The 'special master' going through documents seized at Mar-a-Lago has given Donald Trump's lawyers eight days to back up his claims that FBI agents planted material while carrying out a search of his club.
Judge Raymond Dearie included the order in a new 'case management plan' for processing through some 11,000 documents – and follows Trump repeatedly making the allegation publicly without offering evidence of FBI misconduct.
'No later than September 30, 2022, Plaintiff shall submit a declaration or affidavit that includes each of the following factual matters,' the judge wrote,

1, if Trump/his lawyers said evidence was planted (I don't know if they did say that), then it's a very serious charge that needs to be addressed. How is asking for evidence of such a serious thing bad?
If the evidence exists, ok great, show it. If not, then don't say dumb things. This is court, not TV.

Let's see, the FBI has been "investigating" Trump for over 6 years, giving him the "special treatment". Now, the special master gives Trump 8 days to prove the FBI did anything wrong.

it was not an accusation of things being planted, just an inference that "Who could possibly know?", that the chain of custody and means /methods used "Might" have been contaminated, thus...arguable in admissibility. Plus, if they want to charge him for "Possessing" them they must prove that he did so knowingly and intentionally in violation of the Law...rather than inadvertently in boxes hurriedly packed by GSA staffers, not under his direct supervision, then shipped to a previously approved/secure storage space(the same and greater classification documents were regularly sent/used/stored at Mar a Lago) that he had not gotten around to sorting through yet, not only for Presidential Library stuff, but also for the DOZENS of legal cases, congressional case etc he is currently under barrage with. Some of this stuff may be germane proof of Hillary/DOJ/FBO collusion in planting fake stories to be presented in his lawsuits against her/them, and/or defense against the ones they have(will be) filing against him.

Could be there is something on those Security Tapes that makes him think they planted something. He did say a few days ago he would release them at the right time. Maybe there is some Hanky Pankey on those Tapes! I wouldn't put anything past the FBI at this point!

When one side has possession of all of the evidence, there is the opportunity for spoliation. Anyone who thinks after what DOJ represented to the FISA court that it is above augmenting, replacing, or rewording critical documents has been living in a cave for the past three years. Judge Dearie should have begun by retaining a DOD-qualified copying firm to photocopy and paginate the documents. At least that would prevent any mischief going forward. Requiring Trump to provide proof that the seized documents have been supplemented since their seizure is an abuse of judicial discretion.

Chain of custody is an excellent point. And the burden would be on the doj to prove every single document was properly handled and accounted for and not added to later.
If you don't believe they'll be required to do that by a court then the entire legal process is meaningless anyway and there's no point in discussing the finer points of legal details.

The moment those documents were moved by the FBI, all bets are off. This agency has been proven to be less than truthful to a FISC. What makes anyone believe they are pure as the driven snow now? The DOJ and FBI have not thrown in the get Donald Trump towel. They are actively seeking any advantage, legally or illegally, to bring him down. I don’t trust them, this judge and frankly anyone who presently has any connection to this case. There’s too much willingness to violate the law in order to get the result they need. PDT will never get a fair hearing. There is just too much corruption and bias surrounding this DOJ.

Is common sense "proof? Please explain to me WHY Trump or his associates would take ONLY the CONTENTS of the "classified" folders and leave the empty folders themselves strewn all around the room? Just from an "ease" point of view, wouldn't he just grab the "classified" folders AND their contents---leaving NOTHING behind that would even indicate that something was missing?

I thought that the so-called Special Master’s responsibility was to sort through all the documents, that are supposedly classified and un-classified, that were seized by federal authorities at Mar-A-Lago, and not to question what Trump may have said or not said following that happening?

The FBI is politicized and can no longer be trusted that much is a given.
As such the shoe needs to be placed on the other foot, the FBI should be made to prove every single document in evidence was removed from the home and from where in the home. It should now require a 3rd party to film every, member and aspect of a raid who must simultaneously release a copy of the video to the home owner and FBI prior to leaving the property.
The FBI should also be required to wear a body cameras that must be on at all times and a copy of these videos given to the home owner prior to leaving the property this way there are no questions about evidence obtained.

The order isn't legal. Defense doesn't need to show their hand, but the DOJ has to release everything. Of course these days everything is backward so the order makes total sense.

How would Trump prove that the DOJ / FBI planted evidence during the search if he and his team do not have access to the items seized or were not witness to what items were actually seized during the search. The DOJ provided the inventory of what was seized. They could have put anything that they wanted to put on the inventory. Even things that were not there but were added later. They may have also have omitted some items that were taken that could prove damaging to Trump at a later date or prevent Trump from using them to defend himself. Nobody will ever truly know. As usual, the judicial system will be severely slanted in the crooked DOJ's favor.
