The U.S. Department of Justice (DOJ) declined on Tuesday to comment on its active investigation into Kilmar Abrego Garcia, the citizen of El Salvador deported last month, after two attorneys with the Tennessee Department of Safety and Homeland Security (TDOSHS) informed The Tennessee Star of the federal investigation. The revelation that Abrego Garcia is subject to an active investigation made to The Star after it inquired about the status of the Open Records Request filed on April 17 by Michael Patrick Leahy with TDOSHS, which the agency effectively denied due to its failure to respond within seven business days, as required by the Tennessee Public Records Act (TPRA).

FTA: [In a letter sent to The Star on Tuesday, Senior Associate Counsel Casey Goggin and Associate Counsel Mary Petersen claimed the request was not denied, but that TDOSHS will need nearly two additional weeks to complete it, as any potential release of documents must consider “an ongoing investigation by the United States Department of Justice.” Because DOJ officials are currently investigating Abrego Garcia, the TDOSHS lawyers told The Star, “either the records you have requested to inspect will be available or a determination of accessibility and availability will be made” by May 9.] Ah yes, the old 'Can't comment on an Active Investigation' line. This sounds to me like the easiest, laziest way to answer and deny a request for information. On the other hand, maybe there IS an active investigation going on. If there is, it's one more way to waste the Taxpayer's money, re-re-reinvestigating a foreign Thug who has already been deported to a prison in his home country..

I suppose this is possible, but this was the standard lie used by the FBI when anyone wanted to know anything that they didn't want to tell them about. I suspect that there may be a bunch of ex-FBI or other 'criminals with badges' working for this agency.

The Open Records Request filed on April 17 by Tennessee Star Editor-in-Chief Michael Patrick Leahy, seeking video and written records from the Tennessee Highway Patrol (THP) stop of Kilmar Abrego Garcia in December 2022, was denied on Monday without explanation by the Tennessee Department of Safety and Homeland Security (TDOSHS). The Tennessee Public Records Act provides state agencies with seven business days to respond to valid Open Records Requests, and explicitly states that “[f]ailure to respond to the request” constitutes “a denial,” which gives Leahy the right to sue to compel the agency to take action.

The immigration judge who issued the final deportation order that included a “withholding of removal” for Abrego Kilmar Garcia, the illegal immigrant and alleged member of Mara Salvatrucha (MS-13) who was deported last month by the Trump administration, previously volunteered to serve as the judge for a mock court session meant to train lawyers to defend illegal immigrants. Republican senators Rand Paul, Susan Collins and Lisa Murkowski all voted in support of removing President Trump’s ability to impose tariffs under national security grounds.
