The D.C. Court of Appeals has agreed to rehear the case against retired Army Lt. Gen. Michael Flynn, the court announced on Thursday. The court’s decision prolongs an already three-year legal battle between Flynn and Department of Justice that federal prosecutors asked to be closed with all charges dropped back in May. Federal District Court Judge Emmet Sullivan denied a request to immediately dismiss the case and instead brought in a retired judge to assess and potentially continue the prosecution. Oral arguments in the D.C. Circuit Court are scheduled for August 11.
Just amazing.
Although, it means more information will be coming out, and illustrate previous prosecutor misconduct, and willful withholding of brady material.
I believe, if not for this particular case not being closed a couple years ago, much of the recently discovered material would not have been uncovered. They simply delayed sentencing, for some reason, despite having his plea agreement.
I think that should be a key question, why didn't the judge and previous DOJ prosecutors sentence Gen. Flynn when they had their chance?

So a judge has taken on the job of prosecutor even after the DOJ drops all charges. Not a lawyer, but this does not smell right.

We'll see how much of the "fix" is in.
So if the "en Banc" hearing allows the charges to be dropped, well, that's fine.
If the "en Banc" hearing allows the kangaroo court to continue, it will go to the Supreme Court. (it may end up there anyway, even if the decision to drop the charges is upheld because Judge Sullivan and his deep state cohorts at Lawfare may be too deep in this mess; they have to hope for a Biden victory and just delay everything as long as they can.

Doesn't "Charges Dropped" mean that the DOJ has no case upon which to prosecute Flynn?

It's pretty much another coup attempt, and these judges best be very careful since no one will trust any of them after this clown act.
Did we really need a Court of Appeals?

There really isn't anything these liberal scum won't sink below, is there? There isn't a case against Flynn, but there will be embarrassing info released exposing the Deep State. This is just prolonging removing any restraints on Flynn until after the election in hopes that Biden will win. My God, enough is enough.

It will end up at SCOTUS, where they will vote to lock Flynn up, Roberts will be the deciding vote. While Hillary, Obama, Brennan, Comey, Strzok, Page, et al, go free and make big bucks on TV. #twotieredjustice

RE: #1 - He changed lawyers to the magnificent Sidney Powell who successfully argued his previous lawyers had a conflict of interest, etc. She also fought for exculpatory evidence the DOJ hadn't handed over (which has been coming to her in dribs and drabs). They never made it to the sentencing phase before the DOJ dropped the case. Judge Sullivan refused to dismiss the case and here we are.

From court docs, on December 18, 2018, "Upon a motion of the defendant [Flynn] predicated on a desire to 'complete his cooperation' in the case of United States v. Bijan Rafiekian, No. 18-cr-457, in the U.S. District Court for the Eastern District of Virginia (“EDVA”), the Court continued his sentencing."
Further the memorandum notes: "The defendant [Flynn] noted that any remaining cooperation consisted of testifying at the Rafiekian trial, and requested that the Court continue the sentencing hearing."
Flynn was not just a bump on a log in all this falderol that wasted the time of a Federal Court over two years. He was a player, and had multiple counts that were set aside with his guilty plea to a single count of lying to the FBI. This is also part of the Sullivan play...DOJ maintains he still committed crimes. No one on either side has maintained Flynn is innocent of anything. So, what are DOJ's plans for these other charges that haven't been brought to trial? This case is full of twists and turns that politics forces some people to ignore its entirety. DOJ/AG Barr can always say that there were no crimes committed...they haven't done that, just that they can't prove their case with tainted evidence. What's going in here? Ask AG Barr why he hasn't simply declared Flynn's innocence.

For some reason...until after the election.... Sullivan has been delaying Flynn's sentence for years?????? The DC court system is the sewer. John Roberts is beyond corrupt. Can Trump pardon Flynn before the so called hearing?
