I’m no legal expert, but I wondered to myself if Keith Ellison hadn’t overcharged the cop who killed George Floyd. Now there’s someone much smarter than I who agrees.
Andy McCarthy, who writes for National Review, is a former federal prosecutor and has been a trusted guest on my radio show for the better part of 20 years. He believes Ellison might have just colossally screwed up his case against the cops. My words, not his. McCarthy called Ellison’s amended charges “dangerously flawed.”
Overcharging is tantamount to over-promising. It’s perceived as overly punitive and less thoughtful in some cases.

Keith Ellison is a good example of "Affirmative Action" placing unqualified morons in the wrong positions.

I have a somewhat different take on the charges made by Ellison. I think the overcharge may have been very deliberate. Given Ellison's history, this could have been a calculated move to provoke more dissent when a jury quite likely determines a lesser charge.

The objective is not a conviction but an “unjust” acquittal to fire up the legions of SJWs again.
Folks need to look at the bigger picture. These are hardly “idiots”.

Keith Ellison, wins either way. If he conducts a successful prosecution, he wins. If the charged are acquitted, he wins when he claims racism caused the acquittal, and subsequent riots result, and he gets reelected or elected to another political office. There is no doubt that Ellison is a dangerous left wing political animal.

Hate to break it to poster # 1, but Ellison is no affirmative action hire. He has consistently been voted IN by the people of Minneapolis and the state of Minnesota, the last victory after one of his multi ex girlfriends (the son on the Minn. City Council wanting to get rid of the police is the result of a liaison with a City Council member) accused him of battering, showing the pictures of the physical violence. The picture of him supporting ANTIFA is just icing on the cake. This is either ignorant voters or people who are FOR the elimination of standards and order.

If the trial is held locally, they'll be convicted no matter what the charges are. Minnesotans and Minneapolisans elect the Ellisons, Omars, Walzes and Freys, etc., over and over. They're all in with these people.

Overcharging is a common tactic for prosecutors looking to get the accused to plea bargain to a lesser charge. I've felt from the start that third-degree was the best bet for getting a successful prosecution, and by upping the charge to second-degree, I'm betting they're looking to getting the dirty cop to plead guilty to third.

Isn't this the same thing that Mosby did in Baltimore against the cops who were with Freddie Grey? Not ONE of those cops were convicted of anything-after 2 not guilty verdicts, they dropped charges against the rest. Now if the cop who kneeled on Floyd's neck can be shown by a medical examiner who actually examined the body to be contributing to Floyd's death, then he should be charged with manslaughter. But first degree murder? That's a big hurdle for a cop-who had to excercise physically restraining perps all the time. I haven't seen the full bodycam video, but I bet if Floyd had just gotten into the car when they asked him to get into it.......we'll see.

That would be serious trouble. If this cop gets off, the "outrage" would start all over again and this time we will be much less willing to tolerate it. Not to mention they have very little left to burn. It could be the big one.

What if the police officer accepts a plea deal of a lesser charge? That saves the city from a trial. Do you think this officer is going to risk a trial? Or does he want his day in court?

Please expunge the repeated references to the cop that killed Floyd. That will be decided by a court, if an impartial one can be found, which I doubt is possible in this country.

I discussed this exact issue with a federal prosecutor friend about 3 days ago. He tended to agree that overcharging is often a serious error, but it depends on state law whether the lesser charges are implicitly included or not. Some states, the only choice is guilty or not guilty of the charge as laid.
Personally, when this information is presented in court, I think that they will be acquitted.

What are the Black rioters in Minneapolis to do if the trial jury finds the four ex cops not guilty of the charges against them, as those rioters have already burned out and looted all the commercial retail businesses within their reach in that very liberal leftist and liberal Democrat city?
