Retired federal judge John Gleeson was recently appointed by U.S. District Judge Emmet Sullivan to argue against dismissal of the case against former National Security Adviser Michael Flynn and to advise him on whether the court should substitute its own charge of charge for Flynn for now claiming innocence. I have been highly critical of Sullivan’s orders (Snip)Now Gleeson has filed a brief that confirms the worst fears that many of us had about his appointment. Gleeson assails what he called “a trumped-up accusation of government misconduct.” (Snip) Gleeson was previously reversed as a judge for usurping the authority of prosecutors.

Read the brief carefully! Then consider how it is possible for some educated person not to mention in a 82 document that the multi-million dollar Mueller report found not a single episode of "collusion", and that there is a mountain of evidence of an intense, malicious, and politically motivated assault on all things Trump by the leadership of the DOJ and FBI.

The wording gymnastics in Gleeson's arguments rate a Large Turd, NOT a Medal. I'm not a Lawyer, thank God, I have a Soul...but I can smell a setup miles away. I hope the Appeals court fully understands that Flynn was SET UP and the Perps are the ones that need to be in PRISON! I would also say that Gleason and Sullivan should join them for attempting to Hang a Man that was the Victim of Bad Actors!

This is a terrific essay. Turley knows Gleeson well. He brings that knowledge to this piece. Gleeson has quite a reputation…not a good one.

Thank goodness Gleeson is a former judge. There are many more judges that need to be "former" including Emmet Sullivan.

Jonathon Turley makes me wish I had gone to law school. He is simply one of the most brilliant attorneys on the planet. His reasoning is so logical and his arguments so easily defended. I wish he would be nominated for the Supreme Court but then, he might have to take a pay cut. His students at George Washington University are blessed with this great teacher.

For a retired partisan Democrat federal judge to file such a brief, you have to figure that the retired Judge is fully aware that the Federal District Courts, and especially Judge Sullivan are completely politicized. That can’t be allowed to continue or it will just get worse. If they can persecute the National Security Advisor to the President like that, imagine what they can do to you! The first affect would be to bankrupt you with attorney’s fees, after that the sky would be the limit.

If this drivel is what a seasoned, experienced judge turns out, Lord help us what these new "woke" dingbats from today's law schools will turn out in 30-50 years.
First, the Judge was supposed to keep his treatise to 25 pages. He went over 70. I guess if you can't dazzle them with brillance, then baffle them with ...
I hope the Appeals court says "Judge, dismiss this case" tomorrow. But if the Judge don't like it, well, then it's time for Ms. Powell and her team to walk over to the Supreme Court and finish this off for good. Well, so that they can start the civil suit of Flynn vs Comey, et al. Which will make both Gen Flynn and Ms Powell wealthy people (as if, however, wealth can bring back the three plus years of h-e-double-hockey-sticks that the General and his family went through).

#1 - This case has zip, zero, nada to do with Russian collusion. You've apparently read the motions. The allegations are simple enough to understand...Flynn is said to have lied to Federal agents. He submitted a guilty plea, even confirmed the plea when Judge Sullivan took he case over and asked him if he wished to withdraw. If he now says he is not guilty, or that the plea was entered into under some duress, which he denied twice under oath, he has a perjury problem. DOJ has never said he is innocent. In fact, the filing states the crime occurred, but that the case cannot be proven beyond a reasonable doubt with the tainted evidence excluded. So Flynn/Powell have a hard row to hoe. Sullivan is left holding a big bag. And don't expect the appeals panel to be sympathetic to this one way or the other. Judges don't like being lied to in their courts under oath. They can see Sullivan's situation. Sullivan is surrounded by liars in this case no matter how one cuts it.

I used to get upset at Turley but he's doing what the best lawyers do. - finding a cause that may be unpopular with his side and arguing principle because it ought to be applied equally. I've really enjoyed watching him do this and I've come to respect him a lot because we all know how much flak he gets for this being a law school professor in DC.

1) There was no crime. Flynn did not discuss sanctions. 2) Flynn's plea deal was made under duress; plead guilty or we bankrupt your son like we did you. The plea agreement says there was no 'side agreement,' which this agreement was. Misconduct on the part of both defense attorneys and prosecution. 3) Flynn's counsel was conflicted. The original trial judge was conflicted, removed.
This entire proceeding was a steaming pile. There should be disbarments and criminal charges for all the 'professionals' involved.

Hogwash, #10. The whole Sullivan/Gleeson arguement is specious. THEY HAVE NO AUTHORITY TO DO ANYTHING but affirm the choice of the DoJ to drop this ill founded, fraudulent persecution.
Perjury is BS, even Gleeson says it isn't valid in his brief.

Gleeson should be upset with the corrupt JD instead of Flynn. The wrong people are being prosecuted. If Sullivan was honest he would be demanding full payment of legal fees from all of Mueller’s fake investigations. The judge that prosecuted & trashed Roger Stone is a disgrace too.
