An LAPD ‘top shot’ who had become somewhat of a social media darling is facing a lawsuit after she fatally shot a man who appeared to advance towards her with a knife.Toni McBride, 23, shot and killed Daniel Hernandez, 38 on April 22. A lawsuit was filed on behalf of Hernandez’s 14-year-old daughter, claiming that McBride had “reckless, violent and homicidal propensities,” the Daily Mail reported. As a member of the Newton Division in South Central Los Angeles, McBride and her partner responded to a multiple-vehicle collision, with a suspect carrying a “folding utility-type knife” Corrections*

The idiot attacked an armed police officer with a knife. NOT a victim. That is just 'lawsuit talk' trying to do the 'woe is me, my poor, innocent daddy was shot for no reason by that mean lady'.....lawyers looking for $$. I hope that Ben Crump doesn't have his evil claws in this one.
I have a theory that a LOT of criminal males, but especially Hispanic and black criminal males are extremely disrespective of women, all women. They have a lifetime of easily intimidating or 'sweet talking' women, and somehow can't bring themselves to react to a female police officer the same way that they might react to a male police officer. This is also commonly seen when armed civilian women are involved, too. Perps are far more likely to continue to attack an armed woman even when she has a gun out and pointed at them, imagining "she won't actually shoot me". Sometimes they are right, often they are wrong.
The officer is apparently a really skilled shooter. Bravo for the lady, hope this ridiculous lawsuit goes away soon. I've seen her on that "Blue Press" catalog/magazine cover - for Dillon reloading equipment, which I use.

I just watched the officer's bodycam video. She did an outstanding job, calm, squared away, and absolutely instantly getting effective hits. Super shooting, and totally calm, head in the events after the shooting, and directing the other officers as to what to do.
Very well done. And she started shooting right at about the 25 foot mark, I would estimate, but these wide angle lenses on bodycams make accurate distance evaluation impossible from just that view.
The only way the lawsuit goes is to have a biased jury looking to "stick it to the man" regardless of the facts.
The knife was a folding knive which uses the throwaway utility knife blades. Not much of a stabber, but a very effective slasher, can kill if used on the neck or arms where there are large arteries near the surface.

Page 56 of the Blue Press catalog/mag has an interview with Officer McBride, a second generation LAPD officer. Worth reading. A heck of a shooter, and really mentally squared away, besides being a pretty lady.

This was a good shoot. But vulture lawyers file suit, hoping for an OJ jury. I'm surprised Benjamin Trump didn't chase the ambulance quickly enough.
(Often the city attorney will recommend settlement paments, even in the absence of liability. Quicker and cheaper to settle. and under the 1991 Civil Rights Act, attorney fees are paid, even if the plaintiff loses. dead ted kennedy pushed through that bizarro world language.
The jury in a civil rights case is asked to decide of the plaintiff violated the civil rights oif the plaintiff. They are also asked, if their finding is not guilty, to decide if race played any part in the otherwise legal actions of the defendant. If they say yes, easy to do to end their jury duty, the defendant gets zero dollars, and the defendant's attorney receives his fees, paid by the winner! The plaintiff!
when dead ted kennedy was asked why he pushed through the provision, he said it was to encourage attorneys to take civil rights cases.

Is Daddy an illegal? Can this girl be deported back where she came from? This kind of stuff from lawyers needs to be turned into actionable and disbarment issues for the lawyers who try this stuff on.

Ok, I am going to be unpopular here again, but this guy was no immediate threat to the officer. He was quite a ways away and looked like he was impaired somehow. I don't understand why she shot so quickly. If he had been a lot closer to her or to someone else, I can see her shooting when he didn't stop or drop the knife. But there was a lot more time that could have been used to stop him. She also didn't need to keep shooting either...I don't agree with the policy that says "always shoot to kill and keep shooting 'til he is dead." I have a feeling the family will win.

In Texas, we call what Mr. Hernandez did "suicide by cop".
Any even semi-sane person knows that if you attack a cop with a deadly weapon, you are going to die.
It's sad that evil adults are using a 14-yer-old girl -- who should be allowed to grieve her father's death -- to make the adults rich. Vile and disgusting!!!

#9, sometimes you see stenciled on car side view mirrors: "objects in mirror are closer than they appear". Police bodycams distort the view somewhat. The man with the knife was much closer to her than it appears in the video. I'm going to guess that he was no more than 15 feet away. If someone twice my size is coming at me with a knife from that distance, I'm going to be pretty quick on the trigger.

