An Alaska man is petitioning the Supreme Court to consider whether the government's seizure of his $95,000 plane for transporting an illicit six-pack of beer is an excessive fine under the Eighth Amendment. The Institute for Justice, a public interest law firm, filed a petition for writ of certiorari today on behalf of Ken Jouppi, an 82-year-old Alaskan bush pilot, asking the Supreme Court to rule on whether states should consider the gravity of a defendant's specific offense, rather than an abstract view of the general crime. Jouppi was convicted of a misdemeanor when a passenger was attempting to bring beer to a "dry" village where alcohol is prohibited.

The Institute for Justice has been very successful at the SCOTUS. They have been granted 12 petitions for certiorari at the SCOTUS and won 10 of those cases. Whether this case gets accepted is still up in the air.

Why does this have to go to the Supreme Court? Does the system up to that point have zero common sense or was it hopelessly corrupt. Looks like the latter.

"As government agencies increasingly exploit fines and forfeitures to pad their budgets,".... It sounds to me like the Alaska gummint WANTS A FREE AIRPLANE! Crooks, is what they are. Remember a few years ago (if I recall correctly) they filed some 'Bee Ess' charges against Senator Ted Stevens, ruined him, made his life hell. After he died, it turned out it was all a complete fabrication.

I hope the Supremes take the case, but I fear that they will not, as their docket is crammed with lawsuits against Trump.

In today's market a Cessna 206 is worth way more than $95k. That said, from what I can gather from the article, I do not think the penalty is any more excessive than if authorities seized the plane of cocaine smugglers bringing drugs across the US/Mexico border. They knowingly violated a sovereign village's drug laws.

I thought this type of stupidity only existed in the Middle East. In some of those countries you can rape little boys and beat women to death but you can't have a beer.

Like they do with everything, the government has abused their asset forfeiture laws. They should all be repealed. The only power the government will not abuse is that which they do not have.

Yes, the plane is probably worth $195K. I agree, that was an excessive fine for that misdemeanor.

Asset forfeiture is practiced in many jurisdictions in the Free United States. Depending in the crime, the Feds and the state share the booth denying the accused of property. It's been happening on the highways and at TSA inspections. Try to get it back if you're found not guilty or charges are dropped.

So the guy is accused of bringing in a 6-pack of beer to a 'dry' village. Is all of Alaska 'dry'? If not, is there a commonly-known map of which areas are 'dry' and which ones are 'wet'? How is the pilot supposed to know which is which? I have to respectfully disagree with #4. A 6-pack of beer- which is legal in the overwhelming majority of American states, counties and towns and with the mild effects of its slight alcohol content, is not the same as a load of cocaine, which is illegal nationwide and which -as I understand it- has severe effects on the fools who even start using it.

South Carolina called on the Supreme Court on Thursday to enforce the state’s transgender bathroom ban against a 13-year-old transgender boy. The Fourth Circuit issued an injunction earlier this month preventing South Carolina from banning a student identified as John Doe from using restrooms matching his gender identity. By law, every PHA is required to share eligibility information, including citizenship status, with HUD. The Trump administration will on Thursday grant itself new permission to hire any attorney to serve as an immigration judge on a temporary basis, eschewing longstanding restrictions on who could serve in those roles. The change gives Attorney General Pam Bondi wide latitude in selecting officials to oversee asylum and other cases pending before the Executive Office of Immigration Review, the Justice Department agency that runs the nation’s immigration courts. At least four people are dead, including a child, and 19 others were wounded in shootings across Chicago during the weekend, according to police. The ages of the victims range from 5 to 48. It does not matter if individuals become naturalized citizens of the United States, so long as they retain the citizenship from wherever they came, they should not be allowed to serve in the American government. Either they renounce their foreign citizenship, or stop serving in our government. And, it is more preferable that they self-deport if they feel strongly about keeping the other citizenship. As founder John Jay expressed in 1787, “Permit me to hint, whether it would not be wise and seasonable to provide a strong check to the admission of Foreigners into the administration of our national Government.”
