The $250 million lawsuit filed by Nick Sandmann against the Washington Post has been dismissed by a federal judge. William Bertelsman, who heard oral arguments in the case earlier this month, issued the ruling Friday. Nick and his attorneys, Todd McMurtry and L. Lin Wood, alleged that the gist of The Washington Post's first article conveyed that Nick had assaulted or physically intimidated Nathan Phillips, engaged in racist conduct, and engaged in taunts. But, Bertelsman wrote, "this is not supported by the plain language in the article, which states none of these things." As an arbitrator, I have suffered at the hands of newspaper editorialists. In one case, I was accused of destroying black/white relations in a particular city in another state. (a police officer, on special duty in a drug infested area, pursued, stopped, and searched a black gentleman who had tried to flee from in front of a crack house.) I was offered a police dash cam video of the search, and there was no illegal/unconstitutional search - just a Terry search (Terry v. Ohio, USSC decision that granted police officers the right to conduct a limited search of a detained individual for the officer's personal safety.) The city government paid the black gentleman for an unconstitutional search, suspended, without pay, the police officer who did the search, and I reinstated him with full back pay. There was nothing I could do against the newspaper, because their comments represented an opinion. I didn't even try, except to send a note to the newspaper, offering to explain the incident, if the parties gave me permission. (The parties in an arbitration case own the award - I don't.) I never heard from the newspaper.

So a purveyor of "news" can pass off someone's opinion and present them as fact? Aren't facts what news is all about, at least in theory? How is one person's opinion a hate crime, others' opinions truth? It's becoming clear that not only is common sense a relic of the past but, in our brave new world, unduly judgemental and a crime in and of itself.

I notice that this USA Today story does not address any of the legal issues raised by the lawsuit, but does repeat all of the WAPO disinformation that the Carter judge claims was "opinion" protected by the 1st Amendment. The appellate court will reverse this ruling, but it won't stop the liberal media from continuing to pretend that the fabricated story was legitimate.

Was WaPo's alleged libel in print or online? The latter can be harder to prove, without an authenticated snapshot of it, since online articles are updated and amended regularly to elude such criticism.

A survey released today shows that 40% of American adults believe in creationism, that "God created them in their present form within roughly the past 10,000 years," reported Gallup. I'm mortified. I just took the 15-question multiple-choice quiz on religious knowledge that Pew included in its new survey of Americans' religious knowledge...and I got one of them wrong. Which one, you're asking? It was: "Which of the following is one of Buddhism's four 'noble truths'?" I chose "the truth that every living being has an immortal soul" instead of "the truth of suffering." OK, so I got 14 of them right, and when I look at the full 32-question survey, I figure I'd score a 31. But I teach religion, for crying out loud, and I fit into all the right categories besides.
