The Senate rejected an attempt on Tuesday to derail former President Trump’s impeachment trial by getting it declared unconstitutional. Senators voted 56-44 on if the trial was constitutional falling short of the simple majority needed to grind the proceedings to a halt.Six GOP senators jointed with Democrats to say they believe the trial is constitutional, largely mirroring a similar vote from late last month.Only Sen. Bill Cassidy (R-La.), who had previously supported an effort by Sen. Rand Paul (R-Ky.) that would have declared the trial unconstitutional, flipped

Doesn’t the Supreme Court have say over what is constitutional? Where are you Supreme Court? How come the Chief Justice isn’t presiding? This is a total farce.

#4, the Supreme Court must have a case presented before it in order to rule on something, and as for the Chief Justice’s refusal to preside, that sends a pretty clear message that he doesn’t consider the trial constitutional.

The Senate's opinion of this impeachment's constitutionality may be interesting; but it's still irrelevant. As was Eric Holder's 2011 declaration that DOMA was unconstitutional.
The power of Judicial Review rests solely upon the SCOTUS.

OK. Who wants to tell the morons in Congress that they don't get to "vote" on whether something is constitutional or not. THAT is the exact reason we have a SUPREME COURT. It's the courts only job!

The Senate can vote that the world is flat, and it would have as much meaning as to whether the trial is constitutional. It will end up with acquittal and unfortunately nothing more will happen. It would have to be brought before the Supreme Court to rule on constitutionality, and that would be moot after the acquittal.

The Senate is carrying this out purely for the symbolic value. They are telling Trump he is not welcome in Washington, and they are in charge. They are nothing but a bunch of incompetent crooks. If they would screw with Trump like this, what would they do to the general public? Do these jerks understand the ramifications of what they have done? This country has had over a century with very little civil unrest because we are a nation of laws that protect EVERYONE. They are throwing all that out the window. You don't change the law just to protect a small group of people. If we cannot resolve things lawfully, how will things be resolved? Answer: Through force. These fools are traveling down the wrong road, and that road leads to a cliff. They know exactly what they are doing, know its wrong, but persist. They are fools.

"Senators voted 56-44 on if the trial was constitutional" : That is not for the senators or Congress to decide but SCOTUS. Why is the Chief Justice not presiding as required by the Constitution, if it were constitutional? Because the impeachment in this case falls at the first hurdle: there is not a President to be impeached, and the second hurdle, or "to be removed from office".
