In a victory for the Justice Department and against commonsense, a federal appeals court ruled on Friday that merely being in the Capitol was enough to merit conviction for “disorderly” or “disruptive” conduct.

A three-judge panel of the DC Circuit Court of Appeals unanimously ruled that they were participants if people were aware of what was happening around them.
“A lone hiker on a mountaintop can sing at the top of his lungs without disturbing a soul; a patron in a library cannot,” the panel of the D.C. Circuit Court of Appeals ruled in an 18-page opinion authored by Judge Karen Henderson, an appointee of George H.W. Bush.

What this means is how many of them knew they weren't supposed to be in a certain area.
Most who walked from the rally down to the Capitol arrived way after the security fencing was removed and the doors to the Capitol were open.

The current government is illegitimate. What needs to happen is for millions of Americans to rise up and throw them out. They know this and the illegal Jan. 6 ultra-persecutions of an illegally instigated riot is the Deep State's object lesson of what will happen to the rest of us if we resist their tyranny. Why does the District of Columbia, a relatively small city, have its own Circuit Court of Appeals? Most Circuits consist of three or more states. The 4th Circuit includes Maryland, Virginia, West Virginia, North Carolina and South Carolina. The District of Columbia should also be part of that Circuit. Congress can change this. It probably won't but should.
