These retired Navy personnel served their time protecting and defending the Constitution. To Hell with the Office of Naval Intelligence for telling these brave men and women that they can't practice their 1st Amendment right to free speech!!!! And this is exactly what the 1st Amendment refers to -- the federal government controlling speech!!!!

The fact they have to remind everyone of this is telling. Whereas during Trump there were a few scurnbags looking to cash in, there must be a huge upswelling of hatred and disgust for this deranged old fool who was selected into office.

More limiting freedom of speech is not the answer. Biden is not cognizant of his surroundings and may not be the one running the country. His statement about he was instructed to call on particular reporters is a strong indicator that he isn't in charge. His actions concerning Afghanistan were not appropriate for the situation and he should be impeached for going against the military and intel agencies and closing Bagram AFB. Wrong move at the wrong time.

Sorry, retirees are free to speak their minds in public. Active duty and reserves, not so much, "good order and discipline" and all that. But once you are out of uniform for good.....I'm pretty sure that your freedom of speech is renewed. And even the wording of this mess only points to "ONI retirees" not "reflecting poorly on ONI". And not being able to hand out partisan literature. I suspect that for retirees, this has never been tested in court. I wouldn't personally want to be that test case, but if it is tested, it seems likely that retirees should have their full civil rights as the civilians that they are.

Not to worry....I'll disrespect Traitor Joe Xiden and Heels Up Harris enough that no former line officers will need to. Retired officers are still subject to the USMCJ if they continue to draw retirement pay. Thus they must not criticize the President and a list of other officials. Read on: Both Articles 2 and 88 have been held by the courts to pass constitutional muster, including the First Amendment’s freedom of expression. Whether a general’s statement about Secretary of Defense Donald Rumsfeld’s handling of the war in Iraq violates Article 88 would have to be determined by a court-martial. The solution for a retired officer concerned about violating Article 88 but feeling compelled to speak out would be to resign his or her commission and forfeit military retirement. Drawing one’s military compensation means you are agreeing to remain subject to the UCMJ. https://cdn.ymaws.com/www.roa.org/resource/resmgr/LawReviews/2006/0615-LR.pdf Rather than winging it and ending up wrong, why not look these things up? It’s not hard.

How would they recall hundreds of thousands of retired veterans back on active duty and court marshal them? If that happened it would tie up the military justice system indefinitely with many of the officers on the future court marshal boards sympathizing with the defendants with many of them employing the military version of civilian jury nullification to dump those cases in file #13.
