Editor’s note: The Washington Post and other news outlets on Friday reported that Justice Ruth Bader Ginsburg has been treated again for pancreatic cancer. “It was the second treatment for cancer in nine months for the court’s oldest member and leader of its liberal wing,” the Post story notes. (Snip)On April 14, we published the article by George Bardmesser, which argues President Trump could make a deal to name a “100 percent confirmable anti-Ginsburg” justice not named Amy Coney Barrett in exchange for the liberal jurist’s retirement. In light of Friday’s news, we’re reposting Bardmesser’s prescient commentary for further consideration. I am a lowly lawyer who has never argued before

If the shoes were on the other foot, a Democrat nominee would not be subject to bargaining. Author is bonkers. Justice Amy Barrett sounds nice to me.

Highly impractical as the Dems cannot be trusted to keep of their end of any bargain. It will be "too important" and "too historic" and "people will die" if they don't renege on such a deal.

This is a classic Establishment Republican LOSER position. Just when you are about to WIN, you compromise and surrender. The author says that this is an guaranteed WIN for Trump. We should compromise that WIN away because RBG is a nice old lady? For just once I agree with BO, We WON! the election. We get to make these choices.
Cut a deal? Deals with liberals are NEVER good. They always have a poison pill. They get what they want and we get a long wait and then NOTHING.
And here is a disaster scenario. Trump has the chance to place Amy Coney Barrett on the SCOTUS and compromises that chance away. Then he loses in 2020, probably because he cut a deal with RBG. No more Conservatives added to SCOTUS for a while and one of the best choices is sidelined. Another scenario is that the Senate tightens and the process becomes a really tough battle. I don't believe these things are going to happen but I think Trump would be a dope to trade away this upcoming opportunity. Let's get it DONE!

The time for compromising with the Evil Borg Stalinist Collective is long past. We are in the midst of a war for the soul of this country. The left has already taken the war "hot" and is prepared to inflict even more violence on the basket of deplorables. Let this despicable, evil wench expire soon and join her kindred demons in hell. Really? Give up the advantage and fail to have Amy Coney Barrett on the Supreme Court? Why, pray tell, would Trump make such a blunder? Frankly, I am 98% certain that even with RBG's support, WHOEVER Trump nominates is going to get a hellacious attack by the Enemedia and all of the Dems in politics or even NEAR politics.
I doubt that the reaction to this Britt Grant (who?) will be 2% less vicious than ACB will get. In fact, since Britt seems to be a male, he will be subjected to "near proof" that he has been a serial rapist his entire life, and perhaps a child murderer. All lies, of course, but the lies will still be dumped out there, and the Enemedia will solemnly opine that, "well, of course, Trump would choose a serial rapist and child murderer for the Supreme Court, just like last time. It's because Trump is so evil."
RBG will be in her grave soon enough, and I doubt she will do anything but hang on to life as long as possible, raging, bitter and angry. And even if she tries this gambit, I really hope that the President politely tells her to pound sand.

I’ve mentioned months ago Trump should submit 3 to 5 names to the senate of who he will nominate for any future SC openings. Then force the senate to do whatever checking they deem necessary now. Then hopefully the senate will force time limits for a vote yea or nay. Don’t let the Dems filibuster.

the Kavanaugh confirmation was an opportunity for Dems to act as adults and follow the Constitution. Instead they acted like spoiled children and threw a temper tantrum.
Democrats do not understand compromise, they only understand power. Trump has the power and should use it to once again and make Democrats the losers that they are.

Dittos to the replies here, there is zero reason to compromise. Trump has already nominated two qualified jurists to the Court, which is two more than his predecessor. A few more over the next 5 1/2 years would keep America winning for years to come.

If she assumes room temperature in the next few weeks, PDT could nominate someone quickly and tell Mitch to get it done by Christmas, thus nullifying the Biden rule. Which truly doesn’t apply in the 2020 election but the left will try to use it anyway.

If the Democrats are offering a 'Deal' it is because they believe they are going to lose. In addition, All deals I have ever heard from the Democrats basically say, 'give us what we want or we will pound you'. They realize RBG is not going to last out PDT's term. Just wait. Why surrender to a bully when we know we will win?

#21, I see no gloating here. I only see people observing what is happening, and considering the political consequences of what appear to be the most likely event in the near future.
RBG has pancreatic cancer a second time. She is elderly. It is unlikely that she will be living beyond the first Trump term. These are facts, or high probability events over which we have no control. But, we can anticipate what might be the political issues that will be needing to be handled, if these high probability events do come to pass.
I am no fan of RBG, but I do not gloat at her demise, or any pain she may have. I will be pleased when she is no longer on the Supreme Court, for WHATEVER reason that may happen. Not pleased that she is harmed, but pleased that we will be able to go back to Constitutional law the way our Founding Fathers intended.

This argument has, at least, a little bit of merit. Picture this: RBG enters the bunker at one end and POTUS on the other. She makes her offer and POTUS remains silent. Instead, The Donald, as he is wont to do looks her straight in the eye and thanks her for her offer. He rejects it, and instead, offers a counter-proposal. POTUS says: "Offer me the retirement of yourself, along with Justice Breyer (and possibly Sotomeyer) and we might have a deal. I'll take two or three in exchange for Barrett. Deal, or no deal?" Outlandish, yes. Possible....well..
