A federal appeals court ruled on Friday to vacate the death sentence of Dzhokhar Tsarnaev, who along with his brother planted homemade bombs near the finish of the 2013 Boston Marathon, killing three spectators.
The US Court of Appeals for the First Circuit ruled to vacate his death sentence on five counts, saying the judge erred several times.
(Snip) Because we are affirming the convictions (excluding the three § 924(c) convictions) and the many life sentences imposed on those remaining counts (which Dzhokhar has not challenged), Dzhokhar will remain confined to prison for the rest of his life, with the only question remaining being whether the government will end his life by

Even if he does get the death penalty, it will be appealed for at least the next 20 years.
And I hope that every day of that 20 years are spent being passed around and "used" by big evil men (who like pretty boys) causing him as much pain and horror as possible!!!! I could go into much more graphic details of what I hope happens to him, but I don't want to get banned!

Travesty with a capital T!! Most states follow the same appellate process that holds 12 automatic appeals. Then the Supreme Court gets to weigh in. These murderers will never ever pay for their crimes; they'll just be guests of the state or the federal pen for as long as it can go on. Beats working!

no need to get upset on this one. the good old Bay State will never re-institute the death penalty. crime is a "too bad" response from liberals in Massachusetts until it happens directly to them. THEN it's a big deal and punishment should be severe or, as they say "fit the crime".such hypocrisy in the liberal mindset.

Should have just shot him right off the bat. Let them appeal and appeal and appeal ad naseum then after the taxpayer feeds them and gives them prayer mats for year upon year, then some liberal judge lets them out....doesn't make any dang sense...

i fully agree with #10. The filthy islamofascist terrorist pig, who was receiving every American benefit possible, chose to follow his brother.
Too bad he didn't get the Osama Bin Laden treatment.
Just imagine if the Navy Seal had captured Bin Lden instead of shooting him. Osama would sit in a federal prison forever, demanding his prayer rug, praying and laughing. and federal judges would be wetting their robes in the haste to meet Osama's needs.

When it comes to the prison horrors some believe are SOP, I believe I remember reading that death row prisoners are in solo cells with an hour a day visit to the outdoors. Also solo and under guard. Probably safer on death row than as a lifer...

Elect a demonrat in Nov, and every felonous thug will never see prosecution for anything and the murderous felons existing in federal prison will be let free because of CV-19, the same that comrade Cuomo does. In NYS, felons are coddled, let back out on the street free as a bird, and given reparations, then encouraged to join the Kenyan's private army of anarchists. That's what's going to happen if a criminal loving demonrat is elected.

If the judge made a mistake, he deserves to be criticized and sanctioned. That doesn't make the criminal less deserving of punishment. Punish the judge, but don't punish the criminal less. And do not make the rest of us watch while a criminal gets to live out the rest of his life after taking the lives of so many others.
The facts are not in dispute. He did the things for which he is being executed. To reduce his punishment because procedural errors were made is a profound injustice to those who died. They did nothing wrong. Neither did their surviving loved ones. Yet, because a judge makes a mistake they are asked to suffer further.
It is so unfair, so obviously wrong, only a lawyer or a judge could call it just.
