A father who was left quadriplegic after snapping his neck in a horrific surfing accident is facing deportation - and could be forced to leave his young daughter behind. Damion Miller, 35, was at Newport Beach in Sydney's north for a surf on February 21 when he dived over a wave and broke the C3 and C4 discs in his neck and severed his spine. The freak accident left the father-of-one paralysed from the neck down and confined to a wheelchair. Mr Miller, who has been in Australia since he was a teenager, met his partner Celeste and worked six-days a week, paid his taxes and took out a mortgage

While I am sympathetic and agree that it would be nice if he could stay; I do need to ask, why didn't he become a citizen if he has been there for 20 years and had a child there?

Well if he is deported from Australia to New Zealand, as a citizen of New Zealand you would think that he has a legal way to bring his immediate family with him? The rub is probably the cost, and the future cost of his healthcare by any measure will be huge and what country’s national healthcare system is going to pay. Also since he is 100% disabled one of those two governments are also going to have defray his lifetime living expenses. Obviously Australia believes that since the prospective deportee is a citizen of New Zealand that it should be New Zealand that pays.

One thing Australia doesn't need are any more illegals from China or neighboring islands, dropped off by boat along the northwestern shore. And the white dislike of these minorities is on the surface for all to see. They really, really don't like their invasion either.

Why doesn’t he marry the mother of his child? Why during the 20 years didn’t he file for residency? Won’t NZ care for him? Can’t his family join him in NZ? It sounds like he and his partner want to have their cake and eat it too rather than making some hard decisions. And of course the DM offers a lurid Penny Dreadful of a story to manipulate Australians into helping the poor man stay. Of course the DM will have them pay for it, too.

This is ultra sad but if it was the US and the guy was from Mexico we know what our answer would be and like situations should be treated alike. The Australian government is infinitely tougher on immigration matters than ours is, so what would happen in a situation like this was clear from the get go. You end up liking the people but as everyone here says, why didn't they do this or that? If we are to adhere to the principles we believe for this country with Central America I don't see a choice but to defer to the judgment of the Australian government here.

if he married baby mama, wouldn’t he be a citizen ? like 5 years ago .or is she too getting welfare for being single parent ,another racket .He is soo cute about “wanting to be a good Dad and to teach the kid right from wrong ...welp he is goofy foot on that score about 5 years late.

This is the precedent that will create a wave of unwanted immigration. Although I sympathize with his plight, one must ask: how would he be handled if he were in perfect health?
Is a tragic accident an excuse to change immigration law? If I trip in Mexico do I get citizenship? Or knock up someone in Japan? Of course not.

He came to Australia at 15 and stayed for 20 years, ....illegally. He impregnated his partner but the marriage was an inconvenience. Now he's paralyzed, he wants to be close to his daughter, needs his partner to care for him, and wants government disability benefits. ......suck it up Johnny! You shouldn't have gone SURFING that day!!!

There are all sorts of rapists and murderers in prison that were otherwise "really nice guys".
But you don't hear anyone saying they shouldn't be punished for breaking the law just because they were otherwise good guys.
This guy was a criminal. That is all that matters in the eyes of the law. And I sure can'[t imagine that being deported to New Zealand would be horrible at all.
