The Trump administration sent the far-left into an apoplectic rage on Sunday when it was announced they had detained pro-Hamas activist Mahmoud Khalil. The Department of Homeland Security took him into custody with the intent to revoke his green card and deport him after he repeatedly expressed public support for terrorism. Khalil is originally from Syria and has been one of the leaders of the antisemitic harassment campaign taking place at Columbia University. During the summer of 2024, he helped instigate and organize a group of Hamas supporters who illegally occupied public spaces around the school, becoming one of their chief "negotiators."

When is a Judge not a Judge? Is it when he is actually an activist? There really needs to be a judge for the judges. can ANYBODY say with a straight face that Engoron was really a judge, or just a political flunky?

Why are the Federal District Courts getting involved at this juncture? As proper jurisdiction with this case is in the Immigration Courts where Khalil will be given a deportation hearing before an Immigration Judge who will decide if Khalil is deportable in accordance with the immigration laws. If the Immigration Judge finds that Khalil is deportable and orders him to be deported, Khalil can then appeal his case to the Board of Immigration Appeals of the US Justice Department. That Board would then have authority to either affirm or reverse the Immigration Judge’s opinion. After all that happens, Khalil could then file a Petition of Review in the Federal District Court of jurisdiction. The decision of the District Court would then be appealable to the Federal Appeals Court of jurisdiction, and then if necessary to the US Supreme Court. So it is evident that Khalil is not going anywhere soon, and that the Federal Judge jumped the gun with his precipitous ruling that should move through the Immigration Courts process before being reviewed by a Federal District Court.
