Sources close to former President Trump say he has a plan for keeping Congress from ever again forcing him into “disgraceful” and “ridiculous” spending situations. If he returns to the White House, Trump will seek to resurrect authority that Congress stripped from the presidency almost a half century ago. What President Nixon squandered, his campaign promises, Trump will restore, namely the impoundment power. “A lot of you,” the former president told a New Hampshire crowd Thursday, “don't know what that is.” Indeed, few now remember it. Impoundment, if restored, would allow a president, in theory, to simply refuse to spend appropriations by Congress.

Richard Nixon was the absolute WORST Republican President in our nation's history from a Conservative's standpoint. He ended up being the long term best friend of the Democrat Deep State. If we could turn back the hands of time and start over, I'd recommend going back to Eisenhower's Presidency. It was the best of times for our nation. Economic problems were non-existent and our borders and international relations were under control. I like Ike!

The article does a fair job of describing the 1974 Congressional Budget and Impoundment Control Act but that is not the only potential impediment to impoundment by the president. Picking and choosing which activities to fund or defund, would likely run afoul of the Constitution's Take Care clause: "he [the president} shall take Care that the Laws be faithfully executed..." Most appropriation laws are passed after an authorization law has been passed. For example, the FAA is subject to re-authorization every five years. Annual appropriations of the FAA and other previously authorized agencies and activities is thus a function of two laws, so the Take Care clause appears relevant when it comes to impoundment of authorized and appropriated funding; however, if Trump's party and political allies control Congress, it is doubtful that any Congressional challenges to impoundment would surface, beyond disgruntled democrats. It would be easier and not present a Constitutional issue if some portion of the appropriated funds are obligated. That view stems from the yet-to-be-shot-down theory that the appropriations set a ceiling on funding certain agencies and their activities but does not mandate that the totality of funds appropriated must be spent/obligated. Suffering a slow death doesn't make you any less dead. It is an interesting issue and one that may be decided by the Supreme Court. A president's ability to impound funds is not absolute, even aside from the 1974 law regarding impoundment control. Under Nixon, Congress argued that impoundment was serving as a line-item veto, not specifically authorized under the Constitution or public law. In an 1838 Supreme Court case, US v Kendall, the court ruled that specific language in an appropriation, directing funds for a particular activity prohibits a president from impounding those funds. Of course, that led to a proliferation of earmarks, by-and-large intended to benefit specific congressional districts. Like "read my lips, No New Taxes" Bush 41, Trump also made a never again pledge regarding his signing of multiple trillion dollar spending bills, then followed by signing two more to the tune of $2.7 trillion dollars. Like Bush, I'm sure Trump was well meaning but the separation of powers built into our political system, requires a crusading president to have a majority of co-crusaders in Congress and friends in the Judicial Branch.

Every year at Christmastime, news sites reprint the touching letter from a little girl, Virginia O’Hanlon, asking about Santa Claus and the columnist’s reassuring, fatherly response. He doesn’t smack her with the hard fact that Santa is a fictional creation. He points toward a deeper truth about our shared celebrations and the web of fond memories that bind together generations of children, parents, aunts and uncles, and grandparents. As we celebrate this Independence Day, we desperately need to remember our own shared beliefs and ideals in hopes they will bind together our divided nation. Our shared ideals and common identity as Americans should bind us.

The decision of the Supreme Court to end the use of race in college admissions was not unexpected. Yet, President Joe Biden expressed outrage and actually claimed that the court gutted the constitutional guarantee that "all men and women are created equal." In declaring that this court was not "normal," Biden further insisted that these admissions decisions and the Dobbs abortion decision reversed the gains that "we fought a war over in 1860" to secure.

They are in various ways undermining the tradition of self-reported income tax computation and voluntary compliance. Our tax institutions, of course, are based on the real deterrence of a disinterested, uncompromised Internal Revenue Service. Poland is deploying additional police personnel to its border with Belarus to strengthen security, Interior Minister Mariusz Kaminski said on Sunday. From the Supreme Court to America: Happy Individual Independence Day. OK, the court didn’t actually say that, but its key rulings did. The final cases rang out with a consistent clarity that the Constitution favors individual liberty over group rights and government power. The distinction is what helped make America different from the start, yet to witness the hysterical outcry against the rulings, fewer and fewer Americans understand the founding principles. Either that or they want to trash American exceptionalism so they can force everybody to think alike.

Boston University School of Law students were offered therapy after three controversial Supreme Court decisions this week about affirmative action, religious freedom and student debt forgiveness. The BU Law Student Government Association's (SGA) statement, sent out to law students Friday afternoon, denounced the three Supreme Court decisions of the week: Students for Fair Admissions v. An Obama-appointed federal judge on Monday issued a preliminary injunction against Florida’s election law that imposed limitations on third-party voter registration organizations. In May Florida Governor Ron DeSantis (R) signed SB 7020, a law that barred non-citizens from handling or collecting voter registration forms. One of the plaintiffs in the lawsuit is an immigrant from El Salvador who works for “Mi Vecino,” a third party voter registration organization. US District Judge Mark Walker said the election law banning non-citizens from handling voter registration forms is unconstitutional.

I’m a white writing professor, and apparently, that’s a problem. That was the unmistakable message sent to me at Pennsylvania State University—and that’s why I’m suing the school. In November 2020, nearly half a year after George Floyd’s murder in Minneapolis, I was subjected to a video titled “White Teachers Are a Problem” for a monthly professional development meeting for writing faculty. The video’s featured speaker, Asao Inoue, is a self-described practitioner of anti-racism. Not an obscure one, either: About a year prior, Inoue gave the Chair’s Address at a prestigious writing studies research conference and declared, “White people can perpetuate white supremacy by being present.Your body perpetuates racism.”
