Supreme Court Blocks Biden's Vaccine Mandate
for Private Businesses

Original Article

The Supreme Court on Thursday blocked the Biden administration’s COVID-19 vaccine mandate for private businesses but decided to let a separate regulation that requires health care workers to get a vaccine take effect. In a 6–3 ruling, justices halted the mandate for all private employers with 100 or more workers, ruling the states and companies that challenged the rule were likely to succeed. Biden administration officials had argued that the Occupational Safety and Health Act (OSHA) of 1970 gave them the authority to impose the mandate, but a majority of justices disagreed.

In my lifetime - - at least half of the Pubbie-appointed justices have gone over to the dark side - - but - - none of the commie-socialist justices have. This has been true for every Pubbie president - - from Eisenhower (Warren) - - to Nixon (Blackmun) - - to Reagan (O'Connor) - - to Bush (Souter) - - to Bush (Roberts) - - to Trump (Kavanaugh). Why is that? How can every Pubbie president be so foolish? Can't we ever catch a break?

This still cripples our healthcare system, as many workers quit rather than submitting to the shot. However, I’ve read that some hospitals, realizing their self-imposed predicament, are now begging nurses to come back without the shot.

IMHO this was a totally flawed decision by the SC. Unless I missed something in my high school civics class, it isn’t the job of the Court to decide if virus vaccinations are a good thing or bad thing for any particular group of people. Their job is to rule on the constitutionality of the law. How can this be unconstitutional for private businesses unless that business is healthcare? What happened to Equal Protection? And my comments have nothing to do with the efficacy of the vaccines.

Do the liberal justices on the court understand that their "feelings" don't count? Are they not aware that their job is to protect the people against tyranny by defending the constitution? How are these 3, and we know who they are, even on the SCOTUS? If they don't understand their job they should be removed.

A very small percentage of the Supreme Court's opinions are decided upon, or even involve, the U.S. Constitution, as the Court operates under its "Doctrine of Constitutional Advoidance." This doctrine was described by one of the Court's most famous justices, Felix Frankfurter, when he wrote, “[i]f there is one doctrine more deeply rooted than any other in the process of constitutional adjudication, it is that we ought not pass on questions of constitutionality ... unless such adjudication is unavoidable.”

General Electric suspended its Covid vaccine and testing requirement on Friday after the Supreme Court blocked the Biden administration’s mandate, a company spokesperson told CNBC. GE, which had174,000 employees at the end of 2020, has encouraged its employees to get vaccinated, the spokesperson said. The Supreme Court’s conservative majority, in a 6-3 ruling, called the Biden administration’s requirements a “blunt instrument” that “draws no distinctions based on industry or risk of exposure to Covid-19.”

The U.S. Supreme Court ruling on Thursday allowing the Biden administration to continue mandating COVID-19 vaccines for most health care workers is “really unfortunate” and a “big mistake” from a health policy perspective, said Dr. Jay Bhattacharya a professor at the Stanford University School of Medicine. Bhattacharya, a senior scholar of Brownstone Institute, told The Epoch Times the ruling presents a situation that is “FUBAR,” a military slang term that stands for “[expletive] up beyond all repair.” “That’s what this is, right? This is FUBAR,” he said, adding, “From a health policy perspective, from a public health perspective, it is a big mistake.”
