The Supreme Court ruled Friday that an illegal immigrant who had a gun—a crime—can’t be prosecuted if he didn’t know he was in the country illegally.
In a 7-2 decision the justices said in a crime where the status of a person is the “crucial element” to the offense, the government must prove the person was aware of that. Otherwise, it might just be an innocent mistake. That could affect “thousands” of previous convictions. “Without knowledge of that status, the defendant may well lack the intent needed to make his behavior wrongful. What on earth are they thinking? It isn’t enough that we’re being overrun with illegals from all over the world…. Now they can carry arms and use them and conveniently forget that they are here illegally. They know damn well whether they are legal or not…
That the Supremes would walk into this trap is utterly amazing to me...

(I am furious!) So they are allowed to be here illegally and say they didn’t know that? That they were not familiar with the law? Is that how that alien lowlife got off after killing Kate Steinle in cold blood on a San Francisco sidewalk?
Send them back. Immediately. Don’t keep them around long enough for them to plead confusion.

The ignorance and lack of common sense of our Supreme Court justices just amazes me. The justices, starting with Roberts can come up with the most convoluted reasoning that I have ever seen. And, if you think it is bad now, just wait until Millenials start being appointed to the Court.

So the American citizen gets prosecuted and jailed but the illegals are now free to roam the streets with guns.

I’ve always been under the impression ‘ignorance of the law’ is no excuse. So now I can run red lights, not pay taxes, skip jury duty, not have car insurance etc. thanks SC for the ruling.

Growing up I'd always heard ignorance of the law was no excuse. What happened to that? Under the equal protection clause then, just claim you're ignorant of the law and they have to let you go or be in violation, even if you're a citizen.

A bad decision. The long-standing alien registration laws require that all aliens in the USA be in possession of evidence of alien registration in the form of an alien registration card (green card) or an arrival/departure record card that evidence that both immigrants and nonimmigrant aliens are legally in the USA.
Any alien who is not in possession of alien registration documents and for who no record of a lawful presence in the USA is maintained by the federal immigration authorities is an illegal alien, and 99.999% of illegal aliens know that fact.

Alito and Thomas with the dissent. If you're a felon caught with a gun, just say you forgot you were a felon; a reasonable error. Caught in someone else's house? I had no idea. Voting illegally? Who knew? Sex attacks? It's OK in my home country; my bad. Could we instead simply deport illegal aliens with extreme prejudice?
