Several days ago we anticipated a potentially important point we hoped would start the impeachment defense for President Donald Trump. Today, attorney Patrick Philbin delivered. The issue is a critical constitutional component that needed emphasis, and it is good to see pundits finally starting to realize the significance.
White House Counsel Patrick Philbin explains why House subpoenas were illegitimate: the subpoena power was never authorized; the initiating subpoena power was never voted on.

The House motive here, the forethought within their design, is very important now because it explains why they are vociferously demanding witnesses in the Senate. The House plan was to work around the ability of the executive branch to go to court. The managers are now attempting to execute that plan, along with a manufactured political talking point, in the Senate trial.
The House intended for this to unfold exactly as it is happening.
Sounds like more Lawfare stratageizing to me… They have steered this impeachment as they steered other fiascos like the Kavanaugh hearing...

The Democrat corrupt strategy, deception and lies have been exposed.
Although that is important, it is not enough. Guilty Democrats must be held accountable and penalized so this does not happen again.

Understand this..."to create a public impression." The intent of the "impeachment inquiry" was never to reach this far, to ever send articles to the Senate for trial. The political concept was that the threat of "impeachment" and the daily poundings duly presented by their sycophant media would drove PDT's approval numbers down below 40 and allow a GOPe/UNIPARTY primary challenge, if not to deny re-nomination, to at least trash PDT's behavior, sow convention chaos, irritate the public, and ultimately disrupt the November campaign to the point of defeat.
All this is legal mumbo-jumbo going nowhere. Who is going to appeal to whom? The courts have no standing in this. There is already a trial, legitimizing the path taken by the House, and that trial will reach its denouement with a Senate acquittal.
And then it's on to the next act of this saga...

IF... the House remains Democratic and Trump is re-elected, what's to prevent the House from authorizing a legit impeachment proceeding accusing Trump of the same so-called crimes? Can a re-elected President be impeached for his crimes that were alleged during his previous administration?

The Democrats are proving once again, that they have no interest in a government of the People, for the People. Obama claimed the rot was in America from the beginning, and I agree. The rot IS the Democrat Party. That rot is accessory to most of the rot in the modern world. Slavery in America. the Civil War. The KKK and Jim Crow. Their support of Communism and Nazism. Their constant divisiveness in their quest for power. The blood of millions stains their hands. Jews, Blacks, the unborn...

I doubt they will pay for this Coup to take down a sitting president. If you talk to any Democrat, they are foaming at the mouth at the idea that they think they finally have Trump where they want him...about to quit! They watch THEIR stations (CNN and MSNBC) and all they hear is Juan Williams saying "yes, Trump should be removed from office and here's why........! Any Guest they have on is going after Trump. I have family members who constantly post articles about Trump (from Snopes) that are not true and they believe every word. We will never, ever convince them that Trump is good for our country. Never! Shiff will be a hero and we, the Republicans who love Trump are evil! Go figure!

Schiff said Dershowitz wasn't a reputable constitutional scholar yet this is all Dershowitz has been saying for months. This has Dershowitz written all over it. I would love to see this legal presentation put forth in terms that all Democrats elected to the Senate could almost understand. Its a strech to think a Democrat could understand law when 'fairness' is all they understand.

A critical element. Many had forgotten (if they ever noticed) that Pelosi had to finesse past a House vote to open a formal impeachment process into a Nancy-authorized “impeachment inquiry”. Without the House’s authority, the Judicial Committee could not issue subpoenas. Instead both Schiff’s and Nadler’s committees put out letter requests for appearances or evidence. They had no teeth so could be safely ignored. All the saber-rattling about subpoenas that were not complied with was just that. Bogus. Or as Joe would say, “Malarkey”….
