On Monday, following the news that St. Louis Circuit Attorney Kim Gardner, the city’s top prosecutor, announced that Mark and Patricia McCloskey, the couple who pointed guns at a crowd in front of their home, would be charged with felony unlawful use of a weapon, Missouri Attorney General Eric Schmitt filed a brief that would dismiss the charges. The brief stated that Schmitt “respectfully requests that the Court dismiss this case at the earlier possible opportunity.”

The McCloskeys need to sue Kim, not the city. Kim should be disbarred, prosecuted, and thrown in jail for violating the rights of citizens she's sworn to protect.

Years ago, I had a next door neighbor who was a police detective. We once told me that if someone ever threatens my home and is at my front door in a menacing manner and is attempting to break in, that after opening fire on him/her, I should be sure to drag the body to inside the house before the police arrive.
Fortunately, for the McCloskeys, it didn't come to this. But, if anyone in the crowd had threatened to forcibly enter their home, the McCloskey's had the right to protect themselves and their property. There are legal protections.
My advice to all of us is to identify legal counsel who can represent you should you have been involved in a gun-related incident where you threatened to fire or did fire your weapon at someone in self-defense. This person must be available to you 24/7. Know your local gun laws. If you live in an urban area, be smart because local gun laws can be very restrictive. Don't expect that calling 911 will take care of anything. It won't. You'll either be dead or dying by the time the police arrive, assuming they show up at all.

Kim Gardner has ALREADY confessed to using campaign funds to pay apartment rent. She was fined a five-figure sum but was permitted to pay about $6,000 settlement. She is corrupt. QED.

Since both McCloskeys are lawyers, I imagine that they will own Gardner by the time this is over. Leaving her jobless, penniless and living in a makeshift tent on a St. Louis sidewalk.

Investigate this rogue prosecutor-she is not upholding the law, she is shredding it by acting as a Social Justice Warrior. No radical like this should be anywhere near this kind of a job. How the hell did she get here in the first place? There must have been warning signs.

The reporting about this repeatedly calls these people "peaceful" demonstrators.What is repeatedly omitted is that these, so called, "peaceful" demonstrators broke down a steel security gate to get into the gated community and threatened the lives of Mark and Patricia McCloskey. Only after the McCloskey's called the police, who declined to respond, did they produce the weapons to ward off the threatening crowd.

Mr. McCloskey was on Marc Cox's radio show this morning on 97.1. It was pointed out that the incident went on for 17-20 minutes and that people are only seeing about 20 seconds of it on the news. He said there were 300-500 people in his front yard. Soros scraped too far down into the barrel for Kim Gardner. I saw yesterday he had just donated $60,000+ to her election campaign. She is one of his.

At this point, the McCloskeys are on firmer ground, and in less jeopardy, than Kim Gardner, the rogue prosecutor. Gardner's prosecuting attorney position appears to be an elected one--not an appointed position. She cannot be "fired" easily--a recall vote may be required. Hopefully, the judge to whom the case has been assigned will dismiss the McCloskeys and sharply reprimand Gardner. If not, her dismissal may have to await the election at the end of her current term.
It is unlikely that the state bar association will disbar Gardner at this point. She will claim that charging the McCloskeys was necessary to quell inflamed protesters and that the law is unclear in this instance, since the McCloskeys were waving and pointing and threatening with their guns, which she can argue is illegal unless they are inside their home, or "castle."
Gardner is unlikely to be sued successfully in her personal capacity--only in her position as prosecutor, in which she has discretion to charge individuals with crimes.. McCloskeys would have a pretty good case against the city for malicious prosecution. But all that is up to the judges, who can sustain or dismiss cases, but who cannot easily "fire" an elected prosecutor. The Missouri Supreme Court may have that authority, but they won't be acting any time soon. Such a case or petition would drag on for at least a year. Gardner is black, and this has now become highly politicized.

This rogue prosecutor has a history. She railroaded our former governor and is now attempting to ruin the McCloskeys. She was elected with the very considerable help of George Soros. I'm not sure that she's capable of being embarrassed. She's a leftist crusader. If any state has the will to deal with her (to the extent that they can) it's the show-me state. The important thing is that voters across the country see what happens when the left has access to the levers of power. Do they want a whole justice system filled with Kim Gardners?

In light of what we have seen, it must be concluded that the St. Louis prosecutor is un-qualified to retain her position. Apparently, for her, the 2nd Amendment and the right of self-defense are null and void if a BLM MOB threatens your life and your home. What other explanation is there for her actions besides racism? She is, in effect, ENABLING the BLM mob .

It's not just Missouri law that's being ignored, it's the Bill of Rights and the Constitution. The next step is to remove this Soros paid for hack from her job as prosecutor immediately. She's proved she has no knowledge of the law or the rights of U.S. citizens, and has a political agenda that is not in line with the her position.

#9 VERY bad advice.
A jury MAY understand an error in time of stress. No jury will understand tampering with evidence in a homicide. And a legitimate self-defense shooting is a homicide, the only question is whether it was justified or not. Changing the evidence is a strong indicator of a guiltiy person trying hide the truth.

This is great. It's too bad we don't have options like this in every state but some are all dem run. That's where the problems are the worst because the thugs know they will not be stopped and it the police or citizens try, the dems will turn on them. Eventually the charges may be dropped or overturned but it is hell to go through.
