The American Civil Liberties Union (ACLU) late Monday launched a suit challenging an executive order from President Trump seeking to end birthright citizenship for children born in the U.S. to parents who are not lawfully present.
It’s an order that contradicts the Constitution, which bestows citizenship on anyone born in the United State regardless of the status of their parents. “Denying citizenship to U.S.-born children is not only unconstitutional — it’s also a reckless and ruthless repudiation of American values. Birthright citizenship is part of what makes the United States the strong and dynamic nation that it is.

American Communist Loons Associated is doing us a favor.
This has to be litigated, and finally decided in the courts. Until now there has been only a partial reading of the words of the Amendment, entirely ignoring the critical "subject to the jurisdiction " requirement.
I'm not entirely sure which way this will be decided, but there is an excellent case to be made that "under the jurisdiction of " intended to omit people who are here illegally.

Actually, no, they are incorrect. There is sufficient previous USSC rulings on citizenship matters vis a vis the 14th which make it clear the ACLU has (intentionally) misunderstood the 14th.
As the basis of their legal argument seems to be pulling at heart strings rather than referring to previous USSC rulings in this area they know they don't have a case.

The writer of the 14th Amendment went on the floor of the U.S. Senate in 1868 and declared that the proposed amendment would not grant citizenship to children of foreign nationals who were born here. That's all the proof that the Supreme Court will need to rule in favor of President Trump.

The 14th Amendment is a Civil War era amendment that was passed to ensure that Black slaves born in the USA were granted US Citizenship. At that time because of the existence of the great oceans, the concept of mass uncontrolled illegal immigration into the USA simply was not an issue. What the Supreme Court will have to flesh out is that in each individual case, is were the babies of illegal alien parents born in the USA, considered to be within the jurisdiction of the USA at the time of their births, when their parents are citizens born in foreign countries.

By all these EOs, Trump is forcing the Supremes to rule on a great many things. I pray he gets to replace one of the libs on the court with a true conservative. Ted Cruz comes to mind.

Birthright Citizenship does not apply to children of illegal immigrants. PERIOD.
Illegal immigrants are not in the US under color of US law, and have no special right to claim birthright citizenship for their progeny.

And I'm pretty sure that with regards to #5's comment, the intent had something to do with the children of slaves before Slavery was repealed. (which we did before any other Country BTW). Intent is important

The precedent of not automatically granting US Citizenship to all babies born in the US is already set. The babies born in the US, to foreign diplomats are NOT considered to be US Citizens. QED

My understanding of the 14th amendment referred to Chinese immigrants. Look up the United States vs Wong Kim Ark in 1898. The Supreme Court held that "A child born in the United States , of parents of Chinese descent, who are naturalized citizens , that child is automatically a citizen. It was never meant to be run across the border, have a baby and run back , and have that child be a US citizen.
