As 21 different state attorneys general noted earlier today, there are several reasons why the impeachment effort is unconstitutional. These are not process arguments; they are factual arguments central to the constitutional framework of our government.
The failure of a full House vote to authorize the House Judiciary Committee to pursue evidence -via enforceable subpoenas- was a defect by design of Nancy Pelosi’s decision to initiate an impeachment inquiry by her decree, not an authorizing vote. I thought about this yesterday when Schiffless was ranting about subpoenas. They had no subpoena power because they were engaged in Pelosi’s “impeachment inquiry” with no authorizing vote. What they referred to as “subpoenas” were letters, requesting appearance or evidence, and apparently threatening subpoenas if the recipient(s) did not comply. But they had no power to get regular court-issued subpoenas.

This article thoroughly explains this underlying and major defect in the House’s case. Subpoenas must be court-issued to be enforced, and enforcement is something the House cannot do. So they send letter requests.
Nancy Pelosi did not have the vote or political capital to start by initiating a full House impeachment authorization. Pelosi, Schiff, Engel and Cummings had to rely on the duplicity of the media to help them hide their scheme; and the media complied.
Speaker Pelosi & Lawfare’s impeachment scheme could only succeed with a compliant media protecting it. The media was entirely compliant in not explaining the fraudulent basis for the construct.
If the media would have ever asked questions the fraud would have collapsed.
Adam Schiff had to hide his hearings because the foundation of the impeachment fraud was to create a public impression. There was no structural impeachment process or guideline being followed. The committee leadership used the closed door hearings to leak information to the media to create a needed narrative.
A legislative “letter” or demand request needed to carry judicial enforcement authority –A PENALTY– in order to be a “subpoena”.

America deserves better than this.
The Dems knew Trump would be the one to beat in 2016, no matter what they say. They were positive that Hillary could coast into the White House on Obama's coat tails, and they were shocked when she lost. But, as further proof that the Dems knew Trump would be hard to beat, Obama had already put in place a mechanism of deeply rooted Dem partisans who's purpose was to thwart Trump's every move. They bought foreign intelligence from Christopher Steele and used it to obtain illegal FISA warrants against Carter Page. They leaked info to the press, Shiff lied nonstop about "proof" he had (but never disclosed). then the Mueller Monstrosity, now this sham impeachment. All this is nothing but a series of treasonous acts. Yes, this is what TREASON looks like in 2016-2020. The Dems must be punished for this.

If this was going down in a court of law, the petition would have been dismissed outright with the prosecutors facing legal action.

I liked the comment at the Treehouse about the media being like the Jim Jones followers. The ''Jim Jones democrat media cult'' is literally killing itself. Shedding subscribers and viewers, as they obey their cult leaders, can only end badly.

The Constitution does not specify any impeachment process - none. The House is the sole Constitutional impeachment authority, which means it makes the rules for impeachment. Not the Executive, SCOTUS or the Senate. (Remember, impeachment is simply the accusation of malfeasance.)
The Senate has the sole power of trying the impeachment accusation based on the articles sent it by the House. The Constitution does not specify trial procedures. The Senate can do what it will, including dismiss.
Funny thing is that this cadre of 21 state attorneys general is no less partisan than the House majority. Hard to argue partisanship drives impeachment, which it certainly does, from a partisan point of view. Even Adam Schiff claims the law is in his favor.

Trump attorney Philbin was very clear. The impeachment process was never authorized by a House vote. Instead, it was decreed by Crazy Nancy. That fact alone should end the trial in the Senate. So, why hasn't the House case for impeachment been summarily dismissed by the Senate?

I am no lawyer ,but it seems that real lawyers say this impeachment is unlawful.
If indeed it is unlawful then the claim of treason is even more powerful, more evident.
For indeed an attempt to illegally remove a legally elected and sworn in at an Inauguration , President --is Treason.

i listened to Mark Levin last nite on his radio show and he was so great! Because he is a constitutional scholar he was explaining how radical progressives are turning everything upside down in this country, especially noticeable in the impeachment process. I am not smart enough to follow all his arguments, but all of us are becoming aware that so many things that were a given in our culture are being stealthily and no so stealthily taken away from us. (I mean, men dressed up as women, with make up on, are reading books to toddlers in our public libraries, and we are supposed to be tolerant about the practice.) Normal is out; not normal is in.
