Elon Musk's attempt to unilaterally dismantle the U.S. Agency for International Development likely violated the United States Constitution, a federal judge ruled on Tuesday.
U.S. District Judge Theodore Chuang ordered Musk and his Department of Government Efficiency to immediately give USAID employees access to their "email, payment, security notification, and all other electronic systems," and ordered a pause on any efforts to shut down USAID.
Judge Chuang wrote that Musk's takeover "usurped the authority of the public's elected representatives in Congress to make decisions on whether, when, and how to eliminate a federal government agency, and of Officers of the United States duly appointed under the Constitution

Another judge who can't read and understand the division of powers and the powers allotted to the Executive, the Legislative and the Judicial branches of government. Perhaps Chief Justice Roberts could take time out from making political statements on behalf of his owners (whoever they are) and could do something he ought to do, such as help district judges understand they are not the President(s) of the United States.

Congress has the power to limit the scope of jurisdiction afforded federal courts. It ought to remove the notion a single district court can stop the government with orders embracing the entire country. And removing judges for bad behavior should require only a majority vote in both chambers.

The Secretary of State established USAID as directed by Executive Order 10973, signed on November 3, 1961. The agency was meant to implement components of the Foreign Assistance Act of 1961 (FAA; P.L. 87-195), enacted on September 4, 1961.F
Unfortunately the Judge doesn't do his research.

What an idiot judge. His order says Musk and DOGE must rehire all USAID employees etc, but Musk and DOGE do not have that authority. Musk and DOGE did not fire these people and had no authority to do so, so they cannot rehire them. This judge is really really stupid.

Pssst...Musk is a "Consultant" his recommendations were/are being followed(or not) by actual confirmed agency heads, EVERYTHING he is being credited/blamed for is actually signed off on FIRST by Other, directly in control, Administration officials. IF the judge thinks he/she/they have power over THOSE officials, or over the President himself, they are the ones he/she/they need to issue the orders to...not Musk.

Why don't you go talk to Sec. State Marco Rubio about that first, Judge? USAID was NEVER mentioned in the U.S. Constitution, nor was it ever specifically codified by Congress. The left is writhing in it's death throes.

Now, the Democrat aligned judges are proving they are simply doing the bidding for the Democrats pet projects.
I would suspect personnel decisions are beyond the actual scope of a Federal judge too.

I’m afraid we’re in for some major infighting. Chief Justice Roberts has come to the defense of Judge Boasburg and now
we have another lefty judge ordering the reinstatement of employees that fall under the jurisdiction of the State Dept. which I believe is part of the Executive Branch. This mess is going to end up in the Supreme Court and I have a very bad feeling that the decision will not be one we like.

This article indicates that Musk is dismantling the USAID. MUSK IS NOT. He only make recommendations on what is going with the money. This judge needs a mental evaluation if he thinks those that have been laid off should still have access to the State Department system. My understanding, USAID is now under the State Department.

This is total and pure judicial activism. Firstly, Yes, the United States Agency for International Development (USAID) was established by an executive order. In 1961, President John F. Kennedy signed the Foreign Assistance Act into law, which reorganized U.S. foreign aid programs. Following this, on November 3, 1961, he issued Executive Order 10973, officially creating USAID to administer nonmilitary economic assistance programs.
This means the president has the right to disband USAID by executive order. As it was created by executive order.
