The dismissal of the case against former National Security Adviser Michael Flynn sent shock waves across Washington, including Congress which was hours away from a hearing addressing the case. Any appellate decision taking unprecedented measures to stop “irreparable harms” and “irregular” conduct is newsworthy. However, those admonishments were not describing Flynn's conduct but that of his trial judge, U.S. District Judge Emmet Sullivan. The D.C. Circuit panel took the exceptionally rare step of ordering Sullivan to stop further proceedings and dismiss the case to avoid further damage caused by his prior orders. The case should have been dismissed

Clearly, Sullivan had turned this case into one of political retribution. We all know it, but actually proving it is a different matter. Frankly, he should be removed from the bench.

Sullivan was covering Obama's big gaffe he made about Flynn and perjury. So he had to create a new mess to drag Flynn through to find some 'evidence' to prove Flynn committed perjury, which he did not. Sullivan needs removal, disbarment and prosecution for this circus.

Excellent article. Too many judges (notably, John Roberts) are ruling based on personal beliefs rather than established law. The fact that the Obama-appointed judge dissented in the face of clear precedent shows what happens when someone like him is in the majority.

Case dismissed? I don't think so as of now, Sullivan might be seeking en banc (all the appeal court judges, not just three of them) review.

Good analysis, but it seems that Mr. Turley assumes that Sullivan will not ask for and en banc review by the whole Appeals Court or the Supreme Court to weigh in.
I hope that this matter can end now, but I don't trust Sullivan to do the right thing, not at all.

Micael Flynn case HAS NOT BEEN DISMISSED. This headline is clearly wrong. Sullivan stayed all scheduled actions but he HAS NOT Dismissed this case. He is actively disregarding a direct order from the Appellate Court and instead had been taking alternative judicial measures instead.

"echo journalism" and "this age of rage" are fabulous constructs in this well-reasoned commentary.
The notion that the judicial branch is qualified to substitute itself for the executive branch while making decisions based on tabloid news reports in preference to legal principles and precedents is mind-blowing.
Fortunately cooler heads have prevailed, at least for now. Of course, John Roberts and his Kindergarten Kourt may flip things back the other way. Stay tuned.

Sullivan, in my view is an out and out RACIST. The only reason he's going after Flynn is that Flynn DISSED Obama when he was in office...a slight the Kenyan Kommunist can't abide!

By staying rather than vacating the dates and immediately dismissing, Sullivan is clearly hoping for a rehearing en banc.

I agree with # 12 and earlier posters of similar mind. Sullivan wants to drag this out as long as he possibly can. And I don't think that he feels in any way constrained by the rule of law.
