U.S. Supreme Court Justice Clarence Thomas has asked former President Donald Trump’s lawyers about whether they challenged special counsel Jack Smith’s authority to bring charges against the president. (snip)Justice Thomas asked John Sauer, the attorney who represented Trump in court, “Did you, in this litigation, challenge the appointment of special counsel?” Mr. Smith was appointed to the case by Attorney General Merrick Garland. Mr. Sauer said that Trump attorneys have not raised such concerns “directly” in the current case at the Supreme Court. However, “it points to a very important issue here, because one of [the prosecution’s] arguments is, of course, that we should have this presumption of regularity,” Sauer stated.

Special Counsel Jack Smith admitted federal prosecutors tampered with evidence in his criminal case alleging former President Donald Trump mishandled classified documents.
According to a Friday court filing, prosecutors said documents the FBI seized from Trump’s Mar-a-Lago residence are no longer in the same order in which they found them, and some are mislabeled and may even be misplaced. A government “filter team” that dealt with the boxes once the FBI took them “was not focused on maintaining the sequence of documents within each box,” the special counsel’s office wrote in the filing.
A witness in former President Donald Trump’s New York “hush money” trial on Monday appeared to confirm his attorneys’ claims that payments at the center of the case were legal expenses and that he was not personally directed by the former president to make those payments.
Former Trump Organization controller Jeffrey McConney testified Monday that payments that were sent to former attorney Michael Cohen were legal expenses, confirming defense attorneys’ arguments.
“Michael Cohen was a lawyer?” Trump defense attorney Emil Bove asked Mr. McConney. “Sure, yes,” he replied.
In a normally functioning democracy (constitutional republic) the testimony today by Trump corporate comptroller Jeff McConney would end the ridiculous “hush money” case. McConney testified he alone was the one who instructed the accounting department to classify payments to Michael Cohen as “legal expenses.”
This entire premise of the silly NY city case against Donald Trump is predicated on the claim candidate Trump had the payments classified as legal expenses to hide the hush money payment. If Trump didn’t determine the classification, the case should collapse. Alas, we all know what this Lawfare is really about.
