Judge Emmet Sullivan is refusing to accept the three-judge appeals court ruling – which granted a writ of mandamus and instructed Sullivan to dismiss the Flynn case per the DOJ and Flynn defense unopposed motion. Today Judge Sullivan is asking the Full DC Circuit Court panel to conduct an en banc rehearing of the issues. [pdf here]There is no guarantee the full DC Circuit will agree to the en banc request. However, given the nature of the court, it should be anticipated. What really appears to be the undiscussed background is an effort to keep dragging this issue out as long as possible. This is beyond judicial activism running amok,

Good news is that Flynn can still demand exculpatory documents which the Deep State has been hiding. They will show unequivocally that the treason plot was hatched in the White House by Obama etc, and perpetrated by top FBI and top Justice.

Amazing how they blew it by not sentencing him much earlier, and so much more information continues to come out about the prosecutors withholding exculpatory evidence, and even more on the Strzok memos too.

Sullivan discovered that when Flynn signed his name on a document - - he only used one "n".
I'm sure the NeverFlynn trolls will come on here - - and explain in excruciating detail - - why that was a capital offense.

He's either hiding something that is dangerous and is will to destroy his reputation over it to protect the guilty.
Or, he is a good guy playing the bad guy so more exculpatory info get's released that the bad guys are hiding.

Sullivan’s game plan now is to “snow” the Circuit Court with complex legal B.S. to keep the Flynn matter in his court until after the election, hoping that Biden will defeat Trump, and reinstall the old corrupt Obama-Biden crew back inside the DOJ, so that Sullivan can move ahead with convicting Flynn and sentencing him to prison.

I remain hopeful that Flynn won't have to further appeal. Presuming the full court rules correctly, I want Sullivan censured afterwards not just rebuked.

I am sooo tired of this.
Trump is declining to rightfully pardon Flynn because it leaves both of them with the stench they did something wrong.
Call a press conference to announce your appeal of Flynn, President Trump.
Use the press conference to lay out the case how there was never a crime, this was just to hurt the President and prevent Flynn from being Director of National Security---where he would expose all of Obama's corrupt and illegal actions in wiretapping.
So use the megaphone to talk about the crimes committed by Comey, the FBI, DOJ, in framing an innocent man. And how Judge Sullivan refuses to obey the law. If the DOJ drops their charges against Flynn, IT IT OVER.
Oh, and offer Flynn his old job back...if he wants it.

Waiting for Judge Sullivan to play the race card. The Trump administration and William Barr's DOJ is only doing this because Judge Sullivan is black, and Barak Obama is black, and Susan Rice is black, and Eric Holder is black! The racist white Trump administration is going after and trying to discredit black people from the Obama administration. As a black judge he is being racially targeted and intimidated by the racist Trump DOJ! Evidence of this is how the Obama administration never prosecuted or went after white people like Hillary Clinton or interfered in investigations. I hope the full DC Circuit Court takes up the case and does a full public smack down of Judge Sullivan and exposed the full corruption of the Obama administration in their opinion.

Judge Sullivan is extremely butthurt over the three member mandamus. He has advocated for the further prosecution of Flynn, and he delusionally presents himself as a "party" in the Flynn case by requesting an en banc hearing. Judge Sullivan is incompetent and leaves little doubt that he is incapable of being fair and impartial in this case. The DC court of appeals should not only reject his en banc hearing request, but reassign the case to another judge posthaste.

IMO #10 best explains Sullivan's behavior. But I fear #3 is also likely, i.e. no Flynn = no problem.
I don't see that Sullivan is risking anything, the Democrats can block an impeachment. The handling of the en banc appeal will be revealing.

Inability to admit to the terrible coercive power of a corrupt DA, with corrupt FBI agents creating evidence against him, and hiding the exculpatory evidence seems, after a long period of 'failure to grasp' (failure to listen/read?) leads an observer to wonder about the motives or open mindedness of some people.
Espousing views which fail to even mention, let alone acknowledge as brutally effective, the obvious extreme disparity of force which might lead a person to plead guilty when they are, in fact, innocent seems, after a point to be disingenuous. Repeating the same obvious fact, "He pled guilty" without anything beyond that forlorn fact, is not likely to persuade that one is serious, or that one has any real argument.
Hard fact, some innocent people are coerced into pleading guilty when they are, in hard fact, NOT guilty. This is a wrong that should not occur, but has clearly been perpetrated against the general.
And being coerced by corrupt law enforcement should not be a crime in itself - but apparently, some think is is. Judge Sullivan thinks it is, as does at least one poster. So - being victimized by criminal LE folks with badges is a crime. Wow. Amazing 'logic'.
