The right to Trump tweets

Original Article

The Second Circuit has affirmed a district court decision holding that President Trump cannot block his critics on Twitter. Plaintiffs wanted to get Trump’s tweets directly and contended that their inability to view, retweet, and reply to Trump’s tweets limited their ability to participate with other members of the public in the comment threads that appear below the President’s tweets. The court agreed in a 29-page opinion that I have embedded below via Scribd. FOX News reports on it here. I wondered about possible workarounds plaintiffs could have used. The court addressed that issue as well, holding that available workarounds unconstitutionally burdened plaintiffs’ right

Does this mean that we can 'criticize' Hillary and Obama without being blocked? I've seen what some of the Presidents critics have posted, most vulgar name calling. I look forward to being able to return the favor to liberals in kind.

Does this mean that no politician, celebrity, or any other person considered to be a "public figure" has a right to control their personal social media accounts? Are these accounts now considered to be public utilities? If this ruling covers Trump's account, it should apply to all "public figures". There will be a lot of people unhappy about this as if it applies to one, it must apply to all!

Sorry for the 2nd post, but as badly as AOC takes any kind of criticism, this could turn out to be fun.

This is about public officials, not public figures. The basic answer is that privacy ends once a PUBLIC OFFICIAL uses "a social media account for all manner of OFFICIAL purposes to exclude persons from an otherwise‐open online dialogue because they expressed views with which the official disagrees.” Yes, that would apply to AOC.

Except it probably won't apply to AOC. Some animals don't have to abide by the farm rules like other animals.

#5, then you file a lawsuit and make it apply to AOC.

Well, that means any of us can not block someone who is threatening, harrassing, or just annoying us? Thanks, Judge. Blood will be on your hands.

I too want to know if ANYONE no longer has the right to block someone else on Twitter? How about on a phone? Aren't people who leave disturbing phone messages just "communicating"? Email? "Free speech" isn't that simple. There have always been recognized boundaries.

That is a question that often occurs to me when I watch the Democrats’ anti-American hate-fest. (No, this post isn’t about the media’s slavering homage to Megan Rapinoe, but it could be.) The Southern border is a litmus test: do they believe that the United States has a right to exist as a sovereign nation, or don’t they? For many Democrats, the answer evidently is No. That goes for all of the Democratic presidential contenders: I believe all of them have signed on to the notion of free medical care (along with many other welfare benefits, of course) for illegal aliens. This isn’t exactly treason

Back in 2015, onstage at the annual CPAC conference, Trump said something very interesting about Bill Clinton. "Nice guy," he said. "Got a lot of problems coming up, in my opinion, with the famous island with Jeffrey Epstein. Lot of problems." Trump knew what he was talking about. Vanity Fair reports that, shortly before CPAC, Trump was approached by David Pecker, who then owned the National Enquirer. Pecker visited Trump and brought along "an issue with a Prince Andrew and Epstein-related cover." They were joined by Trump lawyer Michael Cohen. After the meeting, Trump called in Sam Nunberg, who then worked for him. Nunberg told Vanity Fair:

PHOENIX — Hundreds of people including a presidential candidate spoke out on Twitter this week after a 17-year-old black youth was killed at suburban convenience store, allegedly by a white man charged Tuesday with first-degree murder who has said he felt threatened by the boy’s rap music. Family members have told local media that Elijah Al-Amin would have turned 18 in two weeks and was looking forward to his last year in high school. Friends and family hugged Monday at the Islamic Community Center in Tempe, where prayers for the teen were held before burial in Maricopa County. For months, Democrats accused President Trump of manufacturing a border crisis for political purposes. Because of this, they’ve generally refused to work with Trump or Republicans to do anything about it. They’re singing a different tune now, however, but instead of blaming Trump for manufacturing a crisis, they’re blaming him for the crisis. All the negative news we’re hearing from the border has Democrats pouncing, hoping to pin the blame on Trump and policies. But when you look at the facts, it’s clear that while the crisis wasn’t manufactured, the Democrats’ outrage is. For years, they’ve stood idly by as the issues

Mark Hemingway caught Joe Biden’s “especially combative” interview with Chris Cuomo on CNN yesterday (video below). Hemingway reports that when Cuomo shifted the topic from mandatory school busing to Russian election meddling in Europe and America, “Biden bizarrely asserted that the Obama administration never let that happen.” Biden’s catchphrase in this short interview is “C’mon, man.” Count the times he resorts to it. If Biden remains a serious candidate, I’m afraid the interview is worth watching. It put me in mind of Robert Gates’s observation that Biden has “been wrong on nearly every major foreign policy and national security issue over the past four decades.”

On this year’s Fourth of July vacation—a holiday my family still celebrates (call us old fashioned)—my wife and I were walking along a Grand Haven, Michigan street when we overheard how, in the World Cup semifinals, Britain had just tied the U.S. women’s soccer team at 2-2. Unable to watch the remainder of the game, later that night in our hotel room, we made a point to stay up late to see if, in fact, America’s women won the match. As is so often the case, the word on the street was wrong—Britain had never tied the match

A tragic fire aboard a secret Russian nuclear 'mini-sub' in the Barents Sea that killed 14 senior sailors has refocused media attention on a little noticed flash point of the world: the Arctic. That an important Russian system was being tested or demonstrated was suggested by reports "that among the 14 dead were 7 senior navy captains and 2 'Heroes of Russia'." The presence of so many Russian navy worthies raises questions because brass do not typically twiddle dials on mini submarines but watch them being twiddled until something went horribly wrong. One may speculate endlessly on the true nature of the Russian experiment.

On July 4th, 1976, as America celebrated its Bicentennial, four Israeli Air Force C-130 Hercules planes carrying over 100 Jewish passengers, twelve Air France flight personnel, and their Israeli rescuers landed safely at Ben Gurion Airport. The safe landing of civilians and commandos marked the end of a week-long, nightmarish drama that gripped all of Israel. The saga began on June 27, when a Paris-bound Air France commercial airliner took off from Tel-Aviv. The plane was scheduled for a stopover in Athens. Lax security at Athens International Airport enabled four terrorists with forged passports – two from the notorious West German Baader-Meinhof Gang and two

American presidential elections have become a political clown show cum soap opera that goes on far too long and has become a true danger to the country in a variety of ways. On the simplest level, it used to be said that you could never get anything done in Congress in an election year. But now it's always an election year. No wonder nothing gets done. And that's only the half of it, the easy half. Those other old political watchwords — that partisanship ended at the water's edge — have gone out the window and are now headed for Alpha Centauri.
