Elena Kagan, Sonia Sotomayor trade jabs

Supreme Court Justice Elena Kagan appeared to take umbrage at Justice Sonia Sotomayor’s majority opinion in a copyright case involving Andy Warhol and Prince, telling readers in her dissent that she would trust their “good judgment” rather than counter her colleague’s “fistfuls of comeback footnotes.” The shot at Kagan’s fellow liberal came in a lengthy second footnote of her dissent, which several Supreme Court observers found “interesting” and “noteworthy.” . . . Kagan wrote, “ . . . the majority opinion is trained on this dissent in a way majority opinions seldom are. Maybe that makes the majority opinion self-refuting?”

Comments:

Fascinating to witness the level of mutual animus emanating from two liberal, female, Obama appointees to SCOTUS.

Maybe the Wise Laxtinexa is getting on her nerves. I wonder if Kentanij's long soliloquies are also like nails on a chalkboard for the other justices.

Kagan is a repulsive slob who never created anything of value, so ruling that anyone can steal anything for any purpose, is fine with her. She can't even be bothered to write a coherent response. Inspiration, parody, even limited copying are accepted standards. She is too stupid or the people who paid her didn't provide a script to make an argument that Warhol could do what he did. He didn't bother changing anything from the photo except to make it high contrast for silk screening. It was a copy without consent. he was a lazy thief who thought he could do it because it did it before.

Former Clinton White House Communications Director George Stephanopoulos, now host of “This Week” on ABC, commented on the results of a recent ABC News/Washington Post poll Sunday. The short version: “This poll is just brutal for President Biden.” Stephanopoulos was introducing ABC News Political Director Rick Klein, who went into the specifics. “The skepticism over his leadership extends deep inside his own party,” Klein said of President Joe Biden. As evidence, Klein said that only 36 percent of the Democrats surveyed by the poll said that the incumbent should run for a second term. More than half preferred “someone else,”

Senate Republicans found themselves shaken and disoriented Thursday after finding out their leader Sen. Mitch McConnell (Ky.) was in the hospital after tripping at a private event, raising questions about his health and future leadership of the GOP conference. McConnell, who in January became the longest serving party leader in Senate history, has led the Senate GOP conference since 2005 and has helped guide his colleagues through some of the biggest moments in recent history — the 2008 financial collapse, the near default of the U.S. government in 2011, the fiscal cliff of 2012, the two impeachment trials of …

On a clear, sunny day in April 2014, two F/A-18s took off for an air combat training mission off the coast of Virginia. The jets, part of my Navy fighter squadron, climbed to an altitude of 12,000 and steered towards Warning Area W-72, ... Just at the moment the two jets crossed the threshold, one of the pilots saw a dark gray cube inside of a clear sphere — motionless against the wind, fixed directly at the entry point. The jets, only 100 feet apart, zipped past the object on either side. The pilots had come so dangerously close

New York — The New York City suburbs nearly cost Gov. Kathy Hochul her job. Now, far from treading with caution, she’s pushing a proposal that may be radioactive in the bedroom communities that dot the region: A plan to mandate more housing in those suburban counties, some of the nation’s largest and wealthiest. Hochul wants to give the state bold new authority to override local zoning laws in cases where municipalities resist the measure, which she hopes will help address a housing shortage that’s made New York one of the least affordable places in the country.

U.S. Senator Maggie Hassan gave the Nashua Chamber of Commerce an ultimatum: Boot Don Bolduc off the stage at its upcoming candidate event, or she walks. For months, the Gate City’s business organization had planned to host a debate between the two major-party nominees for U.S. Senate for its members and the Nashua community. And according to Chamber President and CEO Wendy Hunt, both Hassan and the GOP nominee, retired Gen. Don Bolduc, had agreed to participate. But on Thursday, Hunt contacted the Bolduc campaign with news that Hassan would not participate in the event if she and Bolduc were

Flint, Michigan’s longtime city clerk is retiring after an election integrity group sent a letter to her office demanding she balance out the number of Democrat and Republican election inspectors. On Sept. 6, Pure Integrity Michigan Elections sent a demand letter to Flint and City Clerk Inez Brown threatening legal action if they do not balance out the number of partisan poll watchers before the November general election. As previously reported, during Flint’s Aug. 2 primary, the city hired 422 Democrats compared to just 27 Republican election inspectors — in direct violation of a Michigan state statute that requires equal

Liberal media reports have NBC canning Chuck Todd as host of Meet the Press. His ratings tanked and his fellow liberals mock him weekly . Gelles, a long-time CNN producer who helped develop the now-defunct CNN+ streamer, was parachuted in to help fix the sinking show, which is down 21% in total viewership and 24% in the key advertising demographic compared to last year . . .."

There has been much perfervid shouting and rending of garments (or these days, parading about with red splotches on the crotches of their clothing or performative displays in Handmaid's Tale costumes -- red hooded capes) to protest the Supreme Court’s decision in Dobbs v. Jackson Women’s Health Organization. On the other hand, those opposed to abortion hail this decision, claiming abortions will end or be much reduced. Neither side is right. I believe the decision will not substantially lessen the number of abortions. On the other hand, I do think that it signals a significant retreat from the days when

Florida recently passed a law that leftist opponents and their collaborators in the media have branded the “Don’t Say Gay” law. Actually, however, the law does not say “don’t say gay.” [snip] Note the classrooms to which this prohibition applies – only kindergarten through third grade. And note the persons to whom it applies – only instructors, not students. And note the subject to which it applies – only sexual identity and sexual orientation, not any other sex issue. But using authority figures like teachers to indoctrinate kindergarteners into the wonders of transsexuality is something the left wants. Predictably, they’re PO’d about this

Ukraine appears to be feeling some of that frustration that we have felt with Joe Biden with his general failure to be effective on virtually anything. Ukraine is under huge assault from Russia, with a convoy bearing down on the capital city of Kyiv. Ukrainian President Volodymyr Zelensky said he hoped that Joe Biden could say something “useful.” But Ukrainian Member of Parliament Oleksandra Ustinova said this morning on NBC’s “Today” that Biden’s speech was “a total disappointment. The revelation came during a Dec. 8 exchange with Sen. Jeanne Shaheen (D., N.H.), who asked how Adm. Christopher Grady intends to implement "women, peace, and security" legislation within the Joint Chiefs of Staff. "The role of a gender adviser is a way to attack a very significant issue, and if confirmed

Republicans make up over 60% of registered voters in Nassau County which left many Conservatives in the county feeling absolutely blindsided by the error. Nassau County Executive Bruce Blakeman told NBC 4 News “We’re already starting to get phone calls from people, saying ‘I’m a registered Republican, I’m a registered Conservative – how come I’m being identified as a Democrat? Every so often, the race industry in America — let’s call it what it is — seemingly feels like they are not getting enough attention, and so they come forward with some new absurd way to get that attention, apparently clinging to the notion that there is no such thing as bad publicity. The latest to attempt that is far-left congressional squad member, Rep. Cori Bush (D-MO). Bush has glommed onto an idea that is certainly not new and is hugely unpopular with roughly half the country. But Bush has decided to give it the old college try and float it once again.

Before we dig into the main course, a few words about polling in general. First, it’s been my experience that many—if not most—casual poll watchers tend to pay selective attention to polls, not unlike Fox News or CNN viewers who watch various on-air personalities to be told what they want to hear. Second, we’ve seen candidates laud the results of a particular poll when its results favor them, then turn around and call the exact same polls “fake” when they don’t like the poll’s latest results. Third, while pre-primary polls conducted among likely voters of a single party might be lauded by various candidates and their followers, polls conducted among
