Federal Judge Emmet Sullivan has issued a couple of extraordinary orders in the case of former National Security Adviser Michael Flynn after the Justice Department moved to dismiss the case. Sullivan has not only decided to allow third parties to argue against an uncontested motion in a criminal case, but he has appointed retired judge John Gleeson to argue against dismissal and address whether Flynn should face a perjury charge from the Court itself. I have practiced in front of Judge Sullivan for many years. I have repeatedly(Snip) expressed my respect for his demeanor and directness. However, these orders raised deeply troubling questions of judicial overreach and enmity.

So judge If I get hit by a car in a crosswalk with the car blowing a red light are you going to hear the case charging that I littered because the contents of my briefcase were scattered all over the place and I did nothing to pick them up?

So, last night it was being mentioned they'd charge him with contempt, but now it's perjury?
Not sure, but since they never sentenced Gen. Flynn, they left the door open to potentially new evidence being discovered, which is has, and now it's KNOWN, the FBI didn't have any reason to interrogate Gen. Flynn.
It would seem he'd be able to change his plea since he was never actually sentenced.
This "judge" doesn't seem to be interested in actual justice, that his court was used and abused.
Thought I heard this same "judge" was involved in the Sen. Stevens case, which was overturned due to prosecutor misconduct. You'd think he would want to ensure his court isn't again used for injustice.

This madness is insane (I realize that's redundant). Leave this poor man alone! What did he ever do to you? Oh, yea, Obama hates him. That must be grounds for ruining this man's life, right?
Perjury for being coerced into a guilty plea? All of the attorneys on this case should be prosecuted to the fullest extent for denying Flynn his constitutional rights.
Stop this ridiculous unmerry-go-round and let us all off--it's making us collectively sick!

To be consistent, Judge Sullivan would need to go back and charge every defendant who has ever come before him with perjury. I would love to see a higher court come back and slap Judge down and put him in his place.

This judge was appointed by the community organizer who is cracking the whip and is desperate. The punk is calling in all his markers. Every liar of that so called administration has been on the phone with this judge. They want the heat off the Kenyan born and returning to the made up story of Russian collusion. Let's litigate it once more, this time in court.
I hope that Powell will ask for a new judge. When amicus briefs were to be entered that were positive about Flynn the 'judge' did not allow it. Now he is looking for negative amicus briefs. According to Horowitz that is against the law. I take his word over this 'judges' any day! Throw this judge out of office

This is serious business. Obama ordered the hit job on Flynn, because Flynn was looking under rocks which were not to be disturbed. Flynn was going to clear the swamp, and said swamp did not want clearing.
Obama is facing jail time and so has pulled the strings on the Judge.
This is judicial misconduct at its worst. Sullivan looks even worse than Chief Justice Roberts, who was intimidated into ruling that a non-tax was a tax to save Obamacare.
I am reminded, for some reason, of the Herblock cartoon from 1973, showing judges pulling the tape out an inch at a time. Inch by inch, the Flynn framing is coming into focus.
Sullivan better look out. He could get sucked in to the drain.

The Fokker case the moron affirmative action dweeb Sullivan referenced in his 'order', makes clear his action is lawless. He and his clerks are just too stupid to realize it, or hope nobody notices. But it has been noticed. I suspect Powell will politely hand him his nether-regions. Or the circuit court will. The more visibility he gains from this the more likely an impeachment charge and removal from the bench becomes, since this is so blatant.

Totally ludicrous. So anyone changing a plea is potentially risking being charged with criminal perjury (since you were under oath before the court when you originally made that plea and now are effectively admitting that you lied then)? Twilight Zone stuff. Tide Pods, the Breakfast of Democrat-appointed judges.
By the way, the absurd threat of the "perjury" charge may in fact be to retroactively give cover to Obama for showing his own complete lack of legal understanding when he casually asserted that Flynn had committed perjury. Gotta protect the awesome reputation of the Liebringer.

obama was talking PERJURY a few days ago. It was thought that he did not know the actual charge and was misinformed. It now seems that he knew what the new charge against Flynn was going to be. Days before. Collusion?

A judge cannot charge someone with anything. A judge can hold a person in contempt of the court, but that is not charging someone with a criminal matter. It is up to the prosecutor to bring charges.

What is especially troubling is how Flynn was also the victim of ineffective assistance of counsel in making the plea. That record has been kid bare as well. How many reasons do you need to withdraw a plea and dismiss a case?

I wonder what Sullivan thought when he heard Comey spell out Hillary's sins, and then said there was no chance of convicting her. Would he have thought about bringing in another prosecutor? Also, apparently he feels you can withhold exculpatory info from the accused and still proceed with the prosecution.

So, if pleading guilty (under coercion) when you are not guilty is perjury, is it perjury if you plead "not guilty" in any case if the ruling then goes against you?

Now Sullivan should know better than to try this on. It has already come out that Flynn was extorted by the threats of persecution against his son. That kind of evidence is not admissible in a normal court of law. But then the buddy of Obama does not run a normal nor honest court of law.

"The suggestion that Flynn could be charged with perjury for seeking to withdraw a plea is highly disconcerting." Sorry, Professor...you're just wrong here. Flynn swore he was guilty, and that he made the admission with counsel and that he was not pressured or coerced. That's the issue.
Are we interested in the truth? Or, afraid that Flynn's heroic narrative will fall apart if examined closely? Why did Flynn swear on two occasions to something not true...and now brings his untruthfulness to the court's attention? That's the issue here. Let's hear the whole story. It surely won't be good for the Government...and it may not be so good for Flynn, either.

Welcome to North Korean justice. This judge has a serious problem that goes beyond criminal justice. Only one thing pushes his radical agenda and its hate. But this POS could hate all he wants because in the end, after he makes a complete fool of himself PRESIDENT TRUMP will pardon General Flynn. Get it.