#9 Google "21 Foot Rule". A knife is absolutely more deadly than a gun at close range. I get that you and Biden disagree with only using deadly force in a deadly manner, and shooting at the center of mass. But the reason that 100% of law enforcement and military use those rules isn't because they are all bloodthirsty meanies. They are based on research and experience, not your "feelings". Also, the triggering event that causes an escalation in the use of force is in no way a factor in the escalation. Police must escalation force when force is escalated against them, and it doesn't matter if the infraction was a jaywalking.

#9, you are wrong, you misinterpret the video and are almost certainly not aware of the police and self defense training about knife wielding attackers.
Here are the two reasons.
1) Bodycams have what is known as 'wide angle lenses', which are selected to show more of the view, but which necessarily make things look farther away than they actually are. They are the opposite of a telephoto lens, which makes things look closer, but gives a more narrow view. A "normal lens" will give a view which has approximately the same look as the naked eye, but that does not give the widest view of complex action. For example, all of the GoPro action cameras also have wide angle lenses, so things look farther away through those cameras, too, but they show more of the action in the frame.
2) there is a very well known, to folks trained in self defense, '21 foot rule' when confronted with a person with a knife or similar contact weapon. A person can cover 21 feet before most people can raise a gun from low ready position and make enough solid hits to stop the person. Handguns cannot instantly stop a person with certainty, although in this case she gets excellent hits, and even then, he drops and gets back up, has to be shot several more times. Even two or three handgun hits will not with certainty instantly stop a person most of the time. Once an aggressor with a contact weapon (knife) moves within 21 feet, it is time to start to shoot them or they can be on you before you can stop them. One or two well placed slashes can be fatal, and even if the 'shot dead' aggressor then falls over - the defender can still be unrecoverable.
This '21 foot rule' has been demonstrated in court rooms, and is taught in most police academies, and in all good training courses on self defense with a handgun.
A recent bodycam video of a female officer from Michigan shows her being attacked by a man with a knife and a screwdriver. She made the mistake of letting him get too close, inside 21 feet, and winds up trying to shoot while running backwards to keep him away, and even then he got a hand on her gun, making it jam, even after she had shot him 6 or 8 times. She cleared the jam, and he got back up and came at her again, and had to be shot 4 or 5 more times to stop his murderous assault.

Also, #9, you totally misstate "the rule" it is NOT what you say "always shoot to kill and keep shooting 'til he is dead." That is never training.
The training and the INTENT is to shoot to stop. As soon as the aggressor stops moving towards the officer with a weapon or drops the weapon, the shooting STOPS. The intent is not to kill, but to STOP the attack. Often, with very dedicated aggressors, like this man, who is shot and falls, but retains the weapon and does his best to regain his feet and continue the armed attack, so he is shot again.
In the case of committed, violent attackers, the "to stop" may require their death, but that is the aggressor's choice. If he had dropped the knife or stayed back, he would NOT have been shot.
If you are truly "for justice" you should get some education on the topic before making your uninformed or misinformed pronouncements on the guilt of police officers. Justice requires knowledge to understand what is actually happening. From what I know of police training, she did it just by the book.

As I've said on other contentious threads, I'm grateful for the civility and insight I find in these pages. #7/#9 and #1/#2 et al are both long-standing L-Dotters, whose views I've read with interest. With that in mind, I searched "21 foot rule" and found this: https://www.policemag.com/341203/revisiting-the-21-foot-rule
Some points for further consideration:
- Seems to have been based on response time drawing a *holstered* weapon
- Includes many other elements, including human hesitation and surprise as factors
My thoughts: As #7 and others pointed out, box cutters are weapons, and police officers are under no obligation to wrestle with armed assailants. I also have no patience for "trick shooting" scenarios. This officer was an expert shot, but a bullet passing through or past a suspect could kill a bystander. Again, advantage: officer. So I'm not sure I'm going to miss this guy very much based on his conduct, and I hope the officer prevails in court.
Having said all that, handguns are good for short range killing and destruction -- not, in my opinion, the only and best tool to enforce compliance on unwilling subjects. I wish we could think of some better ones.

I would suggest that those who are interested in what the police are trained to do, and how they react to given situations consider investigating a "civilian police academy" in your area. Many police departments used to put this on as a public service to educate the public about what the police do, their equipment, how it all works, limitations, legal requirements, and the whole situation that a police officer is trained in, and has to function in.
It can be quite educational, and even fun at times.
