The Supreme Court ruled Monday its prior ruling on race-based congressional districts takes immediate effect. The order {SEE HERE} speeds up the normal 32-day timeline and puts the State of Louisiana on notice their current districts are not constitutional. Effectively the Louisiana Governor and legislature have delayed the election to address the districts. However, Justice Ketanji Brown Jackson was not happy with the immediacy ruling and wrote a dissent that was so ridiculous none of the other minority justices would sign on to it. Jackson said the majority “unshackles itself” from “constraints.” The court should follow the default rule, she insisted.

What she's really having a hissy fit about is that she (to include Kagan and Sotomayor) were scheming to slow-walk the SCOTUS decision so the states would not have time to re-draw congressional districts prior to the mid terms. Now the SCOTUS decision to fast-track the ruling effectively shuts down their plan.

I would have thought that the political body that drafted this unconstitutional map would be the ones who would suffer the consequences of their action. It was on them to draft the map in accordance with the Constitution. They didn't. They caused problems for many by choosing to play politics. The Constitution did not ambush them. They clearly put party before all else with their obvious overreaching for the party's sake. Just because the consequences are a big problem, it doesn't excuse it. It would have been nice to have the CJ opine, I will note that the Supremes do play things a little loose from time to time. There was a case, Marathon Pipeline, early 80s, where the court held that the jurisdictional grant to the bankruptcy courts was unconstitutional because it was so broad that the BK judges needed to be Article 3 judges. But because the result of their decision was terrible, things could happen. The court decided to stay its decision for one year to give Congress time to fix it. It was a mess, and the BK courts tried to fix it by having the parties agree to be bound by any decision. It gave so much power to one side or the other to appeal any action as unconstitutional.

Is there a provision in our Constitution or its so-called, "Penumbra," whereby a Chief Justice, with concurring SCJ's, conduct a "no confidence" vote on another SCJ for removal? I would assume that since the Judicial Branch is its own separate and equal branch of government that it can develop whatever "rules" it would like, barring exclusion from doing so in the Constitution itself, or does this fall onto the shoulders of Congress to "Impeach and Remove" as they do with the Lower Court Judges? Our Founding Fathers were certainly aware of the world's ways, namely that of the "scoundrels, miscreants, and reprobates" in plain sight. Certainly there must be something the Court itself can do to rid its body of a "Justice" who has not one "clue" as to the role of a Supreme Court Justice. It is certainly NOT to be a, "voice for the unrepresented," but rather is solely to be a voice for the U.S. Constitution.

KJB once made the comment that she was excited to be in the SC so she could offer her ‘opinions’. She obviously did not understand the role to begin with. No one cares about her opinions. Their job is to judge the constitutionality of the law. That’s it. She obviously is not capable of or interested in doing that and has no business being there.

He was 87.
