than 1 percentage point, at about 29,000 votes.
