The years-long case against former Trump national security adviser retired Lt. Gen. Michael Flynn continues despite the Department of Justice announcing weeks ago that it wants it thrown it — but the end is near.
Keeping the case alive is Federal District Court Judge Emmet Sullivan, who has refused the Justice Department’s request to immediately dismiss the case, instead deciding to first reexamine the case with the help of retired judge John Gleeson. But the standoff between the Justice Department and Sullivan appears to be coming to a head, both filing directly conflicting motions on Monday to the D.C. Circuit Court of Appeals,

This is analogous to, but the opposite of, a defendant pleading not guilty and after being convicted, the judge charges him with perjury because he said he was not guilty.

Pleas are not testimonial in nature. They are the criminal equivalent of civil pleadings.
A defendant should not be forced by the court to testify against himself in order to plead guilty. Stipulating to a factual basis for the plea is sufficient.

I think Algonquin J. Sullivan is being quite reasonable.
He only wants to wait until the cows come home - - or -- until Beijing Joe can be dragged over the finish line.

Sidney Powell said she expected a ruling of some sort in the next couple of weeks. That is what passes for coming to a head in DC.

Sullivan, the answer is not only NO but Hell NO!
Go back to your little courtroom and shut up...by the way, I think Flynn has a hellofa lawsuit on the back burner and I'm sure Sullivan will get a hit from that. Sullivan is a govt employee and doing illegal actions is NOT covered by govt. immunity...

Blame the prosecutors who delayed the sentencing for so long that exculpatory evidence was found that has changed the dynamics of the original charges.
So much so that the prosecutors' boss decided to decline prosecution.
Now, however, this judge, who helped Comey secure a $100,000 speaking gig, and likely needs to ensure there is still some sort of "guilty" verdict to allow the fraudulent Mueller probe claim another "win".

Clearly Judge Sullivan’s objective now is to delay the Flynn case past the General Election in November thinking that Joseph Biden will win the election, and return most of the corrupt and politicized Obama-Biden legal crew to the Department of Justice, so that the criminal persecution of Flynn can continue. Obviously the Democrats do not want Flynn out there, with all charges against him dropped, and able to tell his story and where all the old Obama-Biden bones are buried in Iran, and throughout the Middle East, during the run up to the election.

The Department of Justice does have the power to withdraw a prosecution.

The judge is corrupt. Remove him from the case, and END THIS, now.

I want this judge charged so badly for ignoring actual law, and making it up as he goes along. You know, we condemned waterboarding of muslim prisoners back in the day, right? What is different here, torturing a man who did not do anything wrong? This judge is now a torturer, whether he likes it or not.

All I can say is to read the two documents...Sullivan's and DOJ's. You may be surprised to discover there is biased/slanted reporting outside the "left"-stream media.

What's the purpose of a hearing on oral arguments? For the circuit to claim they're overburdened and need more judges (like they always do)?

Heh, had a funny thought from the first sentence of the headline...'comes to a head', made me think of a super big pimple (Sullivan) with a nasty red tip, festering, waiting for a patriot to come forward and pop it....

Our entire legal system has become the Mad Hatter's Tea Party in "Alice in Wonderland". That was not a children's fairy tale. The Democrats took it as a User Manual.

If this were not a high-profile case, I don't think the court would hold oral argument on something like this. I think they are trying to avoid any claim that they didn't give the case full consideration.

What's the hurry? If the DOJ can spend four years trying to prove that Donald Trump is a Russian agent based on the fact that he beat Hillary like a rented mule, they can drag Flynn through the mud for a few more weeks. Somebody needs to change their documentation and remove the words "honorable," "justice," "fair," 'impartial," etc. from every instance of writing and speech. They are as corrupt as any criminal organization on planet Earth.

It would be nice if Federal District Court Judge Emmet Sullivan got the full treatment that Lt. Gen. Michael Flynn received, That would be poetic justice.

What is sad about this, and about L. Graham's investigation's re: Rosenstein and others, is that the virus and loot8ing have taken the public's eyes off of it--------so it can happen again, as people don't realize how our country was almost taken away from us by unelected Creeps.

Sullivan will get a reprieve in a few days or weeks when Officer Chauvin mysteriously commits Epstein-like suicide while awaiting trial for murdering George Floyd which will of course be blamed on Orange Man Bad. The tentacles do connect to a central point.

Anything less than a public rebuke of Sullivan will only further empower leftist judges to do what they damn please - Constitution be damned. These judges understand much as do federal prosecutors that the vast majority of defendants just do not have the money or time or adequate legal representation to secure justice and the defense of their rights.

I seriously cannot understand why this point has not come before now;
Emmet Sullivan just has to be a good buddy of the Obummer and the Obummer is asking Judge Sullivan
to do ALL possible to help this to go away.
The Obummer just makes it perfectly clear that he HATES Fynn, and he (The Obummer), is afraid of what may come out after Flynn gets cleared.

Any and all appointments made by the purple-lippped communist need to be un-made, and it should have happened 3 1/2 years ago ! May be the most egregious waste of tax-payer money in history, besides our "wars" and congressional benefits.

Listen, you cowardly republicans. When you have control this coming year, impeach this joke. Along with Ginsberg, for old age, and incompetence. Show some courage like the democrats.

But I just read that a poster on a different thread say that Democrats are cowards.
Democrats have no courage.
That’s my take on republicans in Congress!
Which means that we’re all screwed!

My prediction is DC Court of Appeals will rule in favor of Emit Sullivan. They as far left as the 9th Circuit was in San Francisco. The judge cannot be the judge and the prosecutor. He is working for someone outside the court, maybe deep state or Obama and Soros. This should never have happened and I think this is the first time in history that it has happened.
