The current status of the New York civil fraud case that New York Attorney Letitia James filed against Donald Trump, and that resulted in a huge ruling against him, thanks to Judge Arthur Engoron, is just a little bit of a puzzle. In the short term, Trump is on defense, but the wheels of justice should turn and place him on offense. Understanding that requires us to look at the logic of the law, a subject at once fascinating and exacting and, sometimes, very surprising. The role of logic in law is one of the features of the law that most non-lawyers misunderstand.

Comments:

An interesting discussion of the basics of law. This non-lawyer who has followed Supreme Court cases for decades, and tried to understand how things work found this fascinating.
BUT let's hope and pray that somewhere along the line, Trump and America can get back to ACTUAL law, not the corrupt ThugLaw that the corrupt NY judges and crooked prosecuotrs proclaim for political purpose. Judge Engoron should be impeached and jailed for his obviously criminal behavior. Lucricia James should be disbarred and jailed for her criminal behavior.

It is interesting to note that the basics of the law were not followed, which should cause the first appellate court that hears this to overturn it immediately. FTA: "Under New York law, an essential element of a cause of action for civil fraud—that is, one of the things the plaintiff must prove by a preponderance of evidence—is that the defendant’s false statement or concealment of material fact resulted in harm to the plaintiff (or, in Trump’s case, the State of New York, which acted as the lenders’ proxy). But as every netizen by this time knows, Trump’s evaluation of his own property harmed no one." The "victims of fraud" - the banks, said that they were not defrauded and were happy with the deal, and would gladly do business with Trump again. NO harm was done. The case has ZERO BASIS in law.

An excellent article. The elements of malicious prosecution set forth in the article ought to have the entire Thug Society of the New York Bar quaking in their boots. The most difficult to prove element- “The defendant filed or pursued the underlying case for an improper purpose or abusive purpose, such as a desire to ruin the plaintiff’s reputation.”- has been admitted to by LaTetseFly James. The only thing standing between a successful malicious prosecution action by Trump is the reversal of the trial court on appeal. It would take a member in good standing of the Thug Society to uphold it; pettit members might want to merely reduce it, but then they are outed if the higher court reverses it. Judge Engorged has set up quite a row of dominos.

While James and Engeron are patently guilty of malicious prosecution and judicial malfeasance, they don't care. Their goal was to slow down the MAGA train and influence lo-info voters who think an accusation is equal to a conviction. Sadly there are way too damn many of those especially in blue states.

Interesting take but leaves out the most important role of logic in Law. The people believe in the law and fair application of the law. Thus far, from Sandy Berger, Hitlery Clinton and Diaper Joe, there is a beyond a reasonable doubt of fair application of the law. From NYC and Latsitsa James to Atlanta GA's Fannys Willis and the uber corrupt 'application of logic of Law by Engeron and Scott McAfee, there is beyond a reasonable doubt of the fair application of the Law. The article assumes an appalls court will magically follow the law but to date, there is no evidence to support that assumption. The Appalls Court upholds the reduced fine as does the Supreme Joke of NY. We no longer have a rule of law. We have a Rule of Just-US!

Except for the fact that Logic has been banned by 'the powers that be'. Not only is logic frowned and ridiculed by the loudest voices of modern society, the government actively prosecutes it if you try to use it against them.

For now, lawfare is doing pretty well in their quest. I haven't seen any judges do much to tell these legal despots to get the h*** out of the courtroom and not to come back again with this slop.

I don't have anything but common sense, but my common sense tells me that the whole case was BS and that the monetary fine was absolutely and totally insane, and James and Engoron should be removed from the practice of law.

Many decades ago my four year old daughter was invited to play at a neighbor's house with another little girl while visiting her grandparents in an upper middle class neighborhood. While there, she was attacked and knocked down by the neighbor's Doberman that went for her throat while she on the ground. Thankfully the bite occurred under her arm pit as she instinctively raised her arm to protect herself. The dog clamped down and shook her like a rag doll. Fortunately the owner's teenage son was there and got the dog off my daughter.

The prosecutors and judges in New York are utterly unhinged, an overly-obvious reality evidenced by the onslaught of lawfare against President Trump (in an election year no less) emanating from the state; but it’s not just Alvin Bragg, Arthur Engoron, and Letitia “Peekaboo” James using their offices and the courts to wage persecutory campaigns of political vendettas against those who don’t toe the establishment line, but Brooklyn District Attorney Eric Gonzalez and Judge Abena Darkeh, too. Aside from Mr. Trump, a bright and accomplished man named Dexter Taylor might be the second-most unfairly persecuted person currently fighting off bogus charges in the “justice” system. So what did Taylor do?

A recent video shows a disabled girl confined to a wheelchair being bullied at her middle school. She’s taunted, struck, and tossed around. Those watching and videotaping giggle hysterically. It’s horrible. It also shows sociopathic behavior that is increasingly normalized in America, especially among blacks. This isn’t because blacks are inherently sociopaths. It’s because the Democrat party has deliberately stolen from them the societal institutions that create decency. Note: I am not saying that blacks are inherently criminal, sociopathic, stupid, or whatever other words a Democrat would put into my mouth. To say so—to say that negative traits, values, and behaviors are tied to skin color—would be deeply evil and racist.

Even the subheadlines are substandard at the Washington Post. In “Gazans go hungry as aid groups step back” (04/04/24), the subheadline reads, “Israel’s war has wrecked Hamas civilian rule, with no alternative in place.” The anti-Israel bias at the Post is as clear as the clearest day. It is not “Israel’s war.” To say so exposes the authors’ animus against Israel, ignoring how this war started and who the perpetrators were. To remind The Washington Post, on October 7, thousands of Hamas combatants followed by Gazan civilians stormed through the borders of Israel, murdering; mutilating civilians, including children and babies; and taking hundreds of hostages, including babies.

There are some people who aren't articulate despite possessing the knowledge. There are others who are adept wordsmiths but possess no knowledge. Most overcome either of these shortcomings by burning their midnight oil. There are a rare kind who are not only inarticulate and ignorant but are too lazy to apply themselves even minimally. Then there is Kamala Harris. She is not only nation's primary world salad chef but the leader of the league of ignoramuses. And that's not all, she also has no self-awareness and probably thinks of herself as abundantly talented. This rules out the possibility of any remedial measures. Crews opened a second temporary channel on Tuesday allowing a limited amount of marine traffic to bypass the wreckage of Baltimore's collapsed Francis Scott Key Bridge, which had blocked the vital port's main shipping channel since its destruction one week ago. Work is ongoing to open a third channel that will allow larger vessels to pass through the bottleneck, officials announced at a news conference Tuesday afternoon. Four Florida teenagers have been killed after they were involved in a police chase in which officers used a maneuver designed to get a car to stop, but caused them to spin out of control. The four, who were between the ages of 14 and 16, attended Newberry High School in Bradford County, northeast of Gainesville. Terry Clark Hughes Jr. is the 39-year-old suspect who opened fire at the scene where four law enforcement officers in Charlotte, North Carolina, were shot and killed on April 29, according to Charlotte-Mecklenburg police. Hughes was not the only shooter, Charlotte-Mecklenburg Police Chief Johnny Jennings said in a news conference. “When they approached Hughes,” officers “were met by gunfire and returned the gunfire, striking” Hughes, who was found deceased in a yard, Jennings said.
