Try Again: Federal Court Dismisses Comey
And James Indictments

If we are living in an age of lawfare, this is fast becoming a war of attrition. The dismissal of the indictment of James Comey and Letitia James is the latest twist in the controversial prosecutions of Trump antagonists. Letitia James immediately posted her own message celebrating the decision, but she may want to focus on the prepositional phrase after the word dismissal: without prejudice. The Administration may still be able to resuscitate the case.

Comments:

Hopefully DOJ will challenge 28 USC 546's unconstitutional grant of authority to District Courts to appoint Interim US Attorneys. This allows Democrat members of the Senate Judiciary Committee to indefinitely block Administration appointments, secure in the knowledge that resistance judges will appoint a resistance Interim US Attorney after 120 days have elapsed.

I blame the GOP Congress for this. They have diddled the year away, and have not gotten Trump's US Attorney's appointed, his judges, or other nominees, having done nothing since before July 4th. Bondi has to take make shift measures to get an attorney to prosecute a case.

The footage was identified by Chairman Barry Loudermilk, R-Ga., and his House judiciary subcommittee, which is investigating the security failures and the unanswered questions of Jan. 6.

Democratic presidential nominee Hillary Clinton's dismissive description of half the country as a "basket of deplorables" may have cost her the 2016 election. Now the National Education Association's use of "villains," in handouts for an upcoming "Advancing LGBTQ+ Justice and Transgender Advocacy" training, may fuel bicameral efforts to remove its 119-year-old congressional charter.

House Oversight Committee Chairman James Comer is launching an investigation into Sixteen Thirty Fund's Chorus Creator Incubator Program, according to letters obtained by the Daily Caller. The Sixteen Thirty Fund -- whose donors include nonprofits tied to George Soros -- is a nonprofit that has been accused of trying to sidestep campaign-finance disclosure rules enforced by the Federal Election Commission (FEC) and Justice Department. It also bypasses standard media-ethics practices meant to differentiate real journalism from paid political work that must be disclosed, according to Comer.

Interim U.S. Attorney Lindsey Halligan is defending her handling of the grand jury proceedings, which resulted in two criminal charges against fired FBI Director James Comey, in the wake of critiques from a magistrate judge and probing questions Wednesday from the federal judge presiding over the case. Halligan . . . pushed back on multiple criticisms in Wednesday evening court filings, telling the judge that "the grand jury was provided the proposed indictment, deliberated, and determined probable cause existed to believe that the defendant had committed the crimes charged in two counts" and claiming that the magistrate judge had misrepresented her comments . . . .

We are all owed a better explanation from the FBI and Secret Service about the attempted assassination of Donald Trump 16 months ago at a campaign rally in Butler, Pa. The President himself remains unsatisfied with the answers he's been given about the circumstances leading to 20-year-old Thomas Crooks climbing on a rooftop with an AR-15 rifle and firing eight times at Trump, narrowly missing his head but hitting his head.

When a respected former prosecutor approached the Justice Department in 2018 with a witness who claimed he had evidence on Hunter Biden's alleged misdeeds, they discounted his offer and later subpoenaed his phone records. The incident is gaining new salience after recent revelations that DOJ special counsel Jack Smith cast a net of subpoenas for phone records of several GOP members of Congress and even obtained government phones that had belonged to President Donald Trump and his former vice president.

The Trump administration has so far remained silent on a widening corruption scandal inside Ukrainian President Volodymyr Zelenskyy's government and inner circle. The White House did not respond to a request for comment on a $100 million corruption probe announced this week that has already prompted the resignations of senior Ukrainian officials. Corruption has long been a friction point in U.S.-Ukraine relations.

It’s another day ending in “y,” so it’s another day when a federal judge jumps in to thwart the Trump administration. On Monday, Judge Cameron McGowan Currie tossed the cases against Former FBI Director James Comey and current New York Attorney General Letitia James, ruling that Attorney General Pam Bondi's appointment of Lindsey Halligan as interim U.S. attorney for the Eastern District of Virginia was invalid. The Department of Justice is almost certain to appeal the ruling. Meanwhile, the case was dismissed without prejudice, meaning the charges could still be refiled, although in the case of Comey, that may be in doubt given that the statute of limitations has since run.

Democrats are seeking to put limits on private donations to foot the bill for President Donald Trump's new White House ballroom amid what they say are bribery concerns. Trump announced in October that construction had started on the ballroom — leading to the demolition of the White House’s historic East Wing — and would be privately funded at an estimated cost of $300 million. That was up from the $200 million estimate first provided in July when the project was unveiled. But Democrats are concerned the donors — including individuals and other organizations — are footing the bill for the project because they are seeking

If appropriate, he could be recalled to active duty and courtmartialed. I assume that a number of cases have been decided under the UCMJ, that involve encouraging soldiers to disobey orders. In 2018, as California was laying the groundwork to build a new 911 system for the state, a massive fire ripped through Butte County, decimating several Northern California communities and killing over 80 people. The devastating Camp Fire, which wiped out cell towers and hampered emergency communication during critical hours, was on everyone’s minds as the California Governor’s Office of Emergency Services worked to design the state’s future emergency communication system. Between 2019 and 2025, California paid four technology companies over $450 million to build out its Next Generation 911 system, But when the time came to turn that system on, it didn’t work.

As a three-time Trump voter with no regrets, I don’t like this message any more than most of you. So don’t shoot me, I’m just the messenger. The message is the Republicans in next fall’s midterm elections will lose the House, bigly, and probably the Senate. If politics is indeed “war by other means,” expect the political war next fall to be bloody. Think Battle of the Little Bighorn. Think Stalingrad. Think Pickett’s Charge. Think the Battle of Midway. Think Waterloo. It will be one-sided. Oh, I know the President has done some terrific things – at great personal risk to himself, by the way – even if they were sometimes done unartfully.

House Oversight Committee Chairman James Comer is laying down the law for Bill and Hillary Clinton: show up in person for depositions in the Jeffrey Epstein sex trafficking investigation, or face prison. Comer warned the former president and his twice-failed presidential candidate wife that dodging these subpoenas with written answers will not cut it—it's a clear no-go, and could invite contempt of Congress charges. Originally subpoenaed in August, the Clintons asked their lawyer to request that the committee accept written statements rather than require them to sit for live depositions. Their attorney, David Kendall, claimed that written answers would be the “most efficient and equitable” approach. Comer shot that down.
