Appeals Court Looks Askance
at Obamacare

Original Article

Posted By: Garnet, 7/10/2019 5:44:03 AM

Tuesday afternoon, the Fifth Circuit Court of Appeals heard oral arguments in Texas v. Azar and aggressively interrogated attorneys defending Obamacare’s individual mandate. They seemed deeply skeptical that the mandate can survive constitutional muster unless the lawyers representing Democratic attorneys general in 21 states and the Democrat-controlled House of Representatives can produce more convincing arguments than they have thus far put forward. This may well endanger the entire health-care law. The general atmosphere during Tuesday’s hearing suggested that, if the individual mandate falls, Obamacare’s entire creaking edifice must go down with it.

Who is the bigger disappointment, John Roberts or Jeff Sessions? Flip a coin.

We will see if the SCOTUS, and specifically Roberts, are cowards or not. Roberts resurrected the almost dead BOCare monster. Congress drove another stake into its heart by prying its grasping fingernails off of Americans wallets and once again it is, thankfully, approaching its end-of-life. It's a dead Norwegian Blue parrot. It seems beyond even Robert's Voodoo. However, Roberts attempted to preserve the monster, he should give it a proper and official burial by the SCOTUS and face up to what he did.

Why all the vitrol towards Roberts? He is only 20% of the numb skulls that ruled it a tax. All 5 of those legal morons are on the hook for Obambicare being unconstitutional without the tax component. Why aren't the other 80% that ruled it a tax getting some attention? If the 5th rules its unconstitutional and the appeal hits the SCOTUS, it should be 9-0 against review as 5 have already ruled its unconstitutional without the tax component.

Obamacare should have died in the womb in 2008. There is nothing legal or Constitutional about it and the fraudulent, bought-and-paid-for John Roberts knew it. It was not a medical system it was a socialist nightmare that cost us billions and ruined the healthcare of millions of Americans so a few parasites could be treated for free and a substandard president could be praised for the illegal distribution of our money.

There was nothing legal or Constitutional about the entirety of the fraudulent 0bama cabal, they certainly weren't an administration.

For months now, almost since the opening of Congress, Speaker Nancy Pelosi and freshman Rep. Alexandria Ocasio-Cortez have been at odds with each other. It started with gentle gibes, Pelosi talking euphemistically about AOC’s “enthusiasm,” for example. But over time it has grown more contentious, and now AOC is fighting back. (Snip) “The persistent singling out . . . it got to a point where it was just outright disrespectful . . . the explicit singling out of newly elected women of color.” She has even gone so far to somewhat bizarrely claim that she was loaded with excellent committee assignments just to keep her busy.

The political misfits known as NeverTrumpers are begging for allies ahead of next year’s presidential election—and, as usual, they aren’t looking to the Right. This collection of failed magazine editors, Iraq War propagandists, washed-up columnists, Russian collusion pimps, and losing campaign consultants have dogged Donald Trump and his supporters for three years. While some anti-Trump “conservatives” who contributed to National Review’s infamous “Against Trump” issue in early 2016 have become supporters of the president, others cannot let go—but their obstinance is less about principle and more about grift: Acting as the useful conservative idiot for the Washington Post or MSNBC

We’re currently witnessing one of the greatest attempts at mass bribery in history. With each passing week the Democrats running for the 2020 nomination offer yet another bribe for winning more votes. The most recent is Senator Kamala Harris’s $100 billion dollar plan for black home ownership. But this is child’s play compared to everything else the Democrats have either proposed or endorsed. Consider the 10-year cost estimates for some of the major plans that most, if not all, of the potential 2020 nominees have already embraced: Medicare for All, otherwise known as socialized medicine

Nancy Pelosi was probably not heartbroken when the fourth-ranking member of the House Democratic Caucus, Rep. Joe Crowley, was defeated in his 2018 primary by a bartender named Alexandria Ocasio-Cortez. Crowley had been seriously considered for House Minority Leader in 2016, and he might well have made a serious play for the House speakership had he been reelected in 2018. From Pelosi’s perspective, it must have seemed that she had lost a potential leadership rival and gained an easily managed back-bencher. Even after AOC began making demands concerning the membership and agenda of the Select Committee on Energy Independence and Global Warming

I love those "Any Functioning Adult 2020" bumper stickers as much as any upper-middle-class suburban white liberal. But if I'm honest, it isn't really true. I will never vote for Donald Trump, but that doesn't mean I'll cast a ballot for any Democrat with a pulse. I would vote for no one rather than contribute to the victory of a candidate who fails to show minimal competence and capacity for responsible leadership. Judged by that standard, the Democratic field isn't looking very good right now. Yes, it's early. There's plenty of time to mollify my concerns. But at the moment, none of the leading candidates seem like serious contenders.

There must be another election coming up because Democrats are once again shamelessly pandering to black folks. Their latest ruse is reviving the idea of reparations—literally, race-based transfer payments from white Americans to black Americans. Can you believe that’s really a legislative priority for Democrats at a time when African unemployment is hovering at record lows. Nevertheless, 64 House Democrats are cosponsoring a bill that would establish a commission to work out the details of a national reparations policy, and the House Judiciary Committee recently held a hearing to draw public attention to the effort.

Now that media-savvy congressional Democrats like Rep. Alexandria Ocasio-Cortez have brought attention to the humanitarian crisis on the U.S.-Mexico border caused by Congress’s refusal to fix our exploited immigration laws, political pundits are having to eat their own words from just a few months ago claiming that the border crisis was manufactured by President Trump as a political stunt. This is the time of year when, all across America, disgruntled adolescents are dragged by adults to places they do not want to go. When they aren’t posing with frozen smiles for group photos, they sit sullenly in the back seat, texting their friends about the latest hellhole they have been forced to endure by their parents. Likewise, Alexandria Ocasio-Cortez was recently shamed into visiting a couple of the border detention facilities that she has been criticizing from the comfort of Congress. Her first act upon arrival was to throw a tantrum, complete with foot stamping, yelling and screaming.

The perversity of the illegal immigration debate was best captured by Thomas Sowell: “Immigration laws are the only laws that are discussed in terms of how to help people who break them.” And it would be difficult to find a better demonstration of Sowell’s sagacity than the reaction of the Democratic presidential candidates during last Thursday’s “debate,” when they were asked to affirm that “undocumented immigrants” would be covered by their respective health care plans. Everyone on the stage reached for the sky, thus surrendering the field to President Trump on the issue that got him elected in 2016.

When one candidate enjoys an enormous lead in the polls in a field of two dozen, he's bound to be a target on the debate stage — the one person everyone has an incentive to take down a peg. And so it was that in Miami on Thursday night, in the second half of the first Democratic debate, former vice president Joe Biden became a punching bag. It started with Rep. Eric Swalwell taking a dig at the 76-year-old Biden's age by calling on him to "pass the torch" to a younger generation.

Long before Jeffrey Epstein pleaded guilty to prostitution charges in Florida more than a decade ago, his fellow Palm Beach resident and hedge-fund manager Douglas Kass was intrigued by the local gossip about his neighbor. “I’m hearing about the parties, hearing about a guy who’s throwing money around,” says Kass, president of Seabreeze Partners Management. While stories about young girls swarming Epstein’s waterfront mansion and the sex parties he hosted for the rich and powerful were the talk of the town, Kass was more focused on how this obscure person, rumored to be managing billions of dollars, had become so wealthy without much of a track record. Kass was well-connected
