The defense in the murder trial of Kyle Rittenhouse in Kenosha, Wisconsin, moved Wednesday afternoon for a mistrial based on the prosecution’s violations of the defendant’s rights and the judge’s previous rulings about admissible evidence.Defense attorney Corey Chirafisi asked Judge Bruce Schroeder to declare a mistrial “with prejudice,” which would prevent prosecutors from bringing the charges again. That provision, Chirafisi claimed, was necessary to prevent prosecutors from deliberately ruining their own case to get “another kick at the cat.” He said that prosecutors, led by Assistant District Attorney Thomas Binger, had acted in “bad faith” —

I'm not a lawyer and I didn't stay in a Holiday Inn Express last night, BUT, as bad as the prosecution did in this case, WHY WOULD THE DEFENSE put the Defendant on the Stand. Yeah, I know he has the right to do it, but the reason you hire attorneys is to have them tell you what you need to do to win in court.
Or as a lawyer friend of mine told me, he has become very wealthy on clients failing to heed his advice.

Might be better to let the jury acquit him or convict and have the verdict overturned on appeal. If he gets a mistrial, the prosecution might learn from its mistakes and present a better case at a new trial?

Thomas BInger, the prosecutor, was annoying and manipulative.
He repeatedly made statements as if he were a mind reader, presuming to TELL Kyle Rittenhouse (and the jury) what Rittenhouse was thinking when under attack. Repeatedly, Binger was called out by the judge or Rittenhouse's attorneys for putting the defendant in the position of speculating.

A guilty verdict will be reversed on appeal unless the appelate court judges are politiclly correct types appointd by Democrats. Unlike O.J. Simpson who was clearly guilty, this young man, Rittenhouse, is clearly innocent. The judge can do four things: nothing, dismiss the case with predjudice, direct a verdict of acquital, or if found guilty, reverse the jury findings, acquit the defendent and release him. A hung jury could be a reason. Rittenhouse even now has ample grounds for lawyer malpractice in a civil case. I waive my fee for this demurer because FJB has made me irate about current affairs.

The Prosecutors have lost their case so they are cheating. That's what Leftists do.
Prosecutor: "I did not interpret your ruling as an absolute. . . . " Yeah, you didn't think the law of the case applied to you. You're special. You're a Democrat.
What you don't hear in the Prosecutor's argument is any reference to the elements of proof for the charged offenses, how the testimony sought would prove or disprove those elements and the rules of evidence. In other words, his argument doesn't even talk about THE LAW. Because the entire attempt was to simply slime the Defendant in front of the jury with a lot of Leftist panty-wetting about guns.
Anybody out there licensed in Wisconsin -- please file a bar complaint against this guy now. Lets wrap up this wannabe Duke Lacrosse political prosecution and get the prosecutor charged and disbarred faster than last time. If you don't, it could be your kid up there next time.

As an arbitrator of 30 plus years, I heard the testimony of thousands of witnesses, and in my professional opinion, the defendant was an exceptionally good witness today, and I think his attorney was wise to put him on the stand.
The prosecutor, on the other hand, was just plain terrible.
This 18 year old child will be acquitted, either by the jury or by the judge, and then the little weasel Garland will try him on federal civil rights violations charges.charges.

This is one time that the jury absolutely needed to see and hear the defendant. He has been so slandered in the press and by politicians and creeps in the leftist activist groups. Kyle is a wonderfully humble, servant-spirited young man. His mother must be so very proud of him. His grief is real and it came across so visibly and emotionally. He has demonstrated skill and forbearance in the handling of his weapon. He will be a wonderful nurse. I pray for his safety and wish him the very best.

I watched this poor kid kicked around by the government and the fake media... I was thrilled to watch the judge call the defense team out in court...so...there is justice sometime...I hope he gets his mistrial with prejudice...so this poor kid can have his life back...free from the social media toadies that have caused him so much stress and in my opinion...a miscarriage of justice...

Mistrial! Rittenhouse does not deserve to sit in jail one day. Finding him guilty would get Rittenhouse an appeal like the judge said the prosecution can "kick the cat one more time". Stop it now. This is a case of more time in courts and money spent for nothing. At least the judge is stern or should I say knows the law and the tactics of the prosecution that are failing. The DA made Rittenhouse's case for self-defense and innocents. Set Rittenhouse free. FJB

Kyle Rittenhouse is probably the youngest red blooded Patriot we have in our day. Kyle WILL live through this battle. Some young men may wonder if standing up for your beliefs is worth the effort. Kyle surely will. The furnace of adversity strengthens godly men as the forge does to iron.

With all the video available the DA knew from the start Rittenhouse was protecting himself. Why put this 17 year old in jail, solitary confinement within hours of the riot? What is it with these demonrats putting the Right or Trump supporters in solitary confinement...from Trump's Campaign Manager, to the J6 Trump supporters without bail? These Leftist/democrats/Socialists/Marxists love to punish their opposition by solitary confinement/ jailing them. Sure sounds like what the Nazis did in the 1930s with the Jews and what the Soviet Commies did too with the dissents they put in gulags.
Where is our Justice System? The scales of Justice are not equal today and no one is trying to balance them. This cannot stand.

Every defendant has the right to have their voice heard in open court. There are a number of very good reasons the kid testified in open court. I think the defense rolled the dice very well. Now it remains to be seen if the judge agrees. I hope so. The kid made a fool out of the prosecution too. As to the breaking down on the stand while reliving the traumatic event, I think that is normal behavior for anyone who has shot somebody in self defense, and combine that with the stress the kid has been under the past months in trial prep, and there you go.
Kyle Rittenhouse is a better man after that night than the prosecution team ever will be.

Kyle makes an excellent witness. He comes across as earnest, honest, free of guile, and incapable of forming the mens rea or intent to commit any serious crime, let alone murder. He is a stunning contrast to the prosecuting attorneys, and any sane jury will surely to notice it. If he seems baffled by some of the prosecution's questions, they're the ones looking sinister and conniving, not Kyle.
Binger doesn't care whether Kyle is guilty or innocent, or how much he has unjustly suffered or may suffer in the future. Binger's singular, cold-blooded objective is to get a trial court conviction to keep the antifa and BLM thugs from pillaging and burning Kenosha to the ground.

Well stated, #19. And I might add that some people cry when they are extremely angry or frustrated. Sometimes that anger cannot be released any other way and this would certainly be an example of it. Just try to imagine how much anger Kyle feels.
