SAN DIEGO — A Navy SEAL testifying in the chase of Chief Edward Gallagher, who is accused of several war crimes including murdering a wounded ISIS fighter and shooting civilians, says it was he, not Gallagher, who killed the ISIS teen, the San Diego Union-Tribune reports.
The SEAL reportedly testified under an immunity agreement. He claimed that while Gallagher stabbed the fighter, he covered the teen’s breathing tube, asphyxiating the prisoner.
The U-T’s Andrew Dyer broke the news on Twitter:

Judge Nap, as always very much short of information, just cannot understand how this happened… He also made no mention of the witness’s having been given immunity. Too often charges out on a limb, very ill-equipped to make his pronouncements.
As for Gallagher:
The trial has been dogged by allegations of prosecutorial misconduct, with the trial judge finding that Navy prosecutors used tracking software to spy on the defense team’s email accounts.

Calling this mess a can of worms is an insult to all those innocent bait cans out there.
The persecution (no typo) needs to be tossed out on their stupid ears.

Whatever it takes to send'em to Pair-A-Dice is fine with me. Not guilty. Give them all medals. Case dismissed.

The mooslim scrub deserved to die for fighting out of uniform, per the Geneva Conventions. Case closed.

Outstanding! Kudos to the corpsman for his testimony, and to Hell with the Navy JAG that decided to prosecute this case. We’re in a war with animals who want to destroy our civilization; we should take no prisoners and give no quarter.
In WWII, the Marines in the Pacific took almost no prisoners. The Army in Europe routinely shot captured Germans, especially after the Malmedy massacre. Nobody was ever court-martialed for it. (Eisenhower made noises about it, but did nothing.) That’s as it should be. This court-martial should end today, and Chief Gallagher should be allowed to retire with all benefits.

Judge Nap clearly leans toward prosecution. Could have punched his ugly mug through the TV. Much ado about the ISIS fighter’s being a teen. We have never allowed children - in our time, at least - to be involved in warfare. It was a new idea to American troops abroad to find out how lethal a little kid could be. In the Middle East, a 15 year old is a man. But the sob sisters will repeat “teen” over and over…. Fie on them. Context is everything. Their “teen” would not have hesitated to kill Americans, and that is in plural...

I'm sorry, but I thought we were fighting ISIS to eliminate their threat to civilized society. Seems the only good outcome of this was that an ISIS fighter was killed.

I love the way they use the term ISIS ‘teen’ as if he was just down at the malt shop with his prom date.

My comment to my wife the first time this came up was:
"OK, live SEAL, dead ISIS. That is all I need to know. We are done
here."
If you watched the miniseries "Band of Brothers", or read the book, Lt. Spiers shot
German prisoners, actually several times. Nobody was too real thrilled, but nobody
got too wrapped around the axle.
And Spiers was a true, legit hero in the fight at the village of Foy, relieving a frozen
Lt. Dike and twice running directly THROUGH German lines to contact, motivate and
direct other Americans on the other side of the village. Spiers was a combat wonder,
and yes, he broke some rules, but he was one of the smart and brave ones that helped
us win that war.
War is a real mess, trying to fight it by the Marquis of Queensbury rules is just stupid.
Yes, try to be somewhat humane....but the very concept of humane war is a real
oxymoron.
Win it.

IIRC very young VC children were armed and guilty of shooting our soldiers & those of our allied forces. So a 15-year-old using a weapon against us is no less dangerous than a 20, 30, 40 years old - or any age in between or over. If the kid stumbled upon the S.E.A.L.s hideout position the same thing applies, he's got to be guaranteed quiet!

This happened during the Obama years when the military had to knock on a door before they entered the enemies house. The WH ran the military, now President Trump lets the military do it fast & their way.
