U.S. Supreme Court Justice Clarence Thomas has asked former President Donald Trump’s lawyers about whether they challenged special counsel Jack Smith’s authority to bring charges against the president. (snip)Justice Thomas asked John Sauer, the attorney who represented Trump in court, “Did you, in this litigation, challenge the appointment of special counsel?” Mr. Smith was appointed to the case by Attorney General Merrick Garland. Mr. Sauer said that Trump attorneys have not raised such concerns “directly” in the current case at the Supreme Court. However, “it points to a very important issue here, because one of [the prosecution’s] arguments is, of course, that we should have this presumption of regularity,” Sauer stated.

Number one should be the presumption of legality. Witch hunts ended sometime in the 1600s because every one accused was declared a witch and executed without a shred of proof. Sound familiar?

In many ways, these lawfare insurrectionists do so many unlawful things in their pursuit of Trump, it's hard for his lawyers to include every fault/misdeed of these cretins.

Trump's lawyers are good, but they are missing some good opportunities to get this case thrown out. I read somewhere that many top tier lawyers in NY were warned not to take him on as a client if they valued their careers.

Mark Levin has been talking about this angle for weeks. God Bless Clarence Thomas for brining it up. This will be the end of Jack Smith…and then the spotlight will turn on Biden who, then a Senator , tried to destroy Clarence Thomas during his Supreme Court confirmation hearings with the Anita Hill hoax. The schadenfreude here is amazing!

Filings: Jack Smith Tampered With Evidence
In Get-Trump Classified Documents Case

Special Counsel Jack Smith admitted federal prosecutors tampered with evidence in his criminal case alleging former President Donald Trump mishandled classified documents. According to a Friday court filing, prosecutors said documents the FBI seized from Trump’s Mar-a-Lago residence are no longer in the same order in which they found them, and some are mislabeled and may even be misplaced. A government “filter team” that dealt with the boxes once the FBI took them “was not focused on maintaining the sequence of documents within each box,” the special counsel’s office wrote in the filing.

A witness in former President Donald Trump’s New York “hush money” trial on Monday appeared to confirm his attorneys’ claims that payments at the center of the case were legal expenses and that he was not personally directed by the former president to make those payments. Former Trump Organization controller Jeffrey McConney testified Monday that payments that were sent to former attorney Michael Cohen were legal expenses, confirming defense attorneys’ arguments. “Michael Cohen was a lawyer?” Trump defense attorney Emil Bove asked Mr. McConney. “Sure, yes,” he replied.

In a normally functioning democracy (constitutional republic) the testimony today by Trump corporate comptroller Jeff McConney would end the ridiculous “hush money” case. McConney testified he alone was the one who instructed the accounting department to classify payments to Michael Cohen as “legal expenses.” This entire premise of the silly NY city case against Donald Trump is predicated on the claim candidate Trump had the payments classified as legal expenses to hide the hush money payment. If Trump didn’t determine the classification, the case should collapse. Alas, we all know what this Lawfare is really about.

A constitutional rights litigation firm has obtained internal emails revealing the Biden administration’s efforts to find ways around state bans on gender transition medical procedures. In February, American First Legal (AFL) filed a lawsuit against the U.S. Department of Health and Human Services (HHS) for its alleged refusal to comply with the Freedom of Information Act (FOIA) in handing over communications regarding HHS Assistant Secretary Rachel Levine and transgender clinics, according to the AFL’s press release. In March 2023, the AFL began its investigation into the HHS by filing a FOIA request after Mr. Levine publicly stated that the federal government—including President Joe Biden—supports medical transitioning of children.

You may have heard of the protests in Tbilisi, Georgia recently. The protests are framed around what the State Dept and CIA call “Russian favored” legislation. The Georgia legislation essentially says that domestic lobbyists, NGO’s, entities, groups and individuals who are funded more than 20% by foreign interests need to register as such. Essentially, the USA law we call the Foreign Agent Registration Act (FARA), is what the country of Georgia is enacting in their own political landscape. The pro-Palestinian, antisemitic protests on university campuses across the nation are funded by President Joe Biden’s own political donors — which could explain why he hesitates to condemn them and won’t investigate them. Biden equivocated last month when asked to react to the protests, saying that he condemned the antisemitism but also condemned those “who don’t understand what’s going on with the Palestinians,” which puzzled observers. Research by NGO Monitor and others into the donors behind the protests has turned up familiar names from the Democratic Party bankroll — including George Soros’ Open Society Foundations and other liberal philanthropies.
