The court did not say whether the district had violated the mother’s rights, however, and instead set guidelines for the judge who had previously dismissed the suit. While the Supreme Court has upheld “the fundamental right of parents to make decisions concerning the care, custody, and control of their children,” that right “is not unlimited,” said the 9th U.S. Circuit Court of Appeals. The court told U.S. District Judge Mendez to determine whether rights claimed were “deeply rooted in this nation’s history"
