A federal appeals court ruled Friday that President Trump did not have the legal power to siphon money from the Pentagon to build his border wall, erecting another legal hurdle in the path of his most flamboyant campaign promise. The 2-1 ruling by the 9th U.S. Circuit Court of Appeals comes just two days after Mr. Trump visited the wall in Arizona, signing his name to a plaque marking 200 miles of construction during his term. In the new decision Judge Sidney R. Thomas, a Clinton appointee, said the wall is not a military project, so Mr. Trump couldn’t transfer $2.5 billion

Sure seems like a call for the DOD to make not some court. Does the court get to decide what operations are military?

So a Clinton judge gets to decide unilaterally what is and is not a military project?

Barack the Magnificent delivered a billion dollars in cash to Iran, and that was OK with the courts. Barring Donald Trump going full Andrew Jackson and ignoring the Supreme Court, we're likely headed for a complete national collapse, leading eventually to an iron-fisted leader who will restore order one way or the next; the only question is whose side will he take.

Ah yes, the Ninth Circuit -- the most reversed Circuit Court in America. Let's hope this goes to the Supreme Court and they reverse it. After all, most of the Justices uphold the US Constitution... I think.

Roberts can't wait to get his hands on this case, so he can demonstrate to the establishment how he's "grown in office".

Although Judge Thomas ascended by longevity to the chief justice slot in the 9th District, he is hardly a stellar jurist. His history is here:https://en.wikipedia.org/wiki/Sidney_R._Thomas
Considered for the Supreme Court by Obama, he was passed over for Kagan.
This decision was purely political. No real thinking, no desire to protect our country, went into it.

FTA:
It’s not immediately clear what effect the ruling will have. The Supreme Court last year ruled Mr. Trump could continue spending the money on the wall while the court battles were proceeding.
Indeed, construction has continued even during the coronavirus pandemic, with the Army Corps of Engineers and Customs and Border Protection completing about five miles per week over the past few months.

Two Clinton judges against Trump, one Trump judge for Trump, sounds right on target for the completely politicized ultra liberal 9th Circuit Court in San Francisco. Clearly an effective borderline barrier like the one being built along the Southwest border is a national defensive structure to keep unwanted intrusions from a foreign country into the USA. Such intrusions could be either non-military, military, or terror related these days. No doubt the US Supreme Court will be hearing another government appeal out of the 9th Circuit Court.

The Wall is as important a military project as we have in this country today. No higher priority.
The court is full of beans, totally wrong.

Defund the Circuit Courts. They're just "legislative super committees" and replicate/create legislation like party politicians of the party that installed them.

We voted for Trump to build the wall. We didn't vote for foreign aid to go to Palestine, or to pay for the healthcare of illegal immigrants or to study fish on treadmills and we sure as hell didn't vote to pay for the rebuilding of democrat cities democrat mayors let their constituents burn down in order to point out how much more virtuous people they are than us.
Now build the wall!

I think the proper response to this court is to just ignore the ruling and see what the court can do. Perhaps call out their troops?

What right does this judge have to determine whether a project is “military” when the name of the department is Department of Defense, not Department of the Military.
The wall is part of our defense, as walls have been since the beginning of time. Judge Thomas is far outside his authority, a political being rather than a solid American.

Another leftist decision that harms the nation. This will go to the Supreme Court where it will be found the Commander in Chief has the right to move money to stop threats to the USA, that his job. Communist judges or one world organization supporters need to be removed rom the judicial bench.

Trump is going to build the wall, and it is going to be paid for, and the courts are going to do nothing about it, because Trump is head of the executive branch, and is not going to stop himself. Have a nice day!

Defending our nation's borders from a foreign threat is "not a military project?" Uh, Judge "Clinton," the country's Commander in Chief says it's a military project. What project are you working on?
