'I was expecting a happy place - it was hell

An American-born ISIS bride has admitted that when Donald Trump tweeted she should never be allowed back into the US she 'lost all hope'. Hoda Muthana said that she had a 'meltdown' when the former President said he had effectively banned her from returning to the country she considers home. [SNIP] She is currently living in the Roj refugee camp in Northern Syria with her two-year-old son after a federal judge ruled that because her father was a diplomat when she was born in Hackensack, New Jersey she is not an American citizen and so cannot return.

Read the last sentence of the intro of the article. She was born here, but a federal judge ruled that she was not a U.S. citizen. In other words, the judge said there is no such thing as Anchor Baby citizenship. Hey Kamala -- I hope you're paying attention. The ISIS woman should appeal the judge's ruling, so that we can finally settle the issue of Anchor Baby citizenship.

OP This has nothing to do with the Kamala Harris situation. This womans father was a diplomat. A child of a diplomat born in the USA cannot be considered a citizen. A child born in the USA to alien, non diplomatic persons is a US citizen, wether you like it or not. It is the law. The law should be changed, but for now, that is the way it is.

#7 It is NOT the law. There is nowhere in the U.S. Constitution that grants citizenship to Anchor Babies. If you want to bring up the 14th Amendment, that only applied to freed slaves. The two main writers of the amendment both gave public statements in which they clearly stated that it did not apply to children born to non-citizen foreigners. Not only that, but in 1920s a court ruled that the 14th Amendment didn't even apply to American Indians. Kamala Harris was born in 1964 to two foreign students who were here on temporary student visas. Just ten years earlier in 1964, over one-million Mexicans were departed to their own country -- even the ones born here -- because they weren't U.S. citizens. There were no lawsuits because THAT was the law. That's because from 1868, when the 14th Amendment was ratified, until 1982, foreigners born here were not considered U.S. citizens. So what changed? A rogue, liberal Supreme Court justice in 1982 wrote in the footnote of an unrelated case that the 14th Amendment actually meant the opposite of what its authors intended. It's as simple as that. Additionally, even if Kamala was a U.S. citizen, she's certainly not a second-generation, Natural Born Citizen as required by the Constitution. Just because the mainstream media keeps tell you that she's eligible, doesn't make it so.

Not quite, OP. Since she is the child of diplomats who were serving here, she is not an anchor baby and she is not an American citizen. We have thousands of American citizens who were born on foreign soil because their parents were US military and foreign service employees. One of my best friends was born in Japan when her father was stationed there with the US Air Force. She is not a Japanese citizen. The judge is correct. Bottom line - if she was stupid enough to marry a member of ISIS, that’s her problem, not ours. But I would be that the Xiden cabal will admit her just to spite President Trump.

#6 has it right. She is not a citizen. Trump could legally block her and did. The federal judge got it right. Even so, an appeals court may accept fascinating arguments and overrule that judge. Or, Biden can, and probably will, - allow her return simply because Trump didn't Also. You can bet she will keep bashing ISIS while she wants something from the USA.

#22 There are three levels of citizenship in this county: Naturalized Citizen, Native Born Citizen, and Natural Born Citizen. If you don't know the differences between three, then you shouldn't be having this discussion. As for the definition of "Natural Born Citizen," the Founding Fathers most certainly didn't invent the term. It's a legal concept clearly defined in a book they referenced when writing the U.S. Constitution. The phrase "Natural Born Citizen" appears in only one of the many books and documents employed by the Founding Fathers. There were three copies of the legal book "The Law of Nations" by Emmerich de Vattel at the Constitutional Convention, and the book explicity defines a Natural Born Citizen as a person born to citizens -- also known as a second-generation citizen. It most certainly didn't apply to an Anchor Baby like Kamala Harris, who was born to two visitors who were here on temporary student visas. And for obvious reasons, the Founding Fathers exempted anyone born before the signing of the Constitution from the Natural Born Citizen requirement. It's a real tragedy how little most Americans know about this country's history.

This is my final post on the subject. The U.S. Supreme Court really needs to reexamine the notion of Anchor Baby citizenship. Here's something very pertinent that specifically applies to Kamala Harris. From the Heritage Foundation, here's a discussion of the 14th Amendment: "Even in U.S. v. Wong Kim Ark, the 1898 case most often cited by “birthright” supporters due to its overbroad language, the court only held that a child born of lawful, permanent residents was a U.S. citizen. That is a far cry from saying that a child born of individuals who are here illegally must be considered a U.S. citizen." So in other words, Kamala's parents were here on "temporary" student visas, and not as "permanent residents" as required by the "U.S. v. Wong Kim Ark" ruling. Again, she's clearly not eligible to be president.
