Court Orders Starbucks to Pay $50 Million

A court ordered Starbucks on Friday to pay $50 million in damages to a delivery driver who was severely burned by spilled beverages, CNN reported. The jury in California sided with Michael Garcia, who was picking up drinks in a drive-through in Los Angeles when he was handed beverages with improperly secured lids. According to the lawsuit filed in the California Superior Court in 2020, he “suffered severe burns, disfigurement, and debilitating nerve damage to his genitals when hot drinks ultimately spilled” on his lap. The lawsuit ultimately accused the coffee chain of breaching its duty of care by not securing the lids, according to the report.

I don't care about Starbucks, but this is ridiculous and will be lowered or overturned on appeal. This is what trial lawyers do. Look for the dumbest in the jury pool that they think can be manipulated.

No wonder Starbucks coffee costs over seven dollars. This was all Starbucks fault? The guy in the vehicle didn't have any responsibility in reaching for the coffee? Maybe he was parked too far from the window. People have become too lazy. Get out of your car, go into the store, and secure the lid to your overpriced coffee yourself.

Absolutely ridiculous jury reward. Coffee is brewed and goes into the (paper) cup at about 193 F. Anyone who puts it between his legs without being certain that the lid is firmly on risks getting his privates scorched. Mr. Michael Garcia is not a bright man. Neither should he become a rich man for his stupidity.

The article doesn’t state how, exactly, the coffee spilled. Did he drop it? If so, it’s his fault. Did he place the cup between his legs? Again, his fault. I can’t remember the last time I saw a car that didn’t have cup holders. I don’t go to Starbucks but, if I do stop somewhere for coffee, I always double check that the lid is on securely after the coffee is handed to me. Common sense.

#28 I read a while ago about the case of the woman who sued McDonalds over hot coffee spilling in her lap. The compact car (89 Ford Probe) she was in didn't have cup holders. Stella Liebeck won 2.9 million in punitive and 200 grand in compensatory damages but the judge in the case reduced both to 480 grand and 160 grand for a total of 640 grand which was contested by both parties. McDonald's and Liebeck wound up settling out of court for an undisclosed amount. She died in 2004 at the age of 91 and McDonald's coffee temps were vastly lowered to what they are now. As far as Starbucks goes. When I do get coffee from a place like that, they are the very last choice for me due to their leftist stance on things. Such as their past treatment of military, law enforcement and first responders in uniform.

Democrat Power Depends upon Open Borders 6 replies

The Democrat party’s caterwauling over illegal alien roundups becomes only more shrill by the day. Last week, California politicians were very upset that federal agents had the temerity to disrupt the workings of a marijuana farm exploiting children for its labor. It’s always a bit jarring to see what card-carrying members of the Democrats’ premier virtue-signaling club will find worthy of their righteous indignation. Many rational observers couldn’t have guessed that Democrats would pull out all the stops to shill for “child slavery.” Of course, there was also a time when rational observers could never have guessed that Democrats would

If a Democrat from today were to be transported to the 1960s, he'd be considered a dangerous lunatic." Truer words were never spoken. Once upon a time the Democrat party defended blue-collar workers, the poor, and the middle class. Not that long ago BJ Clinton and Hussein Obama spoke about the necessity of securing the border. And very recently a rallying cry on the Left was, "No one is above the law." Times have changed. Quinnipiac now tells

California Gov. Gavin Newsom claimed that he did not want to bulldoze the remains of burned-down Palisades houses and replace them with low-income housing. But that is apparently exactly what he’s doing now, with the help of the California legislature—and Donald Trump’s special missions envoy is furious. Richard Grenell accused Newsom of lying about his fire recovery goals. Newsom had scoffed, “The claim that the Governor wants to bulldoze fire victims’ neighborhoods and replace them with ‘affordable housing’ is absurd.” But he just announced over $100 million for building low-income housing in the area of the Palisades and other burned areas, as a bill moves through the California

America is in crisis, with the left battling the ascendant right, a clash of visions between a socialist nightmare in which America becomes either a feudal, feral combination of California and a communist college campus or we re-make it into something like the glorious, golden country it once was. How does all this end? Leftists in America— and the Democrats are a leftist party that is eagerly embracing admitted communists— seem to be under the impression that normal patriotic Americans have no right to engage in their own self-governance. That’s unsustainable. We’re not giving up our self-determination. The question is whether America resolves this peacefully,

Four hours of gaslighting and cursing. I've watched most of Newsom's latest venture in podcast politics in a four-hour-long Shawn Ryan Show interview. It was a curse-word-filled apologia of his time as governor and how everything is great in LaLa Land. Here are some highlights. Gavin Newsom is in favor of gun control, but he's not. He presided over and encouraged the dumbest decriminalization of felonies, prompting massive theft rings to prey upon shop owners, causing a mass exodus of people and retail outlets, but California is one of the toughest on crime. He's not running for president, but he is.

California Governor Gavin Newsom has been boldly — and annoyingly — trying to make a case to Democrats to be the party's presidential nominee in 2028. For all intents and purposes, the 2028 primary season starts next Sunday, just after brunch. Don't shoot the messenger. Newsom knows that he has to get a head start because he's attempting to do something that is nigh on impossible in the current Dem electoral climate:

There was never a need for the military to deploy against civilians in Los Angeles. The damage is done, however.
