The liberal media meltdown about last week’s speech by Supreme Court Justice Samuel Alito is silly and hypocritical. The speech was not only acceptable but insightful and appropriate. Alito was the featured speaker at the annual national meeting (by video because of the coronavirus) of the Federalist Society, a group of mostly conservative lawyers that sponsors debates and seminars throughout the country. His remarks were quite pointed, perhaps even provocative, but they were well within ethical bounds. The media and leftist politicians, though, reacted as if Alito had thrown a verbal Molotov cocktail into the edifice of judicial propriety. But the media’s vapors are nothing more than gaseous piffle.

“gaseous piffle,” a most excellent description that I shall appropriate. It has endless applications these days. Alito’s speech, on the other hand, was brilliant, as one might expect.

Of all the claims that have been made in this election, the most astounding is the idea that the proper authority to certify the winner — and dispose of all objections — is the press. That would be the same press that proved to be so inaccurate in respect of what would happen in the past two elections. It is now in high dudgeon over the fact that millions of Americans lack for confidence in its decision to call the race for Mr. Biden. What vainglory. “Day by day,” the Washington Post editorializes this morning, “President Trump’s efforts to overturn the results of a free and fair election grow more brazen.”

At least two demonstrators who gathered in the Old Market section of Omaha, Neb., on Friday night to protest the deadly police shooting of a Black man were taken into custody after police declared an unlawful assembly, according to reports. The protest came one night after the man, identified as Kenneth Jones, was shot and killed during a vehicle stop. “Until (police) prove that they didn’t murder a Black man, we’re not shutting up – not one bit,” protest organizer Peyton Zyla told the Omaha World-Herald.

Judge Merrick Garland is a candidate to become attorney general for President-elect Joe Biden next year, NPR reported Friday. He currently sits on the U.S. Court of Appeals for the District of Columbia, where he served as chief judge from February 2013 to February 2020. Garland was nominated to the Supreme Court by former President Barack Obama in March 2016, but Senate Majority Leader Mitch McConnell did not allow a confirmation hearing.

The video by Haley's advocacy group Stand for America highlights Warnock's praise for anti-American preacher Jeremiah Wright, his connection to communist dictator Fidel Castro, and the policies he has supported that are "too radical for Georgia." "Raphael Warnock is an anti-America, anti-police, anti-Israel, anti-Semitic, anti-jobs, anti-taxpayer, pro-socialized medicine, and pro-communist radical," the video concludes. "That's a lot of reasons to stand against Raphael Warnock. That's a lot of reasons to stand for America."

Today several of President Trump’s lawyers, including Rudy Giuliani and Sidney Powell, held a press conference in which they alleged that they have convincing if not conclusive evidence that the presidential election was rigged, and that in addition to garden variety voter fraud, hundreds of thousands of votes were added to Joe Biden’s totals through electronic manipulation. Brandon Martin, a former Tampa Bay Rays first-round draft pick, was sentenced to life in prison without parole for the 2015 grisly murder of his disabled father, uncle and an alarm installer in California. Martin could have been given the death penalty because of the nature of the murders. When President Trump refused to concede the election to Joe Biden in the immediate aftermath of Nov. 3, we argued that he had the right to mount legal challenges if he believed there had been irregularities, mistakes, fraud, or all three. Democratic objections and outrage were as hypocritical as they were inevitable, coming as they did from a corps that refused to accept the 2016 election result not for days, weeks, or even months, but for four years. But although fair-minded people know there are legitimate procedures for litigation, and that these should be allowed to play out, there is also wisdom in the phrase, “put up or shut up.”

New York Governor Andrew Cuomo blasted county sheriffs who are refusing to barge into people’s homes to break up gatherings of more than 10 people, arguing that his executive order limiting the size of private gatherings is the equivalent of law. Cuomo said the sheriffs who have vowed to ignore the mandate he issued last week are “arrogant” and “frightening to democracy,” the Democrat & Chronicle reported. This time, the insults came from Kristin Fisher, who was speaking from either ignorance or malice when she attacked Rudy Giuliani after Trump’s legal team gave a press conference. (snip) The conference was essentially a preview of coming attractions. In a trial, first you tell your story, then you prove your story, and then you summarize your story. The legal team is at Phase One. That didn’t stop Kristin Fisher from proving that she’s a lousy listener and is staggeringly ignorant about how the American legal system works.

Her claims involve broad, systemic fraud that could affect tens and hundreds of thousands of votes, maybe even millions.
