The Chauvin Appeal Ruling

My friend Bill Mohrmann is representing Derek Chauvin on appeal of his conviction for the murder of George Floyd. Former Acting Solicitor General of the United States Neal Katyal is representing the State of Minnesota. It’s something of a David and Goliath matchup. The Minnesota Court of Appeals was the first stop. The court held oral argument before a panel of three judges this past January. I reported on it here. The principal issue on appeal was that pretrial publicity and related riots required a change of venue — that they precluded a fair trial in violation of the Sixth Amendment. Chauvin was railroaded, and he did NOT harm Floyd. What he did was specifically tested by doctors as the safest and best way to stabilize a person who is suffering from excited delirium which is a frequently fatal reaction to drugs. Chauvin did not harm Floyd, this was clear from the autopsy. NO signs of respiratory restriction were found, no bruising or harm to any tissues around the airway. Floyd killed Floyd, and Chauvin did what he was trained to do by the police department, shown by a photo of that specific restraining method in the police training manual which was tested by doctors to do no harm. This was a severe injustice, a "lynching" by other methods.

Oakland has always been a gritty city—the tough-luck twin to wealthy San Francisco. Under newly elected Alameda County District Attorney Pam Price, Oakland could be headed for a fate much darker than gritty. Price has been following the de-prosecution and decarceration playbook of radical district attorneys across the United States. If she stays on that course, Oakland is in for a “hella tough time,” to use the language of the Bay Area. Price took office this year with no prior experience as a prosecutor, having spent her entire career as a criminal defense and civil rights lawyer. If that sounds familiar, it should: Price’s background matches the career history

Kyiv, the capital city of Ukraine, where the American dollars are crisp and clean, has just dodged a bullet. This one didn’t come from Russia; the shot was self-inflicted. Mayor Vitali Klitschko overruled the city council and a popular vote of city dwellers to prevent the naming of a street after a World War II-era Nazi collaborator. The European Jewish Press reported Wednesday that the city “wanted to name a street after Volodymyr Kubiyovych, a Nazi collaborator and SS official,” until Klitschko, apparently mindful of how bad this looks in the West, stepped in and put a kibosh on the plan. Until his intervention, everything was going swimmingly:

International legal “experts” — backed by the United Nations — have released a report stating sex with minors is perfectly acceptable. “Sexual conduct involving persons below the domestically prescribed minimum age of consent to sex may be consensual in fact, if not in law,” according to the International Commission of Jurists (ICJ). You can read that part for yourself on page 12. FACT-O-RAMA! The pedo-loving report is called “The 8 March Principles for a Human Rights-Based Approach to Criminal Law Proscribing Conduct Associated with Sex, Reproduction, Drug Use, HIV, Homelessness and Poverty.” The shocking legal “recommendations” were released purposely last month on March 8, which is International Women’s Day.

On April 26, 2021, we predicted the current inflation before it began. Now we are predicting an upcoming stock market crash, and we even know the date that it will take place. Interviewer Margaret Brennan and European Central Bank President Christine LaGarde gave the date away during their conversation on "Face the Nation" on April 16: (Snip) The Democrats have scheduled the stock market crash to take place the day that House Republicans vote to not raise the debt ceiling. Right afterwards, the Biden Administration will declare a temporary “default” on the U.S. Debt, the stock market and bond market will immediately crash, and Republicans will be blamed.

This is not an incorrect headline. Rep. Katie Porter (D-Calif.) has, of course, consistently blamed criticism of her performance in office on sexism like any good neoliberal politician would. But she also recently piloted a new little victimization narrative for herself by complaining about racism, just to shake things up. Porter’s recent cry of racism comes in the context of her travels through the corporate media circuit to promote herself as demented Dianne Feinstein’s replacement as one of California’s two senators. As part of her campaign, Porter graced ABC’s The View, toxic cesspit of performative feminism that it is, for a daytime TV propaganda tour.

For the past couple of years, we’ve been led to believe that the letter from 51 national security officials was some sort of spontaneous, grassroots effort by the intelligence community to warn us about the potential foreign influence behind Hunter Biden’s laptop. The laptop has since been confirmed to be legitimate, and the Office of the Director of National Intelligence confirmed that there was no foreign disinformation campaign involved. But new information from House Judiciary Committee Chairman Jim Jordan and congressional investigators, with the help of two Obama-era CIA officials, has revealed a new twist in the story. The investigation has uncovered evidence linking the letter dismissing the Hunter Biden laptop

Carpe Donktum calls himself an “Eternally Sarcastic Memesmith,” and his eternally sarcastic memes have earned him over 335,000 followers on Twitter, as well as the undying wrath of the authoritarian Left: his pro-Trump memes were so effective that he was banned from Twitter in June 2020, at the height of Trump’s reelection campaign, and only reinstated when Elon Musk took over. Over the last few days, he has begun calling attention to the transgender cult’s grooming of the youngest children in schools in a particularly piquant — and riotous — way. Happy Monday, dear Kruiser Morning Briefing friends. (Snip) I am well aware that many who read today’s headline will think, “On its way?!?!?” California is a lot more than what people outside of it see. I lived there for four years when I was a kid and spent over 20 years there as an adult. There are still a lot of good people there, and the physical beauty of the state remains unchanged. The politics, sadly, are rotten to the core. When I left there a little over five years ago, the politics in Sacramento were descending into a hideous place they hadn’t been in all the time I’d lived there.

The facts in this case are even more repulsive than incidents involving men who insist they’re women usually are. A group of seven college girls in Wyoming is suing the Kappa Kappa Gamma sorority for admitting a man who claims to be a woman into its chapter at the University of Wyoming, exposing the plaintiffs and their sorority sisters to his lewd behavior. After a woman who claimed to be a man murdered six people in Nashville and trans activists menaced and assaulted women’s rights activist Riley Gaines at San Francisco State University, the plaintiffs requested anonymity. A federal judge, however, has now twice denied this request.

Francis Menton at the Manhattan Contrarian, who often has well-considered things to say, posted an intriguing and important blog this week. In 2009 the EPA found that CO2 and other “greenhouse gases” endanger human health and welfare because they potentially warm the atmosphere. Many scientists have taken issue with this finding, which has provided the justification for reducing conventional energy sources, raised the cost of energy to consumers, and unrolled massive federal and state spending for manifestly unreliable alternative sources. The Biden administration has pressed this autocracy-enabling finding to its bosom, using it to justify regulating everything, -- including gas

The Democratic Party and President Joe Biden are wrecking the country. Their ongoing economic blunders, perverse cultural agenda, and corrupt foreign policy, if unchecked in the near future, will turn the United States into a dystopian nightmare comparable to Venezuela. This can be averted if former President Donald Trump and Florida Gov. Ron DeSantis run together on the 2024 Republican presidential ballot. Neither can win in 2024 without the other, even if the Democratic alternative is an unpopular incumbent whose running mate is a running joke.

The state of California is implementing full Marxism before our very eyes under the guise of “equity.” And so now there can be no possible doubt if there ever was for anyone: instituting Communism has been what “equity” initiatives have been about all along. Now three of its most powerful utility companies are saying that they’re going to charge based not on how much of their product was used, but on how much money the user makes. In simpler times, if you bought something, you paid for it. Rich or poor, tall or short, black or white, female or male, wise or foolish, everyone paid the same amount for a product.

A little-noticed revamp of federal rules on mortgage fees will offer discounted rates for home buyers with riskier credit backgrounds — and force higher-credit homebuyers to foot the bill, The Post has learned.
