In an 8–2 decision, the D.C. Circuit yesterday denied Michael Flynn’s petition for a writ of mandamus that would have ordered district court Judge Emmett Sullivan to dismiss the criminal charge against Flynn. While the majority’s opinion presented a methodical analysis,(Snip) only politics can explain the D.C. Circuit’s decision. Here’s why.
Flynn’s attorney, Sidney Powell, first sought a writ of mandamus from the D.C. Circuit after Judge Sullivan refused to dismiss the criminal charge against Flynn. The Department of Justice had filed a motion to dismiss the charge that Flynn had lied to FBI agents(Snip), after U.S. Attorney Jeff Jensen conducted an independent review of the Flynn prosecution.

Emmett Sullivan will dismiss the Flynn case right after the election. He will then retire to take a job with a Democrat aligned law firm.

Maybe someone on this site who knows the Law can explain how one Judge can tie things up for Gen. Flynn. Can't his attorney ask for another judge who is not biased? Or can't AG Barr put an end to this? Or why can't President Trump step in and put Flynn and his family out of the misery, not to mention the financial burden, they have endured? Can't SOMEONE help this poor man? I just don't understand why this Judge has so much Power!

This could easily be handled by Congress. If the House is Rebublican, they could easily reign in these rogue black robed demigods. Call hearings to explore, for legislative purpose, the constitutional duty of congress to determine the breath and scope of the circuit and appeals courts. Ask all 8 Clinton/Obambi judges why the ruled that judges can now be parties in cases and can impose powers never granted to the judicial branch. Then make a law limiting the powers of these courts. It will be a nice public accountability check for rogue judges and put the judicial branch on notice that there are checks and balances.

Thomas Jefferson was very unhappy that the US Supreme Court created for itself, out of NOTHING, the power to decide the Constitutionality of laws.
There is NO place in the Constitution where the Supreme Court is granted this power. Jefferson warned that judges would become tyrants.
And here we are, judges are tyrants.

Let me know when DOJ ever announces that Flynn is innocent and retracts its statement to the court that the case is dismissed because the evidence it would use to convict is now tainted. Let me know when Flynn tells us why he pled guilty twice under oath, given the opportunity to withdraw his plea by evil Judge Sullivan, and why he now still does not claim innocence.
It is astounding to me that everyone wants this case to vanish without ever getting to the bottom of it. The FBI and DOJ crookedness. the possible malfeasance of Flynn's original lawyers (and how he came to hire them), the FBI threats against his son, how he came to apparently perjure himself with his repeated guilty pleas, the government's plans with respect to other possible charges, such as Flynn's failure to register as a foreign agent. The list goes on ad infinitum. But let's not shake the tree...

Clearly the Democrats want to delay the Flynn court case until after the November election hoping that Biden wins, with the old Obama-Biden crew that instituted criminal charges against Flynn in the first place, being reinstalled in the Dept. of Justice. It will be interesting to see if Judge Sullivan takes the next step in that delay process, or if he sees the light and dismisses the charge against Flynn, as Flynn’s lawyer and the current Dept. of Justice crew have requested Sullivan to do. Will Sullivan slow walk his final opinion until after the November election to see which way the election goes?
Whatever happens as the courts juggle their legal balls, President Trump still holds the “trump” card on all that, all the way up to January 20, 2021 at Noon.

This case has made a mockery of law at the hands of government tyranny, first by the DOJ and then perpetuated by the court. Enough exculpatory evidence has been unearthed to prove the case should never have been brought in the first place. Upon review, the DOJ agreed and dropped the prosecution. Sullivan, motivated by enormous and obvious bias decided that he wasn't quite done with the case yet. The Appeals circuit has just enshrined that bias as valid even though all reasonable people can see the glaring prejudice. After Flynn is finally exonerated, I hope he sues the DOJ and court and Sullivan for a small fortune.
