Fox News contributor Donna Brazile sent co-hosts of “The Five” into a fit of laughter over her take on the First Amendment.The former Democratic National Committee Chairwoman left the panel momentarily speechless after she declared that “there’s no First Amendment right to lie” during a discussion on the battle between President Trump and Twitter. (Video) “This whole fact-checking thing is designed as a way to tackle misinformation which would be good if there was a balance,” Greg Gutfeld noted in the discussion after President Trump blasted the platform this week for adding a fact-check label to his tweets about mail-in voting.“

She is flat-out wrong - the Stolen Valor Supreme Court decision expressly stated that lying is protected Constitutionally. The opinion is interesting. By the time I completed it I concluded the court was right.

Donna Briazile has no business on Fox News and The Five. When she arrives I leave. I don't watch most shows as it is, maybe Fox and Friends or Fox Business in the morning but then I won't watch again until The Five comes on. Sometimes I wish I hadn't watched that show as well. When Donna is on, I can't stomach it! Shame of Fox for paying a Cheater to be on their shows!

Uh, yeah, actually, you ignorant airhead, you have the First Amendment RIGHT to say ANYTHING YOU WANT TO SAY. Leftists CANNOT put limits on free speech, no matter how much they hate losing the arguments - and no matter how often they claim that views different from theirs are "lies". IMO, 90%, at least, of what Brazile says on a daily basis is a lie.

She is partially correct. The First Amendment will not protect you from civil liability for defamation and fraud, and it will not protect you from lying to the FBI or lying under oath (perjury). And if you tell your wife you were out with the guys and you were really seeing Lulu, you will need more than the First Amendment to protect your sorry hide.

I am glad to see her on the Five (occasionally). I fast forward through her segment because I know what she says will be stupid but since she is there to represent the Dim perspective I am glad she is the one doing it because anyone who watches can easily see how stupid the point she tries to make.

I'm gonna catch grief for seemingly defending Brazille, but she is right in a limited sense. That is in the law of slander and defamation. However, that is a different context from that which she made her statement. In that context she is completely wrong.

#28, the Supreme Court has put limits on suits for defamation based on the 1st Amendment. To sue a public figure, the plaintiff has to prove knowledge of falsity or reckless disregard for the truth. One SC justice--I think it was Hugo Black--dissented from rulings in defamation cases arguing that the 1st amendment was absolute and that defamation suits are unconstitutional. That didn't carry the day, but sometimes minority views end up becoming majority.

Donna Brazile. One of the reasons I watch Fox less and less. When she is on, I switch the station. I would rather watch a commercial than watch this admitted liar. Am watching Newsmax more often.

I guess it's a definitional issue. If a Republican says something, it's a lie. If a Democrat says anything, it's the truth. Just ask Adam Schiff. Or Donna Brazile.

Yes, #32! She used the holy name of Jesus Christ as an expletive when addressing Jessie. I was shocked because this is not generally accepted on shows nor should it be. Then in the next segment she declared herself a Christian woman. Sorry, Donna, but real Christians do not use the name of our Lord as an expletive. I haven’t watched the show in awhile, and when I turned it on and saw her, I was instantly on edge. Juan is bad enough, but she is anathema. Also, she told Jessie he was a whiner. Dems are the biggest whiners of all time, that is all they do, 24/7.

FIRST AMENDMENT: "Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances."
Technically, she is correct. The First Amendment does not guarantee Americans the right to speak a lie or, for that matter, the right to speak the truth. It only mandates that no law be made to limit or curtail (thereby punishing) free speech.
Gods' moral law working through our conscience should govern the content of all speech because one day, God will hold all of us accountable for everything done and said during our life on earth. Politicians who acknowledge no moral law (other than their own agenda) and no accountability to God feel free to lie. Politicians who acknowledge their accountability and try to live within Gods' moral law are less inclined to do so. In both cases, their rise to political power is a reflection of the values of the people who vote for them.
